AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM, CALIFORNIA,ADDING CHAPTER 6.35 TO TITLE
6 OF THE ANAHEIM MUNICIPAL CODE TO BAN WEAPONS
IN CITY BUILDINGS
WHEREAS, there have been incidents across the nation where individuals armed
with weapons, particularly firearms, have caused widespread carnage, death and destruction by
discharging those weapons in public places; and
WHEREAS,the City Council wishes to promote and ensure the safety and security
of City employees and members of the public who access City buildings and attend City meetings
and events; and
WHEREAS,the City Council of the City of Anaheim desires to enact an ordinance
prohibiting individuals from bringing weapons into buildings owned and operated by the City of
Anaheim.
NOW THEREFORE, the City Council of the City of Anaheim does hereby ordain as follows:
SECTION 1. Chapter 6.35 be, and hereby is, added to the Anaheim Municipal Code to
read in full as follows:
6.35 WEAPONS PROHIBITED IN CITY BUILDINGS
.010 No person shall bring a weapon into any building owned and operated by the City of
Anaheim without permission of the City of Anaheim.
.020 The provisions of this Chapter shall not apply to any peace officer employed by the
City of Anaheim, nor to any on-duty peace officer or peace officer acting or present at a City
building in an official capacity.
.030 The term"peace officer"as used in this Chapter shall have the same meaning as used
in California Penal Code § 830 et seq., and shall include a federal law enforcement officer who
has powers of arrest under Penal Code § 830.8. The term "weapon" as used in this Chapter shall
include a firearm as defined in Penal Code § 16520, a knife, dirk or dagger as defined in Penal
Code § 16470,a deadly weapon as defined in Penal Code § 16430, a destructive device as defined
in Penal Code § 16460, an explosive as defined in Penal Code § 16510, a generally prohibited
weapon as defined in Penal Code § 16590, an imitation firearm as defined in Penal Code § 16700,
and a switchblade knife as defined in Penal Code § 17235. If any of the foregoing Penal Code
sections is renumbered, replaced or modified, the definition in the successor section shall apply.
SECTION 2.
The City Council of the City of Anaheim hereby declares that should any section,
paragraph, sentence, phrase, term or word of this ordinance be declared for any reason to be
invalid, it is the intent of the City Council that it would have adopted all other portions of this
ordinance independent of the elimination of any such portion as may be declared invalid. If any
section, subdivision,paragraph, sentence, clause or phrase of this Ordinance is for any reason held
to be invalid or unconstitutional, such decision shall not affect the validity of the remaining
portions of this Ordinance. The City Council hereby declares that it would have passed this
Ordinance, and each section, subdivision, paragraph, sentence, clause and phrase thereof,
irrespective of the fact that any one(or more) section, subdivision, paragraph, sentence, clause or
phrase had been declared invalid or unconstitutional.
SECTION 3.
The City Clerk shall certify to the passage of this ordinance and shall cause the same to be
printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of
general circulation, published and circulated in the City of Anaheim.
SECTION 4.
This ordinance shall take effect and be in full force thirty(30)days from and after its final
passage.

of the City of Anaheim held on the 29th day of October, 2019, and thereafter passed and adopted
at a regular meeting of said City Council held on the 5th day of November.,2019,by the following
