Environmental Determination: The Planning Commission will consider whether to find the project to be Categorically Exempt from the provisions of the California Environmental Quality Act and Guidelines as a Class 1 (Existing Facilities) Categorical Exemption. No modifications are proposed to the existing buildings on site. Environmental Determination: The Planning Commission will consider whether to find the project to be Categorically Exempt from the provisions of the California Environmental Quality Act and Guidelines as a Class 1 (Existing Facilities) Categorical Exemption. Resolution No. PC2017-053 Resolution No. PC2017-054 (Lieberman / Armstrong) Approved, with modifications to the Tentative Parcel Map resolution by deleting Condition Nos. 9 and 10. DISCUSSION TIME: 10 minutes (5:17 to 5:27 p.m.) JUNE 12, 2017 PLANNING COMMISSION ACTION AGENDA 06-12-2017 Page 5 of 5 ITEM NO. 5 ZONING CODE AMENDMENT NO. 2017-00140 (DEV2017-00047) Location: Citywide Request: A City-initiated amendment to Title 18 (Zoning) of the Anaheim Municipal Code modifying various Zoning Code provisions in response to recent changes to State law pertaining to Accessory Dwelling Units also referred to as second units, in-law units or granny flats. If amendments to the Zoning Code are adopted, concurrent revisions to the Anaheim Municipal Code may be required for consistency purposes. Environmental Determination: The proposed action qualifies for a statutory exemption from the provisions of the California Environmental Quality Act (“CEQA”) per State CEQA Guidelines Section 15282(h). This section establishes a statutory exemption for “the adoption of an ordinance regarding second units in a single-family or multifamily residential zone by a city or county to implement the provisions of Sections 65852.1 and 65852.2 of the Government Code as set forth in Section 21080.17 of the Public Resources Code.” Approved a motion for continuance to July 10, 2017, as requested by staff, in order to allow for staff to research matters relating to larger unit sizes correlating to larger lots, clarification of tenancy handled at the time of sale, and owner occupancy requirements.
