A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM ADOPTING ADDENDUM NO.1 TO THE
MITIGATED NEGATIVE DECLARATION FOR THE
ANAHEIM SOUTH RECYCLED WATER PROJECT.
WHEREAS, on June 6, 2016, the City Council of the City of Anaheim adopted a
Mitigated Negative Declaration ("MND") pursuant to the California Environmental Quality Act
("CEQA") (Public Resources Code, § 21000 et seq.) and the California Code of Regulations,title
14, section 15000 et seq. ("State CEQA Guidelines") addressing the potential environmental
impacts associated with the Anaheim South Recycled Water("Project"); and •
WHEREAS, subsequent to the adoption of the MND and the approval of the
Project, minor modifications to the Project became necessary; and
WHEREAS, those modifications were not addressed in the MND, and consist of:
minor technical changes related to increases the size and capacity of the proposed pump station
and forebay tank; and
WHEREAS, the City of Anaheim, as lead agency, has prepared an Addendum
("Addendum") to the MND for the Project to evaluate the potential environmental impacts that
could result from modifying the Project; the Addendum is attached hereto as Exhibit A; and
WHEREAS,the Addendum to the MND was prepared pursuant to the requirements
of State CEQA Guidelines Section 15164; and
WHEREAS, the City Council of the City of Anaheim has carefully reviewed the
Addendum, as well as all of the information contained in the record for the proposed project, and
all other legal prerequisites to the adoption of this Resolution have occurred; and
WHEREAS, Section 15164 of the State CEQA Guidelines requires the City
Council of the City of Anaheim to make one or more of the following findings prior to approval
and adoption of the Addendum:
Finding 1. Minor technical changes or additions to the original project are
necessary;
Finding 2. None of the following conditions described in Section 15162 of the
State CEQA Guidelines calling for preparation of a subsequent negative declaration have occurred:
A. Substantial changes are proposed in the Project requiring major revisions of
a previous Mitigated Negative Declaration due to the identification of new significant
environmental effects or a substantial increase in the severity of previously identified significant
effects;
B. Substantial changes occur with respect to the circumstances under which
the project is undertaken which will require major revisions of the Mitigated Negative Declaration
due to the involvement of new significant environmental effects or a substantial increase in the
severity of previously identified significant effects; or
C. New information of substantial importance, which was not known and
could not have been known with the exercise of reasonable diligence at the time the previous
Mitigated Negative Declaration was adopted, shows any of the following:
(1) The Project will have one or more significant effects not discussed
in the previous Mitigated Negative Declaration;
(2) Significant effects previously examined will be substantially more
severe than shown in the previous Mitigated Negative Declaration;
(3) Mitigation measures or alternatives previously found not be feasible
would in fact be feasible and would substantially reduce one or more significant effects of the
Project,but the project proponents decline to adopt the mitigation measure or alternative; or
(4) Mitigation measures or alternatives which are considerably different
from those analyzed in the previous Mitigated Negative Declaration would substantially reduce
one or more significant effects on the environment,but the Project proponents decline to adopt the
mitigation measure or alternative.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of
Anaheim as follows:
1. The Recitals set forth above are incorporated herein and made an
operative part of this Resolution.
2. As the decision-making body for the Project, the City Council of the City
of Anaheim has reviewed and considered the information contained in the Addendum and related
administrative record. The City Council of the City of Anaheim finds that the Addendum contains
a complete and accurate reporting of the environmental impacts associated with the proposed
changes to the Project. The City Council of the City of Anaheim further finds that the Addendum
has been completed in compliance with CEQA and the State CEQA Guidelines.
3. The City Council of the City of Anaheim finds that only minor technical
changes or additions to the Project are necessary and that none of the conditions set forth in State
CEQA Guidelines Section 15162 requiring a subsequent mitigated negative declaration have
occurred.
4. The Addendum prepared for the Project reflects the independent judgment
and analysis of the City of Anaheim.
5. On the basis of the whole record before it, the City Council of the City of
Anaheim finds that all environmental impacts of the Project with mitigation measures incorporated
are found to be below a level of significance. There is no substantial evidence in the record as a
whole supporting a fair argument that the Project will have a potentially significant effect on the
environment.
6. The City Council of the City of Anaheim hereby approves and adopts the
Addendum to the MND prepared for the Project.
7. The City Council of the City of Anaheim directs staff to file a Notice of
Determination with the County of Orange within five (5) working days of the adoption of this
Resolution.
8. A copy of the Addendum, the MND, the Initial Study, the Mitigation
Monitoring and Reporting Program, and all other materials constituting the record of proceedings
are located at: 201 S. Anaheim Boulevard,CA 92805. The Custodian of Records is Public Utilities
Department of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and adopted by the City Council
of the City of Anaheim this 2nd Day of April , 2019,by the following vote:

Background
This document constitutes an Addendum to the June 2016 Final Initial Study/Mitigated Negative
Declaration (the adopted IS/MND) prepared for the Anaheim South Recycled Water Project
(hereafter referred to as the Adopted Project). The City of Anaheim is the lead agency under the
California Environmental Quality Act(CEQA). The IS/MND was adopted by the Anaheim City
Council on August 9, 2016. The Project consists of the installation of piping and associated
infrastructure to allow distribution of recycled water. Several modifications to the Adopted
Project have been proposed. This Addendum evaluates whether proposed modifications to the
Adopted Project would result in any new impacts or require any new mitigation measures not
identified in the adopted IS/MND.
CEQA Addendum Framework
Section 15164 of the CEQA Guidelines provides that an Addendum to an adopted IS/MND may
be prepared as long as only minor technical changes or additions are necessary.
Based on the analysis of the Updated Project provided, none of the conditions described below
(Section 15162) have occurred;hence, an Addendum to the adopted IS/MND is the appropriate
CEQA document determination.
• Substantial changes in the project which require major revisions to the IS/MND due to the
involvement of new significant environmental effects or a substantial increase in the
severity of previously identified significant effects;
• Substantial changes with respect to the circumstances under which the project is
undertaken which require major revisions to the IS/MND due to the involvement of new
significant environmental effects or a substantial increase in the severity of previously
identified significant effects;or
• New information of substantial importance, which was not known and could not have
been known with the exercise of reasonable diligence at the time of IS/MND adoption,
shows any of the following:
o The project would have one or more significant effects not discussed in the
IS/MND;
o The project would result in impacts substantially more severe than those disclosed
in the ISIMND;
o Mitigation measures or alternatives previously found not to be feasible would in
fact be feasible and would substantially reduce one or more significant effects of
the project,but the project proponent declines to adopt the mitigation measure or
alternative;or
o Mitigation measures or alternatives that are considerably different from those
analyzed in the IS/MND would substantially reduce one or more significant effects
on the environment, but the project proponent declines to adopt the mitigation
measure or alternative.
Revised Project Description
The project would install (1) the recycled water supply and metering connection, (2) a recycled
water pump station with a tank, and (3) distribution pipelines serving the southern area of
Anaheim.
Supply and Metering
Recycled water supply for the project would be from the existing Orange County Water District
(OCWD) Groundwater Replenishment System(GWRS) Pipeline, located on the west side of the
Santa Ana River. The project would construct a new turnout facility on the 66-inch diameter
GWRS pipeline,located near Rampart Street,just south of the existing North Net.The connection
facility would divert recycled water from the GWRS pipeline through a new various sized
pipeline to the new recycled water pump station. This component of the Project was evaluated
within the Adopted 2016 IS/MND, and does not require additional review.
Pump Station and Forebay Tank
A new recycled water pump station would be located at South Santa Cruz Street, between
Stanford Court and Orangewood Avenue, north east of I-5. An approximate 130,000 gallon
recycled water forebay tank is planned to be constructed with the recycled water pump station.
The pump station would have a variable pumping capacity up to 4000 gallons per minute(GPM).
The pump station building would have a pad area of approximately 2,000 square feet and external
architectural features to match the surrounding area. The tank height would not pose any
aesthetic views as the elevated freeway would block the tank from residential neighborhoods.
Although the pump station was previously evaluated in the Adopted 2016 IS/MND, the pump
station capacity and the building pad area have increased. Therefore,these components were re-
evaluated for potential significant impacts.
Distribution System
Recycled water pipelines would be installed in the same locations and same linear footage as
described in the Adopted 2016 IS/MND,and therefore,does not require additional review.
Construction Schedule
Completion of design is anticipated by fall 2018 with bidding and award of the construction
contract in winter 2019. Construction is expected to begin in spring 2020 and reach completion
fall 2021.
Proposed Project Changes
Modifications to the Adopted Project have been incorporated into the revised project description.
These changes are summarized below:
• The recycled water forebay tank would increase in volume from 50,000 gallons to
approximately 130,000 gallons, with an increase in height from 16 to approximately 30
feet;
• The pump station capacity would increase from 2,400 gpm to approximately 4,000 gpm;
• Distribution pipe diameters would increase from up to 16-inches to up to 20-inches;and
• The construction schedule would be adjusted to accommodate these changes.
Potential Environmental Effects Findings
The adopted IS/MND and CEQA Checklist (discussions and findings) were reviewed and
analyzed and all Updated Proposed Project components were considered. It was determined that
the Updated Project Components remain consistent with the Adopted determination provided in
the 2016 Final IS/MND and no additional environmental impacts would be created as a result of
the Project.
As the new Project components are within the existing Adopted Project footprint area,the CEQA
Guideline Checklist categories (e.g. biology, air quality, cultural resources, traffic, etc.), were
determined not to provide additional impacts human health or the environment, as determined
in the Adopted 2016 IS/MND.
In addition to the detailed review discussed above, further analysis was applied for potential
visual impacts due the increase of the tank size and height. The height increase of the forebay
tank from 15 feet to 30 feet, would be the greatest project component change outside of the
Adopted Project scope. The increased height of the forebay tank would potentially create visual
impacts to sensitive receptors such as nearby residential neighborhoods.
The size and location of the tank,with respect to its visibility to nearby residents, was analyzed
from multiple angles and from multiple locations. Analysis determined that the tank would not
be visible by nearby residents, as the residential neighborhoods are shielded by the I-5 freeway
and ivy covered, raised, cement walls. Therefore, no additional impacts or mitigation measures
were identified and the Adopted IS/MND would still apply.
The following findings for the Updated Proposed Project continue to be supported:
• The overall Project activities have not changed;
• The overall Project location has not changed;
• The circumstances under which the Adopted Project was approved have not changed;
• There are no new significant environmental effects and no substantial increase in the
severity of any previously identified effects;and
• The Updated Proposed Project does not require additional mitigation measures.
Mitigation Measures
The adopted IS/MND identified mitigation measures that would reduce or eliminate potential
environmental effects of the Adopted Project. All of the mitigation measures adopted for the
Adopted Project would also apply to the Updated Proposed Project.
Conclusion
Based on the above information it is concluded that this Addendum to the Adopted IS/MND is
appropriate to address the changes in the Updated Proposed Project and maintains the
requirements under CEQA for the Adopted Project. No further action is required.
