A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING ADDENDUM NO. 7 TO THE
REVISED PLATINUM TRIANGLE EXPANSION PROJECT
FINAL SUBSEQUENT ENVIRONMENTAL IMPACT
REPORT NO. 339 AND MODIFICATION OF THE
MITIGATION MONITORING PLAN 106C FOR THE GENE
AUTRY WAY AND STATE COLLEGE BOULEVARD
IMPROVEMENTS PROJECT AND DETERMINING ITS
ADEQUACY TO SERVE AS THE REQUIRED
ENVIRONMENTAL DOCUMENTATION FOR THE
PROPOSED PROJECT
WHEREAS, the City of Anaheim ("Anaheim") proposes to improve the segments
of Gene Autry Way between I-5 and State College Boulevard and State College Boulevard
(westside) from Artisan Court to Gateway Office (the "Project"); and
WHEREAS, the purpose of the proposed improvements is to more effectively
accommodate existing and future traffic volumes along Gene Autry Way and State College
Boulevard, bring it into compliance with the City's Platinum Triangle Implementation Plan
Update #4 for Public Works Backbone Facilities Improvements and the County of Orange
Master Plan of Arterial Highways, enhances the corridors' aesthetics, and improve vehicular
safety; and
WHEREAS, Anaheim is the lead agency for the preparation and consideration of
environmental documents for the Project, as defined in the California Environmental Quality Act
of 1970, as amended ("CEQA") and the State of California Guidelines for the Implementation of
the California Environmental Quality Act ("State Guidelines"); and
WHEREAS, On October 26, 2010, the Anaheim City Council certified Final
Subsequent Environmental Impact Report No. 339, adopting a Statement of Findings of Fact, a
Statement of Overriding Considerations ("FSEIR No. 339") to provide for the implementation of
The Revised Platinum Triangle Expansion Project, and in conjunction with its consideration and
approval of General Plan Amendment No. 2008-00471, amendments to the Platinum Triangle
Mixed Use Overlay Zone, Zoning Reclassification No. 2008-00222 and a series of related
actions; and
WHEREAS, since approval of the FSEIR No. 339, six addenda to FSEIR No. 339
have been prepared related to various projects developed since adoption of FSEIR No. 339 and
WHEREAS, based upon the analysis included in the attached EIR Addendum No.
7, prepared in connection with the Project, together with updated and modified Mitigation
Monitoring Program No. 106C, the City has concluded that the Project will not result in new
significant impacts or substantial increases in the severity of previously identified significant
impacts and no supplemental or subsequent environmental review is required; and
WHEREAS, the Addendum No. 7 addresses the environmental effects
associated only with the changes in environmental setting or circumstances since certification of
the FSEIR No. 339 and the conclusions of the analysis in the Addendum are not substantially
different from those made in the FSEIR No. 339 and the same unavoidable significant impacts
identified in the FSEIR No. 339 remain and no new significant impacts will result and no
substantial increase in severity of impacts will result from those previously identified in the
FSEIR No. 339
WHEREAS, the City of Anaheim desires and intends to use previously -certified
FSEIR No. 339 and the Seventh Addendum to FSEIR No. 339 prepared in connection with said
Project, together with updated and modified Mitigation Monitoring Program No. 106C, as the
environmental documentation required by CEQA and the State CEQA Guidelines for each of the
above -referenced Discretionary Actions to the extent authorized by law; and
WHEREAS, said previously -certified FSEIR No. 339 and the Seventh
Addendum, together with updated and modified Mitigation Monitoring Program No. 106C, has
been presented to the City Council of the City of Anaheim for review and consideration prior to
the final approval of, and commitment to, said Project.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Anaheim, pursuant to the provisions of CEQA, that the City Council, as lead agency for the
Project, finds and declares, based upon its independent review and consideration of the Seventh
Addendum to previously -certified FSEIR No. 339 prepared in connection with the Project,
together with updated and modified Mitigation Monitoring Program No. 106C, and the
requirements of CEQA, including Section 21166 of the California Public Resources Code and
Section 15162 of the CEQA Guidelines, and the evidence received at the public hearing, that
previously -certified FSEIR No. 339 and the Seventh Addendum to FSEIR No. 339, together with
updated and modified Mitigation Monitoring Program No. 106C, are adequate to serve as the
required environmental documentation for said Project and satisfy all of the requirements of
CEQA, and that no further environmental documentation need be prepared for said Project.
BE IT FURTHER RESOLVED by the City Council of the City of Anaheim, that
staff is hereby directed to file a notice of determination with the County of Orange within five
working days of the adoption of this Resolution.
