A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING AN AMENDMENT TO THE
CONDITIONS OF APPROVAL IN CONDITIONAL USE
PERMIT NO. 2169 AND AMENDING RESOLUTION NO.
81R-155.
WHEREAS, the City Council of the City of Anaheim
heretofore adopted Resolution No. 81R-155 approving Conditional
Use Permit No. 2169, subject to certain conditions specified
therein; and
WHEREAS, the permittee has now requested an amendment to
certain of said conditions of approval; and
WHEREAS, the City Council held a duly noticed public
hearing on January 17, 1989, at which hearing the City Council did
receive and consider evidence, both oral and documentary, relating
to said request; and
WHEREAS, the City Council hereby finds and determines
that the amendment of said conditions of approval in the manner
hereinafter set forth is reasonably necessary to protect the
public peace, health, safety or general welfare, or necessary to
permit reasonable operation under said Conditional Use Permit No.
2169.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim that the conditions of approval heretofore imposed
in Conditional Use Permit No. 2169 be, and the same are hereby,
amended by the amendment of Condition No. 5 as set forth in
Resolution No. 81R-155 to read as follows:
"3· That the subject property shall be developed
substantially inaccordance with plans and
specification on file with the City of Anaheim marked
Exhibit Nos. 1 through 5."
BE IT FURTHER RESOLVED that Conditional Use Permit No.
2169 be, and the same is hereby, amended by the addition of
certain new conditions thereto, to read as follows:
That prior to issuance of a building permit, the
petitioner shall obtain a letter from the Orange
County Water District approving the modular unit.

That prior to issuance of a building permit, the
modular unit shall comply with all applicable City
Flood Plain (Zone "A") regulations.

That prior to issuance of a building permit the
legal owner of subject property shall irrevocably
offer to dedicate to the City of Anaheim a strip of
land 52 feet in width from the centerline of the
street along Richfield Road for street widening
purposes.

That prior to issuance of a building permit, the
legal owner of subject property shall irrevocably
offer to dedicate to the City of Anaheim an
additional strip of land along La Palma Avenue,
measured easterly from the ultimate right-of-way
line at the corner of the intersection of La Palma
Avenue and Tustin Avenue, and varying in width from
twelve (12) feet for the first three-hundred (500)
feet and then transitioning from twelve (12) feet to
0 feet for the next three-hundred (500) feet.

That prior to final building and zoning inspections,
sidewalks shall be installed along La Palma Avenue
as required by the City Engineer.
10. That a trash storage area shall be provided and
maintained in close proximity to the modular
building in a location acceptable to the Street
Maintenance and Sanitation Division and in
accordance with approved plans on file with said
Division.
11. That prior to issuance of a building permit, the
appropriate fees due for primary mains and fire
protection service shall be paid to the Water
Utility Division in accordance with rules 1SA and 20
of the Water Utility rates, rules and regulations.
12. That prior to issuance of a building permit, an
on-site fire hydrant shall be installed and charged
as required and approved by the City Fire Department
or such other fire protection shall be provided as
reviewed and approved by the City Fire Department.
13. That existing illegal signs shall be removed or a
variance shall be approved to permit the sign prior
to commencement of activity authorized by this
permit."
BE IT FORTHER RESOLVED that, except as expressly amended
herein, Resolution No. 81R-155 shall remain in full force and
effect·

THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 17th day of January, 1989.
