A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM IDENTIFYING THE TERMS AND CONDITIONS
FOR ANAHEIM FIRE AND RESCUE PERSONNEL
ASSIGNED TO AN EMERGENCY INCIDENT AND
RESCINDING RESOLUTION NO. 2016-176.
WHEREAS, the City of Anaheim is a public agency located in the County of Orange,
State of California; and
WHEREAS, it is the City's desire to fairly and lawfully pay its employees for time
worked; and
WHEREAS, the City has in its employ Anaheim Fire and Rescue ("AF&R) response
personnel that include the following positions: Fire Chief, Deputy Chief, Assistant Chief,
Division Chief, Battalion Chief, Fire Captain, Engineer, Firefighter/Paramedic, Firefighter/EMT,
Part Time Emergency Management Officer, Public Safety Public Information Officer, Police
Sergeant, Fire Marshal, Deputy Fire Marshal, Medical Care Provider, Communications
Supervisor, Fire Communications Operations Supervisor, Fire Communications Shift Supervisor,
Fire Dispatch Operations Manager, Fire Dispatcher II, Training Facility Administrator, and
Administrative Analyst.
WHEREAS, the City of Anaheim will compensate its employees portal to portal while in
the course of their employment and away from their official duty station and assigned to an
emergency incident, in support of an emergency incident, or pre-positioned for an emergency
response; and
WHEREAS, the City will compensate its employees overtime in accordance with the
current Memoranda of Understanding (the "MOUs") between the City of Anaheim, the Anaheim
Firefighters' Association, and the Anaheim Police Association, or the Anaheim Municipal
Employees Association, General Employees while in the course of their employment and away
from their official duty station and assigned to an emergency incident, in support of an
emergency incident, or pre-positioned for emergency response.
NOW, THEREFORE, BE IT RESOLVED:
Section 1. The foregoing recitals are incorporated into this Resolution by this
reference, and constitute a material part of this Resolution.
Section 2. Resolution No. 2016-176 is hereby rescinded in its entirety.
Section 3. City of Anaheim personnel shall be compensated according to the MOUs
and City of Anaheim rules and regulations.
Section 4. Personnel will be compensated (portal to portal) beginning at the time of
dispatch to the return to jurisdiction when equipment and personnel are in service and available
for an emergency response.
Section 5. This Resolution shall be effective immediately upon adoption.
THE FOREGOING RESOLUTION is approved and adopted by the City Council of the
City of Anaheim this 15th day of August , 2017, by the following roll call vote:
