Location: 1700 South Lewis Street
Request: The following land use entitlements are requested
to permit development of a 153-unit attached single-family
residential project: 1) a General Plan Amendment to change
the property’s land use designation from Office-Low to Mixed
Use and to increase the total amount of residential
development permitted in the Platinum Triangle Mixed-Use
land use designation to 17,501 dwelling units and decrease
the total amount of office development permitted in the
Platinum Triangle Office-High and Office-Low land use
designations to 4,309,486; 2) a Zoning Code Amendment and
an amendment to the Platinum Triangle Master Land Use
Plan to establish the Lewis District and associated
development standards and reflect the change in
development intensity described above; 3) a conditional use
permit to permit a 153-unit attached single-family residential
project with modified setbacks between buildings; 4) a
Tentative Tract Map to create a 31-lot, 153 unit residential
subdivision for condominium purposes; and, 5) a
Development Agreement to allow development of the
proposed project described above.
Environmental Determination: The Planning Commission
will consider whether a Mitigated Negative Declaration is
the appropriate environmental documentation for this
request under the California Environmental Quality Act.

Scott Koehm, Senior Planner, provided a summary of the staff report dated January 9,
2017, along with a visual presentation. He read into the record an added condition of
approval for the Development Agreement, to state, “Prior to issuance of the first building
permit the property shall enter the Platinum Triangle Community Facilities District (CFD).
To begin the annexation process the applicant shall submit a request to the Public Works
Department, Development Services Division, requesting to annex the property into the
CFD.”

Commissioner Lieberman asked staff to elaborate on the reasons for creating the Lewis
District for the subject project.
Susan Kim, Principal Planner, responded that the reason for creating the separate
mixed-use district for the Lewis District is that the only adjacent district is the Katella
District which runs along Katella and it is a very large district, therefore they did not want
to add an additional area to the Katella District. She stated alternatively it could be
added as part of the Katella District but staff determined that it was best to separate it out
and to start a new district.
Commissioner Lieberman asked staff why there was a need for a district.
Ms. Kim explained that the Platinum Triangle is divided into several different areas, with
different planning principles for each one of the districts, and indicated the districts on a
map in the presentation. Ms. Kim further explained that early in the development of the
Platinum Triangle districts were allocated on a first-come, first-serve basis, and over
time, the districts were modified into sub areas in order to conduct more specific
environmental reviews of the projects. The districts are tied to the environmental
impacts and the infrastructure capabilities that surround them.
Commissioner Lieberman thanked staff for the explanation.
Commissioner Henninger referred to the PowerPoint presentation slide showing the
building-to-building separation, and indicated per the city standards it seems like if you
have a very short run of parallel walls with narrower openings and/or walkways, that it
does work; but if they were longer parallel walls or if the buildings were taller that you
may need wider walkways in order to let in more light. Therefore, the city standards may
need to be reviewed and possibly revised so if they are short they can be narrow, and if
they are long they can be wider, etc. Furthermore, he indicated in relation to the subject
project he believes the city standards do work.
Chairperson Caldwell opened the public hearing.
Eric Nelson, applicant, Trumark Homes, 450 Newport Center, #300, Newport Beach,
stated he had reviewed the conditions of approval and agreed with the staff report, and
stated he also approves of the added condition of approval read into the record by Mr.
Scott Koehm.
Chairperson Caldwell asked if anyone was present to speak on the item. Seeing no
other persons indicating to speak, he closed the public hearing.
Commissioner Henninger stated the Platinum Triangle has a considerable amount of
office development that is allowed within the area, and he asked how much of the office
space has been proposed on it, and if there are any projects that include office
development.

Ms. Kim responded currently has been no office development constructed within the
Platinum Triangle since the Platinum Triangle Master Land Use Plan was adopted. One
project was proposed on the site where Golden Road Brewery is located but that project
was never constructed and the development agreement was terminated. Staff hopes to
see more office development within the Platinum Triangle as the market provides. The
last time a market analysis was conducted on the Platinum Triangle some type of office
recovery right around now and hopefully in the near future we will see new office
projects.
She stated that there is an abundance of jobs in the Platinum Triangle so adding
residential uses create the mixed-use balance and the trend has been to develop
residential uses so it will continue to be a balance of different uses.
Commissioner Dalati offered a motion, seconded by Commissioner Carbajal and the
MOTION CARRIED (Commissioner Bostwick absent), recommending that the Planning
Commission adopt the draft resolution attached to the January 9, 2017 staff report,
determining that a Mitigated Negative Declaration is the appropriate environmental
documentation for this request and approving General Plan Amendment No. 2015-
00503, Zoning Code Amendment No. 2015-00127, Miscellaneous Case No. 2016-
00636, Conditional Use Permit No. 2016-05877, Tentative Tract Map No. 17994 and
Development Agreement No. 2016-00004 (DEV2014-00124).
Eleanor Morris, Secretary announced that the resolution passed with six yes votes.
Chairperson Caldwell and Commissioners Carbajal, Dalati, Henninger, Lieberman and
Seymour voted yes. Commissioner Bostwick was absent.
