RES-2017-114RESOLUTION N02017- 114 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING A LETTER OF UNDERSTANDING BETWEEN THE ANAHEIM POLICE MANAGEMENT ASSOCIATION AND THE CITY OF ANAHEIM WHEREAS, the City of Anaheim and the Anaheim Police Management Association have met and conferred and reached an understanding to establish reimbursable overtime opportunities for Police Lieutenants and Police Captains; and WHEREAS, the Anaheim. Police Management Association is in agreement with the recommendation contained in said Letter of Understanding; and WHEREAS, as a result thereof, the Letter of Understanding dated June 19, 2017 between the parties has been prepared and signed; and WHEREAS, the City Council of the City of Anaheim does find that it is in the best interest of the City of Anaheim to approve said Letter of Understanding. NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Anaheim that the Letter of Understanding dated June 19, 2017 between the Anaheim Police Management Association and the City of Anaheim, a copy of v,.,hich is attached hereto and incorporated herein by reference herein, is hereby approved. THE FOREGOING RESOLUTION is approved and adopted by the City Council of the City of Anaheim this 25th day of July, 2017 by the following roll call vote: AYES: Mayor Tait and Council members Vanderbilt, Murray, Barnes, Moreno, Kring, and Faessel NOES: None ABSENT: None ABSTAIN: None MAYOR OF THE CITY OF ANAHEIM AT',`� CITY CLERK OF TH CITY OF ANAHEIM LETTER OF UNDERSTANDING between the ANAHEIM POLICE MANAGEMENT ASSOCIATION and the CITY OF ANAHEIM The Anaheim Police Management Association (hereinafter "APMA") and the City of Anaheim (hereinafter "ANAHEIM"), after meeting and conferring, have reached an agreement with regard to reimbursable overtime. The Parties have agreed to the following: (1) All classes listed in Appendix "A" of the Memorandum of Understanding ("MOU") between the APMA and ANAHEIM shall be compensated for overtime work at the rate of one and one-half (1 'h) times top step, Police Officer — Senior Master Advanced or top step, Police Sergeant — Senior Master Advanced. Provided that such employees have been requested by a Police Sergeant assigning reimbursable overtime, and the work normally would have been performed by employees in the Anaheim Police Association ("APA") unit. (2) These assignments shall be permitted to be worked by Lieutenants and Captains voluntarily and at their choosing, and the assignments shall only be reimbursable extra duty events, specifically at the Honda Center, Angel Stadium, Anaheim Convention Center, Disneyland Resort, The Garden Walk, or any other extra duty assignment that is reimbursable to the City of Anaheim or paid for by a grant. (3) An extra duty assignment(s) must be approved by the Police Chief or his/her designee prior to a Lieutenant or Captain working reimbursable overtime. (4) A Lieutenant or Captain who is absent from work due to sick leave, vacation, or any other reason shall be prohibited from working overtime on such day he/she is absent or the weekend immediately following such absence. For example, an employee cannot be absent from work on a Friday due to sick leave or vacation and then work overtime hours on Sunday. (5) Extra duty, reimbursable overtime shall not interfere with the normal duties and responsibilities expected of a Lieutenant or Captain, or overlap or be performed in lieu of regular scheduled hours. (6) The assignment shall determine the appropriate rate of pay, depending upon the position to be filled as determined by the Police Sergeant assigning the event. (7) This Letter of Understanding may be terminated by either Party for any reason with thirty (30) days written notice.
