RES-1989-346 RESOLUTION NO. 89R -- 346
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM AMENDING PERSONNEL RULE 6, PREMIUM PAY
AS SET FORTH IN RESOLUTION NO. 88R -166.
WHEREAS, on April 26, 1988, the City Council adopted
Resolution No. 88R -166 adopting Personnel Rules covering management,
confidential and non - represented part -time employees; and
WHEREAS, the Human Resources Director recommended in a staff report
dated August 1, 1989, that the Premium Pay Rule be amended to define policies
related to overtime exemptions for certain part -time classifications; and
WHEREAS, the City Council of the City of Anaheim does find that the
amendment to the Premium Pay Rule is in the best interests of the City of
Anaheim.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Anaheim that Subsection 6.042 of Personnel Rule 6 as set forth in Resolution
No. 88R -166 be amended to read as follows:
"6.042 Certain part -time classifications working
in designated Recreation Programs shall
be exempt from overtime. The programs of
Aquatics, Playgrounds, Day Camp and Pearson
Park Theatre have been designated as meeting
the Recreation Employee Exemption as specified
in Section 260 of the Fair Labor Standards Act.
Specified part -time employees working in these
programs shall be compensated at the straight
time hourly rate for all hours worked."
BE IT FURTHER RESOLVED that the effective date of said amendment to
Resolution No. 88R -166 is August 4, 1989.
AND BE IT FURTHER RESOLVED that except to the extent amended,
Resolution No. 88R -166 shall remain in full force and effect.
THE FOREGOING RESOLUTION is approved and adopted by the City
Council of the City of Anaheim this 8th day of August , 1989.
