Reports and Recommendations ITEM NO. 1A ZONING CODE AMENDMENT NO. 2018-00155 (DEV2018-00103) Location: Citywide Request: An amendment to Section 18.38.125 (Emergency Shelters) of Title 18 (Zoning) of the Anaheim Municipal Code to clarify location, permitting, and operational requirements for emergency shelters and provide regulatory relief in the event of a “Declaration of a shelter crisis” as defined by California Government Code Section 8698(d). Environmental Determination: The Planning Commission will consider whether the proposed action is exempt from the requirements to prepare additional environmental documentation per California Environmental Quality Act (CEQA) Guidelines, Section 15060(c)(2). Approved request as recommended by staff (Lieberman / Dalati) VOTE: 5-1 Chairperson Carbajal and Commissioners Armstrong, Dalati, Keys and Lieberman voted yes. Commissioner White voted no. Commissioner Gillespie was absent for this item. Environmental Determination: The Planning Commission will consider whether the proposed action is Categorically Exempt from the requirements to prepare additional environmental documentation per California Environmental Quality Act (CEQA) Guidelines, Section 15303, Class 3 (New Construction or Conversion of Small Structures). Resolution No. PC2018-061 (Dalati / Gillespie) Approved VOTE: 7-0 Chairperson Carbajal and Commissioners Armstrong, Dalati, Gillespie, Keys, Lieberman and White voted yes. Project Planner: Wayne Carvalho wcarvalho@anaheim.net OPPOSITION: None DISCUSSION TIME: 8 minutes (5:05 to 5:13 p.m.) NOVEMBER 14, 2018 PLANNING COMMISSION ACTION AGENDA 11-14-2018 Page 4 of 4 ITEM NO. 3 CONDITIONAL USE PERMIT NO. 2018-05973 (DEV2018-00067) Location: 1550 South Lewis Street Request: For a conditional use permit to permit a crematory business to embalm human remains within an existing industrial building. Environmental Determination: The Planning Commission will consider whether the proposed action is Categorically Exempt from the requirements to prepare additional environmental documentation per California Environmental Quality Act (CEQA) Guidelines, Section 15301, Class 1 (Existing Facilities). Approved a motion for continuance to December 10, 2018, to allow additional time for the applicant to meet with surrounding neighbors, and to allow for staff to research matters raised during the public hearing relating to health & safety issues and land use compatibility. A motion was made by Commissioner Lieberman, seconded by Commissioner Armstrong to approve the item per staff’s recommendations in the staff report. THE MOTION FAILED TO CARRY VOTE: 2-5 Commissioners Armstrong and Lieberman voted yes. Chairperson Carbajal and Commissioners Dalati, Gillespie, Keys and White voted no. ---------------------------------------------- A second motion was made by Commissioner Keys, seconded by Commissioner Dalati to continue the item to December 10, 2018. APPROVED VOTE: 5-2 Chairperson Carbajal and Commissioners Armstrong, Dalati, Gillespie and Keys voted yes. Commissioners Lieberman and White voted no. DISCUSSION TIME: 1 hour and 41 minutes (5:14 to 6:55 p.m.) MEETING ADJOURNED AT 7:00 P.M. TO MONDAY, DECEMBER 10, 2018 AT 5:00 P.M. The scheduled meeting of November 28, 2018 was cancelled due to a lack of agenda items.
