A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM
SUPPORTING THE DRIVING UNDER THE INFLUENCE (DUI) TRAFFIC
SAFETY PROJECT INITIATED BY THE CALIFORNIA HIGHWAY PATROL
AND AUTHORIZING PARTICIPATION IN THE PROJECT BY THE
ANAHEIM POLICE DEPARTMENT
WHEREAS, DUI drivers are a significant traffic safety problem; and
WHEREAS, the California Highway Patrol has received grant funds from the California
Office of Traffic Safety (OTS) to act as the lead agency for a multi-agency DUI enforcement
project entitled, "Removing Impaired Drivers Project," Grant No. AL0307; and
WHEREAS, the participating law enforcement agencies are the California Highway
Patrol, Anaheim Police Department, Costa Mesa Police Department, Tustin Police Department,
and Newport Beach Police Department; and
WHEREAS, the City Council of the City of Anaheim has agreed that increasing traffic
law enforcement is an important element in improving public safety.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim
that the City Council expresses its strong support for the project and authorizes execution of
agreements with participating law enforcement agencies as provided in the Office of Traffic
Safety grant agreement.
BE IT FURTHER RESOLVED by the City Council of the City of Anaheim as follows:
The Police Department will work in partnership with the California Highway
Patrol and the other law enforcement agencies participating in this grant project.
It is agreed that any liability arising out of the performance of this grant award,
including civil court actions for damages, shall be the responsibility of the grant
recipient and the authorizing agency. The State of California and OTS disclaim
responsibility for any such liability.
One Police Sergeant and five Police Officers from the Anaheim Police
Department will participate in a six-hour joint DUI roving patrol operation,
on an overtime basis, in the City of Anaheim on a date to be determined between
October 1, 2003, and December 31, 2003, and will be reimbursed by the
California Highway Patrol with grant funds.
