If amendments to the Zoning Code are adopted, concurrent revisions to the Anaheim Municipal Code may be required for consistency purposes. Environmental Determination: The proposed action qualifies for a statutory exemption from the provisions of the California Environmental Quality Act (“CEQA”) per State CEQA Guidelines Section 15282(h). This section establishes a statutory exemption for “the adoption of an ordinance regarding second units in a single-family or multifamily residential zone by a city or county to implement the provisions of Sections 65852.1 and 65852.2 of the Government Code as set forth in Section 21080.17 of the Public Resources Code.” This item was continued from the June 12, 2017 Planning Commission meeting. Environmental Determination: The Planning Commission will consider whether to find the project to be Categorically Exempt from the provisions of the California Environmental Quality Act and Guidelines as a Class 32 (In-fill Development) Categorical Exemption. * The number of units has been reduced from 42 to 41 subsequent to advertisement for this item. Environmental Determination: The Planning Commission will consider whether to find the project to be Categorically Exempt from the provisions of the California Environmental Quality Act and Guidelines as a Class 1 (Existing Facilities) Categorical Exemption. Approved a motion for continuance of the item to August 7, 2017 to allow additional time for the applicant to meet with adjacent neighbors to address concerns raised at today’s public hearing. (Dalati / Armstrong) VOTE: 6-0 Chairperson Dalati and Commissioners Armstrong, Carbajal, Gillespie, Keys and White voted yes. Commissioner Lieberman was absent. Five persons spoke expressing opposition and concerns relating to the subject request. In addition, video recordings were presented by the applicant and adjacent neighbors to demonstrate the amount of noise being generated by the church, as well as potential privacy impacts on the neighbors west of the subject site. IN SUPPORT: A person spoke in favor of the subject request. DISCUSSION TIME: 56 minutes (5:51 to 6:47 p.m.) JULY 10, 2017 PLANNING COMMISSION ACTION AGENDA 07-10-2017 Page 6 of 7 ITEM NO. 6 CONDITIONAL USE PERMIT NO. 2017-05919 ADMINISTRATIVE ADJUSTMENT NO. 2017-00406 DETERMINATION OF PUBLIC CONVENIENCE OR NECESSITY NO. 2017-00136 (DEV2017-00051) Location: 1921-1931 East Wright Circle Request: The applicant requests approval of the following land use entitlements: (i) a conditional use permit to permit a brewery with a tasting room and outdoor patio area within an existing industrial building; (ii) an administrative adjustment to permit fewer parking spaces than required by the Zoning Code; and, (iii) a determination of public convenience or necessity to permit a brewery and tasting room with on and off-premises sales and consumption of alcoholic beverages. Environmental Determination: The Planning Commission will consider whether to find the project to be Categorically Exempt from the provisions of the California Environmental Quality Act and Guidelines as a Class 1 (Existing Facilities) Categorical Exemption. Approved a motion for continuance of the item to August 7, 2017 to allow additional time for the applicant to meet with adjacent neighbors to address concerns raised at today’s public hearing. DISCUSSION TIME: 1 hour and 6 minutes (6:48 to 7:54 p.m.) JULY 10, 2017 PLANNING COMMISSION ACTION AGENDA 07-10-2017 Page 7 of 7 ITEM NO. 7 CONDITIONAL USE PERMIT NO. 2013-05678 (DEV2013-00072) Location: 1256 North Magnolia Avenue Request: A City-initiated request to revoke a previously-approved conditional use permit for an existing storage facility which includes a temporary modular office, indoor and outdoor storage of recreational and commercial vehicles, automobiles, trucks, trailers, miscellaneous equipment, and auto repair services. Environmental Determination: The Planning Commission will consider whether to find the project to be Categorically Exempt from the provisions of the California Environmental Quality Act and Guidelines as a Class 21 (Enforcement Actions by Regulatory Agencies) Categorical Exemption. Approved a motion for continuance of the item to September 6, 2017 to allow additional time for the applicant to submit a complete set of plans addressing the unpermitted work as it currently exists, and for an engineer or design professional to provide the applicant with the appropriate solutions to address the substandard work completed on-site. The Planning Commission further directed that Fire Department staff conduct an on-site inspection to immediately address any potential life safety issues.
