Environmental Determination: The Planning Commission will consider whether the proposed action is Categorically Exempt from the requirements to prepare additional environmental documentation per California Environmental Quality Act (CEQA) Guidelines, Section 15301, Class 1 (Existing Facilities). Resolution No. PC2018-013 (White / Lieberman) Approved VOTE: 7-0 Chairperson Dalati and Commissioners Armstrong, Carbajal, Gillespie, Keys, Lieberman and White voted yes. Environmental Determination: The Planning Commission will consider whether the proposed action is Categorically Exempt from the requirements to prepare additional environmental documentation per California Environmental Quality Act (CEQA) Guidelines, Section 15303, Class 3 (New Construction). Resolution No. PC2018-014 (Carbajal / White) Approved with modifications to the conditions of approval which were submitted to the Planning Commission at the public hearing by staff related to timing for the maintenance and occupancy covenants, alternative options to satisfy the parking requirements until the auxiliary parking lot is constructed, requiring that Parcel Map 2017-112 to be approved and recorded prior to issuance of a building permit, and other minor clarifications. VOTE: 6-1 Chairperson Dalati and Commissioners Armstrong, Carbajal, Keys, Lieberman and White voted yes. Commissioner Gillespie voted no. Project Planner: Joanne Hwang jhwang@anaheim.net OPPOSITION: None IN SUPPORT: Two pieces of written correspondence were received expressing support, and included a petition with twenty-four signatures in support of the proposed project. DISCUSSION TIME: 26 minutes (5:11 to 5:37 p.m.) MARCH 5, 2018 PLANNING COMMISSION ACTION AGENDA 03-05-2018 Page 4 of 4 ITEM NO. 4 CONDITIONAL USE PERMIT NO. 2017-05911 (DEV2017-00031) Location: 1041 and 1065 North PacifiCenter Drive, and 1071 and 1081 North Tustin Avenue Request: To demolish 26,000 square feet of office space and remove approximately 310,000 square feet of surface parking lots and 100,000 square feet of landscaping; and, to construct 406 apartment units and 5,000 square feet of new commercial space. The request includes permitting development with an interior structural setback and landscape setback that is less than the setback area required by the Anaheim Municipal Code. Environmental Determination: The Planning Commission will consider whether the proposed action is statutorily exempt from the requirements to prepare additional environmental documentation pursuant to Section 21155.4 of the California Environmental Quality Act (CEQA) Statute. Resolution No. PC2018-015 (Gillespie / Carbajal) Approved, with the following modifications: Modified Condition No. 44 to state that it is the responsibility of the property owner/developer to remove and relocate any existing traffic signal poles and equipment affected by project construction at the intersections of Tustin/Pacificenter and La Palma/Pacificenter if necessary at the project’s expense. Modified Condition No. 56 adding language to state that in the event that the rail road crossing has not been widened, the developer shall join existing improvements at the westerly property line and transition the 7-ft widening continuing into the right turn pocket to the satisfaction of the City Engineer. VOTE: 7-0 Chairperson Dalati and Commissioners Armstrong, Carbajal, Gillespie, Keys, Lieberman and White voted yes. Project Planner: Scott Koehm skoehm@anaheim.net OPPOSITION: None IN SUPPORT: Four persons spoke expressing support of the project, and one of the persons who spoke submitted four pieces of written correspondence expressing support of the subject project.
