The proposed use would occupy approximately 27,000 square feet within the first floor of an existing office building. Environmental Determination: The Planning Commission will consider whether the proposed action is Categorically Exempt from the requirements to prepare additional environmental documentation per California Environmental Quality Act (CEQA) Guidelines, Section 15301, Class 1 (Existing Facilities). SEPTEMBER 5, 2018 PLANNING COMMISSION ACTION AGENDA 09-05-2018 Page 3 of 4 ITEM NO. 3 CONDITIONAL USE PERMIT NO. 2017-05930 VARIANCE NO. 2018-05102 (DEV2017-00080) Location: 191 South Imperial Highway Request: The applicant requests approval of the following zoning entitlements: (i) a conditional use permit to allow for the construction of a new 3,233 square foot fast food restaurant with a drive-through lane and a mural on the building wall, and (ii) a variance to permit reduced landscape setbacks (Raising Cane’s Chicken Fingers). Environmental Determination: The Planning Commission will consider whether the proposed action is Categorically Exempt from the requirements to prepare additional environmental documentation per California Environmental Quality Act (CEQA) Guidelines, Section 15303, Class 3 (New Construction). Resolution No. PC2018-045 (Dalati / Gillespie) Approved with the following added conditions of approval as read into the record by staff during the public hearing: That the hours of operation shall be limited to Sunday through Thursday, 9:00 a.m. to 12:00 a.m.; and Friday and Saturday, 9:00 a.m. to 2:00 a.m. That the speaker box volume on the menu order board shall be set to minimize noise impacts to the surrounding residential properties. The volume shall be lowered at 10:00 p.m. so not to be audible from residential property lines. That the neon accent lighting on the top of the parapet wall along the south building wall facing the residential properties shall not be permitted. VOTE: 5-1 Chairperson Carbajal and Commissioners Armstrong, Dalati, Gillespie and Keys voted yes. Commissioner White voted no. Commissioner Lieberman was absent. DISCUSSION TIME: 54 minutes (5:02 to 5:56 p.m.) SEPTEMBER 5, 2018 PLANNING COMMISSION ACTION AGENDA 09-05-2018 Page 4 of 4 ITEM NO. 4 GENERAL PLAN AMENDMENT NO. 2011-00484 RECLASSIFICATION NO. 2011-00242 (DEV2011-00035) Location: Ball Road Basin Request: Amendments to the City of Anaheim’s General Plan and Zoning Map to allow commercial development of the project site (Ball Road Basin). The proposed project would change the City’s General Plan Land Use Designation for the Ball Road Basin from Open Space to General Commercial and the Zoning from Transitional (T) and Industrial (I) Zones to the General Commercial (C-G) Zone. In addition, the proposed project would amend the General Plan Circulation and Green Elements to add a Planned Class 1 Bike Path/Trail Study Area along the northern, eastern and southern edges of Ball Road Basin. The proposed project does not include a specific development plan for Ball Road Basin. Environmental Determination: The Planning Commission will consider whether to recommend City Council certification of Environmental Impact Report No. 2012-00345 and adoption of a Mitigation Monitoring and Reporting Program, Findings of Fact and a Statement of Overriding Considerations for the proposed project. Approved request for continuance to October 1, 2018 (Gillespie / White) VOTE: 6-0 Chairperson Carbajal and Commissioners Armstrong, Dalati, Gillespie, Keys and White voted yes.
