AN UNCODIFIED ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF ANAHEIM DISSOLVING CITY OF
ANAHEIM COMMUNITY FACILITIES DISTRICT NO. 1989-
1 (SYCAMORE CANYON)
WHEREAS, the City Council (the "City Council") of the City of Anaheim (the "City")
has previously formed the City of Anaheim Community Facilities District No. 1989-1 (Sycamore
Canyon) (the "Community Facilities District") under the Mello -Roos Community Facilities Act
of 1982 (the "Act"); and
WHEREAS, the qualified electors of the Community Facilities District authorized the
levy of special taxes (the "Special Taxes") within the Community Facilities District to finance
certain public facilities (the "Facilities"); and
WHEREAS, pursuant to the Act, a Notice of Special Tax Lien with respect to the
Community Facilities District was recorded in the Office of the County Recorder of the County
of Orange on February 24, 1989, as Instrument No. 89-099002 and any subsequent addendums,
if any, thereto (together hereinafter, the "Notice of Special Tax Lien"); and
WHEREAS, bonds (the "Bonds") payable from the Special Taxes were issued by the
Community Facilities District from time to time to finance and refinance the Facilities; no other
debt has been incurred by the Community Facilities District; and
WHEREAS, the City Council has determined that no additional Facilities are to be
financed by the Community Facilities District; and
WHEREAS, all debt service on the Bonds has been paid and no Bonds remain
outstanding; and
WHEREAS, as the Bonds are no longer outstanding, the Community Facilities District is
not obligated to pay any outstanding debt and, as no additional Facilities are to be financed, the
Community Facilities District has no authorization to levy the Special Taxes; and
WHEREAS, the City Council desires to dissolve the Community Facilities District
pursuant to Section 53338.5 of the Act; and
WHEREAS, the City is authorized to undertake all of the above pursuant to the
Constitution and other applicable laws of the State of California.
THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS
FOLLOWS:
Section 1. The foregoing recitals are true and correct and the City Council so finds.
Section 2. The City Council hereby finds and determines that the Community Facilities
District is not obligated to pay any outstanding debt.
Section 3. The City Council hereby finds and determines that the Community Facilities
District has no authorization to levy the Special Taxes.
Section 4. The Community Facilities District is hereby dissolved.
Section 5. The Acting City Clerk of the City is hereby directed to cause to be recorded
with the County Recorder of the County of Orange an addendum to the Notice of Special Tax
Lien, which shall state that the Community Facilities District and all associated liens, if any,
have been dissolved.
Section 6. The officers, employees and agents of the City are hereby authorized and
directed to take all actions and do all things which they, or any of them, may deem necessary or
desirable to accomplish the purposes of this Ordinance and not inconsistent with the provisions
hereof.
Section 7. Neither the adoption of this Ordinance nor the repeal of any other ordinance
of this City shall in any manner affect the prosecution for violations of ordinances which
violations were committed prior to the effective date hereof, nor be construed as a waiver of any
license or penalty or the penal provisions applicable to any violation thereof. To the extent the
provisions of this Ordinance are substantially the same as ordinance provisions previously
adopted by the City relating to the same subject matter, the provisions of this Ordinance shall be
construed as restatements and continuations of those provisions and not as new enactments or
amendments of the earlier provisions.
Section 8. The City Council of the City of Anaheim hereby declares that should any
section, paragraph, sentence, phrase, term or word of this Ordinance be declared for any reason
to be invalid, it is the intent of the City Council that it would have adopted all other portions of
this Ordinance independent of the elimination herefrom of any such portion as may be declared
invalid. If any section, subdivision, paragraph, sentence, clause or phrase of this Ordinance is for
any reason held to be invalid or unconstitutional, such decision shall not affect the validity of the
remaining portions of this Ordinance. The City Council hereby declares that it would have
passed this Ordinance, and each section, subdivision, paragraph, sentence, clause and phrase
thereof, irrespective of the fact that any one (or more) section, subdivision, paragraph, sentence,
clause or phrase had been declared invalid or unconstitutional.
Section 9. The Acting City Clerk shall certify to the passage of this Ordinance and shall
cause the same to be printed once within fifteen (15) days after its adoption in the Anaheim
Bulletin, a newspaper of general circulation, published and circulated in the City of Anaheim,
and thirty (30) days from and after its final passage, it shall take effect and be in full force.
