• AMENDING TITLE 1 OF THE ANAHEIM MUNICIPAL
CODE BY ADDING THERETO CHAPTER 1.05

THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN
SECTION 1.
That Title 1 of the Anaheim Municipal Code be, and
the same is hereby amended by adding thereto Chapter 1.05 --
PERSONNEL SYSTEM, reading as follows:
"CHAPTER 1.05 -- PERSONNEL SYSTEM
"SECTION 1.05.010 ADOPTION OF PERSONNEL SYSTEM. In order
to formalize an equitable and uniform procedure for dealing
with personnel matters; to attract to municipal service the
best and most competent persons available; to assure that
appointments and promotions of employees will be based on
merit and fitness; and to provide a reasonable degree of
security for qualified employees, the following personnel
system is hereby adopted:
"SECTION 1.05.020 ADMINISTRATION OF PERSONNEL SYSTEM.
The personnel system established by this chapter shall be
administered by a Personnel Director appointed by the City
Manager and approved by the City Council. The Personnel
Director, under the direction of the City Manager, shall:
(a) Administer all the provisions of this
chapter and of the personnel rules.
(b) Prepare and recommend revisions and
amendments to the personnel rules.
Such revisions and amendments shall
be submitted to the City Council for
adoption.
(c) Maintain and administer a position
classification plan and a plan of com-
pensation. Positions having similar
duties and responsibilities shall be
classified and compensated on a uniform
basis.
"The City Council, upon recommendation of the Personnel
Director and the City Manager, may contract with any
qualified person or agency for the performance of such
technical services as may be necessary for the effective
operation of the personnel system.

"SECTION 1.05.030 SCOPE. All offices and positions of
• the City are divided into the classified service and the
exempt service. The exempt service shall include the
following.
(a) All elected officials and members of
boards and commissions.
(b) The City Manager and the City Attorney.
(c) Volunteer personnel and personnel
appointed to serve without pay.
(d) Architects, consultants, counsel, and
othersrendering temporary professional
service.
(e) Such positions involving seasonal or
part-time employment as may be specifi-
cally placed in the exempt service by
the Personnel Director.
The classified service shall include all other positions
that are not specifically placed in the exempt service
by this chapter.
"The provisions of this chapter and of the personnel
rules shall apply only to the classified service unless
otherwise specifically provided.
"SECTION 1.05.040 ADOPTION OF RULES. Personnel rules,
prepared by the Personnel Director (under the direction
of the City Manager) subject to this chapter and to
revision by the City Council, shall be adopted, and may be
amended from time to time, by resolution of the City
Council. The rules shall establish specific procedures
and regulations governing the operation of the personnel
system.
"SECTION 1.05.050 APPOINTMENTS. Appointments to vacant
positions in the classified service shall be made in
accordance with the personnel rules. Appointments and
promotions shall be based on merit and fitness to be
ascertained so far as practicable by competitive examina-
tions. Examinations shall be used and conducted to aid
in the selection of qualified employees, and shall consist
of recognized selection techniques which will, in the
opinion of the Personnel Director, test fairly the
qualifications of candidates.
"SECTION 1.05.060 TENURE OF EMPLOYEES. Tenure of
employees in the classified service shall be subject to
good behavior, satisfactory work performance, necessity
for the performance of work, and the availability of funds.
• "SECTION 1.05.070 POLITICAL ACTIVITY. Any employee in
the classified service shall not:
(a) Seek or accept election, nomination, or
appointment as an officer of a political
club or organization.

(b) Take an active part in a county or
municipal political campaign.
• (c) Serve as a member of a committee of such
club, organization, or circle.
(d) Act as a political worker at the polls or
distribute badges, pamphlets, dodgers, or
handbills of any kind favoring or opposing
any candidate for election or nomination
to a county or city office.
This chapter does not prevent any officer or employee from:
(a) Becoming or continuing to be a member of
a political club or organization.
(b) Attendance at a political meeting.
(c) Enjoying entire freedom from all inter-
ference in casting his vote.
(d) Seeking or accepting election or appointment
to public office while on leave of absence.
(e) Seeking signatures to any initiative or
referendum petition directly affecting his
rates of pay, hours of work, retirement,
or other working conditions.
(f) Distributing badges, pamphlets, dodgers, or
handbills or other participation in any
campaign in connection with such petition,
if the activity is not carried on during
hours of work or when he is dressed in the
uniform required in any department of the
city government.
The violation of any provision of this section is grounds
for discharge of any officer or employee.
"SECTION 1.05.080 DISCRIMINATION. There shall be no
discrimination against any person seeking employment or
against any employee in the classified service because of
any considerations of religious or political affiliation
or belief, membership in or attitude toward any employee
organization, ethnic or geographical origin, or race.
"SECTION 1.05.090 SOLICITATION OF CONTRIBUTIONS. No
officer, agent, clerk, or employee, under the government
of the city, and no candidate for any city office shall,
directly or indirectly, solicit or receive, or be in any
manner concerned in soliciting or receiving, any assess-
ment, subscription, contribution, or political service,
whether voluntary or involuntary, for any political
purpose whatsoever, from anyone on the employment
• lists or holding any position under the provisions of
this chapter.

"SECTION 1.05.110 APPROPRIATION OF FUNDS. The City
Council shall appropriate such funds as are necessary to
carry out the provisions of this chapter.
"SECTION 1.05.120 SEVERABILITY. If any section, sub-
section, subdivision, sentence, clause, or phrase of this
chapter is, for any reason, held to be unconstitutional,
such decision shall not affect the validity of the remain-
ing portions of this chapter. The City Council hereby
declares that it would have passed this chapter, and each
section, subsection, subdivision,_sentence, clause, and
phrase thereof, irrespective of the fact that any one or
more sections, subsections, subdivisions, sentences, clauses,
or phrases be declared unconstitutional."
SECTION 2.
The City Clerk shall certify to the passage of
this ordinance and shall cause the same to be printed once
within fifteen (15) days after its adoption, in the Anaheim
Bulletin, a newspaper of general circulation, printed, published
and circulated in said City, and thirty (30) days -from and after
its final passage it shall take effect and be in full force.
THE FOREGOING ORDINANCE is approved and signed by
