A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM APPROVING A FAST TRACKED AND NO -COST
PLAN REVIEW PROGRAM; WAIVING PUBLIC WORKS,
BUILDING, PLANNING AND FIRE PLAN CHECK FEES
APPLICABLE TO THE REPAIR OR RECONSTRUCTION OF
STRUCTURES DAMAGED AS A RESULT OF THE CANYON
FIRE 2; AND, WAIVING THE SPECIMEN TREE REMOVAL
PERMIT FEE FOR TREES WITHIN THE BURN AREA AND
DAMAGED BY THE CANYON FIRE 2
WHEREAS, the Canyon Fire 2 swept through the City of Anaheim ("City") on
October 9, 2017; and
WHEREAS, on October 9, 2017, the Director of Emergency Services of the City of
Anaheim (the "Director") issued a proclamation of the existence of a local emergency pursuant
to California Government Code Section 8630 and Anaheim Municipal Code Section 6.04.060 as
a result of the Canyon Fire 2; and
WHEREAS, on October 12, 2017, the City Council ratified the proclamation of local
emergency issued by the Director pursuant to Government Code Section 8630 and Anaheim
Municipal Code Section 6.04.060; and
WHEREAS, as a result of the Canyon Fire 2, thirty-one residential structures in
Anaheim have been completely destroyed or partially damaged. Additionally, a limited number
of trees designated by the Anaheim Municipal Code as "Specimen Trees" were damaged; and
WHEREAS, it is important to clean up properties as soon as possible to minimize
airborne debris, safety hazards and unsightly conditions; and
WHEREAS, it is in the best interests of the City to facilitate the evaluation and, if
appropriate removal, of burned Specimen Trees that may be creating a hazard and the prompt
repair and re -construction of structures damaged or destroyed as a result of the Canyon Fire 2 in
order to bring the same into compliance with all applicable building and fire codes as soon as
possible.
WHEREAS, the on November 7, 2017, the City Council designated the City as a City
of Kindness and affirming our commitment to fostering community and building resiliency
through everyday acts of kindness.
WHEREAS, the Canyon Fire 2 has created hardship for many families as their homes
have been severely damaged and destroyed, families have been displaced, and personal
mementos destroyed.
WHEREAS, the City is committed to supporting the recovery and rebuilding efforts.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES
HEREBY RESOLVE AS FOLLOWS:
SECTION 1.
The Specimen Tree Removal Permit fee required by Anaheim Municipal Code
Section 18.18.040 will be waived in order to facilitate the evaluation process for the removal of a
Specimen Tree that was badly damaged in the Canyon Fire 2 and may be creating a hazard. The
fee waiver shall apply only to Specimen Trees located within the burn area as determined by the
Fire Marshal.
SECTION 2.
Grading, Building, Planning and Fire plan check fees otherwise applicable to the
repair and/or reconstruction of residential structures damaged as a result of the Canyon Fire 2 are
hereby temporarily waived for completed applications received on or before December 19, 2019,
unless otherwise waived by City Council prior to that date.
A. The fee waiver shall apply only to "in-kind" (i.e., the same square footage plus up
to 499 sq. ft., height, number of stories, fence materials, etc.) repair and reconstruction of
residential structures, and shall not apply to any portion of a rebuilt residential structure that is
greater than the original square footage at the time the residential structure was destroyed plus up
to 499 sq. ft..
B. Only property owners of damaged or destroyed residential structures as of the
date of the Canyon Fire 2 are eligible for this fee waiver, and this waiver cannot be applied to a
vacant parcel or any other non -fire damaged parcel.
C. A new buyer of a fire -damaged parcel is not eligible to receive this waiver of fees.
For purposes of this Resolution, "new buyer" shall mean any buyer whose escrow closed after
October 19, 2017.
E. All new construction undertaken in the repair or replacement of residential
structures shall comply with all applicable planning, zoning, building, and fire code
requirements, as determined by the Building Official, Fire Marshal, and City Engineer, including
provisions relating Nonconformities set forth in the Anaheim Municipal Code.
F. For purposes of this Resolution, "residential structures" shall mean main
residential building, attached garage, detached garage, accessory buildings, irrigation systems,
pool, pool equipment, fences, walls, patio covers, and decks.
G. Any fees waived shall be waived once per lot. Unless waived pursuant to
this Resolution, all other fees shall imposed pursuant to pursuant to resolution of the City
Council shall be collected.
H. Fees for Anaheim Public Utilities services are not subject to this action.

SECTION 3.
Neither this Resolution nor anything contained herein shall be construed as amending
or modifying any existing fee resolution of the City of Anaheim.
