A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM DECLARING ITS INTENTION TO VACATE
CERTAIN PUBLIC STREETS, HIGHWAYS AND
EASEMENTS. (Abandonment No. ABA2003-00072)
BE IT RESOLVED that the City Council of the City of Anaheim does hereby
declare its intention to vacate the following public streets, highways and service easements
pursuant to the Public Streets, Highways and Service Easement Vacation Law (part 3 of Division
9 of the Streets and Highways Code); to wit,
That certain easement for equestrian and hiking purposes over the
southerly 10 feet of Lot 33 of Tract 9524, generally known as 327
South Royal Ridge Drive, Anaheim, California
as said property is shown on a map or plan on file in the Office of the City Clerk.
BE IT FURTHER RESOLVED that all persons interested in the proposed
vacation will be heard at a hearing to be held at 5:30 o'clock P.M. or as soon thereafter as the
matter may be heard, in the Chambers of the City Council located in the Civic Center located at
200 South Anaheim Boulevard, Anaheim, California 92805, on:

CITY PROPERTY ! (1) Purpose
(1) Purpose
The purpose of this regulation is to establish for the City a procedure for the sale of excess
City-owned land.

(2) Sale of Excess City Property
The department that has a parcel of land and/or building that is of no further present or future
need to said department shall forward a written request to the Public Works Department
declaring said parcel as excess to their needs and request disposition of same.
Should the excess parcel be of an unbuildable nature or a portion of a well site within existing
property boundaries, the Public Works Department will commence negotiations to sell the excess
parcels to the adjoining lot owner.
If the excess parcel is of a buildable size and shape, the Public Works Department will proceed in
the following manner:
A. Circulate a map indicating the size, shape and location of said parcel to all departments of
the City for their review and determination of a possible need by another department.
B. Provided no other department has a need for said parcel, an independent professional
appraisal of the parcel will be ordered.
C. Upon receipt of the appraisal, the Public Works Department will prepare a report with all
pertinent data and forward same to thc City Manager recommending the sale of said land.
D. Upon receipt of the approval of the City Manager, the information will be forwarded to
the City Attorney's office to prepare a Resolution of Intent to sell, setting out the time, place and
date of sale by sealed bids, setting a sale price at the minimum bid as thc appraised value of said
land. All bids will be accompanied by a deposit of a certified or cashier's check in the amount of
10 percent of the minimum bid price.
E. Pursuant to the Surplus Unimproved Land Act, Government Code $4222 - $4232, the

City Attorney's office shall notify the County Parks and Recreation Department, any regional
park authority having jurisdiction within the area in which the land is situated, the State
Resources Agency and the Orange County Housing Authority of the City's intention to sell the
surplus land. These agencies will have a 60-day period in which to notify the City of their intent
to purchase the surplus property at fair market value.
F. The City Clerk's office will publish the proposed Notice of Sale by advertisement in the
newspaper and the land will be posted.
G. The bids shall be publicly opened by the City Clerk at a time and place set forth in the
Notice of Sale. The Public Works Department shall evaluate the bids and submit an award
recommendation to the City Council.
H. The City Council will by Resolution accept the highest bid and approve the sale of said
land. The City Attorney's Office will then prepare the necessary escrow instructions and open
escrow at a title insurance company or escrow office approved by the City Council.
