RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM AUTHORIZING THE PUBLIC UTILITIES
GENERAL MANAGER OR DESIGNEE TO SUBMIT AN
APPLICATION TO THE UNITED STATES DEPARTMENT OF
THE INTERIOR BUREAU OF RECLAMATION FOR GRANT
FUNDING FROM THE TITLE XVI RECLAMATION AND
REUSE PROGRAM TO EXPAND THE USE OF RECYCLED
WATER; TO ENTER INTO A FUNDING AGREEMENT AND
ACCEPT GRANT FUNDS, AS AWARDED, ON BEHALF OF
THE CITY OF ANAHEIM; TO AMEND THE BUDGET
ACCORDINGLY FOR THE APPROPRIATE FISCAL YEAR;
AND TO TAKE SUCH ACTIONS AS ARE NECESSARY IN
FURTHERANCE OF THE GRANT.
WHEREAS, Title XVI of P.L. 102-575, as amended, entitled "Reclamation
Wastewater and Groundwater Study and Facilities Act" (Title XVI) provides authority to the
United States Department of the Interior, Bureau of Reclamation (BOR) to identify, study and
fund water recycling and reuse projects; and
WHEREAS, the Title XVI program is focused on identifying and investigating
opportunities to reclaim and reuse wastewaters and naturally impaired ground and surface water
in the State of California; and
WHEREAS, the BOR has budgeted Title XVI funding for design and construction
of water recycling projects, on a project-specific basis, in partnership with local governmental
entities (Grant); and
WHEREAS,the BOR offers Grant funding under Title XVI to assist local agencies
with the development, design and construction of new water recycling projects; and
WHEREAS,the City of Anaheim(City)is committed to realizing potential benefits
from water recycling and reuse projects that are eligible for Title XVI cost share matching funds,
including the Anaheim South Recycled Water Project(Project), formerly known as the Ball Road
Recycled Water Project, which will deliver recycled water from the regional Groundwater
Replenishment System (GWRS)treatment facilities to the Anaheim Resort Area; and
WHEREAS, to maximize the likelihood of a Grant award for the Project, the City
wishes to submit an application for Grant funds as early as possible in response to the next BOR
Funding Opportunity Announcement under Title XVI,which is expected to occur in early or mid-
2019; and

WHEREAS, the City is familiar with the terms, conditions, and limitations placed
on Title XVI Grants and previously obtained and utilized Grant money under Title XVI to fund a
portion of the feasibility study costs for the Project; and
WHEREAS, the City is willing and able to conform to the terms, conditions, and
limitations imposed by the BOR upon Title XVI Grant funds through a Grant Cooperative
Agreement between the City and the BOR; and
WHEREAS, the City Council remains supportive of the ongoing efforts of the
Public Utilities Department to apply for such allocation of funds through the Title XVI program
as may be awarded to and accepted by the City.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of
Anaheim as follows:
1. The Public Utilities General Manager or designee is authorized to submit an
application to the BOR for and on behalf of the City of Anaheim, a municipal
corporation established under the laws of the State of California,for a Grant entitled
WaterSmart: Title XVI Water Reclamation and Reuse Program in an amount of up
to 25 percent of the total cost of planning, design, and/or construction to offset the
costs of the Anaheim South Recycled Water Project.
2. The Public Utilities General Manager or designee is hereby authorized and directed
to execute any agreements, certificates and/or assurances, reports, plans, payment
requests, or other documents, including but not limited to a Grant Cooperative
Agreement, as may be necessary for the purpose of obtaining assistance provided
by the BOR, including any extensions and amendments thereof, as may be
necessary for the purpose of obtaining funds under the Grant.
3. The City Council of the City of Anaheim hereby agrees to accept, and by this
Resolution does accept, any such Title XVI Grant so awarded to the City of
Anaheim without further action of the City Council of the City of Anaheim being
required therefore.
4. The City Council of the City of Anaheim hereby agrees to attest, and by this
Resolution does attest, that the City has the capability to provide Seventy-Five
Percent(75%)or more matching funds/in-kind contributions as may be required by
the BOR for the Grant.
5. The City of Anaheim hereby agrees to comply with each and all of the terms,
conditions, and limitations imposed by the BOR upon said Grant.
6. The City of Anaheim hereby agrees to work with the BOR to meet established
deadlines for entering into a Grant Cooperative Agreement, if required.

7. If Grant funds are awarded, revenue appropriations shall be increased by a
commensurate amount in the annual budget of the City of Anaheim in the
applicable fiscal year.

of the City of Anaheim this 2nd day of April , 2019,by the following vote:
