ITEM NO. 2 PLANNING COMMISSION REPORT City of Anaheim PLANNING AND BUILDING DEPARTMENT DATE: FEBRUARY 3, 2020 SUBJECT: CONDITIONAL USE PERMIT NO. 2019-06016 LOCATION: 411-457 North Lakeview Avenue APPLICANT/PROPERTY OWNER: The applicant is the Eukon Group represented by Paul Kim. The property owner is the Kaiser Foundation Hospitals. REQUEST: The applicant requests approval to exceed the maximum height within the Scenic Corridor (SC) Overlay Zone to replace a 50-foot high Monopole Wireless Communications Facility with a new 70-foot high Stealth facility designed as a eucalyptus tree. RECOMMENDATION: Staff recommends that the Planning Commission adopt the attached resolution, determining that this request is categorically exempt from further environmental review under the California Environmental Quality Act Class 2 (Replacement or Reconstruction) and Class 11 (Accessory Structures) and approving Conditional Use Permit No. 2019-06016. BACKGROUND: This 9.42-acre site consists of three properties and is developed with a medical office building and is located in the General Commercial (C-G) Zone and the Scenic Corridor (SC) Overlay Zone. The General Plan designates the site for Mixed Use- High land uses. Surrounding land uses include Riverdale Park to the west, single-family residences to the south across Riverdale Avenue, Lakeview Plaza commercial center to the east across Lakeview Avenue, and the Santa Ana River to the north. PROPOSAL: The applicant proposes to remove an existing 50-foot high, ground- mounted wireless communications monopole antenna and replace it with a stealth 70- foot high wireless communications facility designed as a faux eucalyptus tree for Sprint. The stealth facility would be installed in the same location as the existing monopole at the rear of the property behind an existing medical office building. The antenna and associated equipment would be located within an expanded eight-foot high block wall enclosure. The unmanned facility would operate 24 hours a day, seven days a week. Routine maintenance would occur every four to six weeks. 200 S. Anaheim Blvd. Suite #162 Anaheim, CA 92805 Tel: (714) 765-5139 Fax: (714) 765-5280 www.anaheim.net CONDITIONAL USE PERMIT NO. 2019-06016 February 3, 2020 Page 2 of 3 FINDINGS AND ANALYSIS: Before the Planning Commission may approve a conditional use permit, it must make a finding of fact that the evidence presented shows that all of the following conditions exist: 1) That the proposed use is properly one for which a conditional use permit is authorized by this code; 2) That the proposed use will not adversely affect the adjoining land uses, or the growth and development of the area in which it is proposed to be located; 3) That the size and shape of the site proposed for the use is adequate to allow the full development of the proposed use, in a manner not detrimental to either the particular area or health and safety; 4) That the traffic generated by the proposed use will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area; and 5) That the granting of the conditional use permit under the conditions imposed, if any, will not be detrimental to the health and safety of the citizens of the City of Anaheim. Wireless Telecommunications Facilities are restricted to a maximum structural height of 35’- 0” within the Scenic Corridor (SC) Overlay zone. Any increase requires the approval of a Conditional Use Permit (CUP) by the Planning Commission. The purpose of the CUP is to ensure compatibility with surrounding uses and ensure the project site is adequate to accommodate the use in a safe manner. The antenna would be located in an underutilized portion of the property currently used for surplus parking. Two parking stalls would be removed to accommodate the expansion of the existing equipment enclosure and installation of the new antenna. The property will continue to provide more parking than required by the Zoning Code for the existing medical office building. The proposed stealth design is intended to minimize aesthetic impacts on the surrounding properties by blending into the environment. The proposed 70-ft. height will blend in with other existing mature Eucalyptus trees located along the property line of the abutting Riverdale Park site directly west of the proposed antenna. Three live Eucalyptus Rosea trees, a minimum 36-inch box in CONDITIONAL USE PERMIT NO. 2019-06016 February 3, 2020 Page 3 of 3 size, would be planted in close proximity in conformance with the Zoning Code. Staff believes the antenna would have minimal visual impacts on the surrounding area because it would be located at the rear of the property behind the existing medical office building, approximately 490 feet from Lakewood Avenue and more than 200 feet from Riverdale Avenue. The applicant has submitted a project description and justification (Attachment 3) which states that the height proposed for this facility is necessary to eliminate coverage gaps and enhance voice and data services in this area of the City. The benefits of this improved service would be better voice and reception quality, higher security and privacy for users, and enhanced communications for emergency services. An alternative site analysis for this Sprint wireless facility was not conducted due to the presence of the existing facility. The proposed stealth antenna would have a lesser impact on the aesthetics of the area as compared to other alternative locations since it would be located at the rear of the property where it would have limited visibility to the public right-of-way. Environmental Impact Analysis: Staff recommends the Planning Commission find that the effects of the proposed project are typical of those generated within the Class 2 (Replacement or Reconstruction) and Class 11 (Accessory Structures) categorical exemptions. Class 2 consists of the replacement or reconstruction of existing structures and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced. Class 11 consists of construction, or placement of minor accessory structures. The proposed project is a request to replace a 50-foot high monopole wireless communications facility with a new 70-foot high stealth facility designed as a eucalyptus tree. As such, the proposed project meets the criteria for these categorical exemptions. Pursuant to Section 15300.02 (c) and 15301 of Title 14 of the California Code of Regulations, there are no unusual circumstances in respect to the proposed project for which staff would anticipate a significant effect on the environment and, therefore, the proposed project is categorically exempt from the provisions of CEQA. CONCLUSION: Staff believes that the conditions exist for Planning Commission to make the required findings to approve this request. The proposed telecommunications facility would be compatible with surrounding land uses and would help support the local community by improving telecommunication service in the area. The facility is designed in a manner that minimizes visual impacts on surrounding land uses. Staff recommends approval of the Conditional Use Permit. PC2020-*** A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ANAHEIM APPROVING CONDITIONAL USE PERMIT NO. 2019-06016 AND MAKING CERTAIN FINDINGS IN CONNECTION THEREWITH (DEV2019-00065) (411-457 NORTH LAKEVIEW AVENUE) WHEREAS, the Anaheim City Planning Commission (hereinafter referred to as the "Planning Commission"), did receive a verified petition for Conditional Use Permit No. 2019- 06016 to permit a 70-foot high Stealth Facility, designed as a eucalyptus tree (herein referred to as the "Proposed Project"), on that certain real property located at 411-457 North Lakeview Avenue in the City of Anaheim, generally depicted on the map attached hereto as Exhibit A and incorporated herein by this reference (the "Property"), pursuant to Section 18.60.190 of the Anaheim Municipal Code (the "Code") for the Property; and WHEREAS, the Property is approximately 9.4-acres in size and is developed with a medical office building. The Property is located within the General Commercial (CG) Zone and in the Scenic Corridor (SC) Overlay Zone. The Anaheim General Plan designates the Property for Mixed Use land uses; and WHEREAS, on February 3, 2020, the Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim, notice of said public hearing having been duly given as required by Chapter 18.60 of the Code, to hear and consider evidence for and against proposed Conditional Use Permit No. 2019-06016, and to investigate and make findings and recommendations in connection therewith; and WHEREAS, pursuant to and in accordance with the provisions of the California Environmental Quality Act (Public Resources Code Section 21000 et seq.; herein referred to as “CEQA”), the State of California Guidelines for Implementation of the California Environmental Quality Act (Title 14 of the California Code of Regulations; herein referred to as the "CEQA Guidelines"), and the City's Local CEQA Procedure Manual, the City is the "lead agency" for the preparation and consideration of environmental documents for the Proposed Project; and WHEREAS, the Planning Commission finds and determines that the Proposed Project is within that class of projects (i.e., Class 2 – Replacement or Reconstruction) which consists of the replacement or reconstruction of existing structures and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced, and Class 11 (Accessory Structures) which consists of construction, or placement of minor structures accessory to (appurtenant to) existing commercial, industrial, or institutional facilities, and that, therefore, pursuant to Sections 15302 and 15311 of the CEQA Guidelines, the Proposed Project will not cause a significant effect on the environment and is, therefore, categorically exempt from the provisions of CEQA; and - 2 - PC2020-*** WHEREAS, the Planning Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing pertaining to the request for Conditional Use Permit No. 2019-06016, does find and determine the following facts: 1. The request to replace an existing 50-foot high Monopole Wireless Communications Facility with a 70-foot high Stealth Facility on a property with an existing office-use is properly one for which a conditional use permit is authorized under Section 18.18.090.020.0201 (Commercial Zones – Standards) within the Scenic Corridor, and 18.38.060 (Antennas – Telecommunications) of the Code. 2. The Stealth Facility will not adversely affect the surrounding land uses, or the growth and development of the area in which it is proposed to be located because the project has been designed as a faux eucalyptus tree to be compatible with surrounding office, commercial, recreational and residential uses because it will remain within an existing parking area surrounded by existing eucalyptus trees so to visually blend into the surrounding environment. 3. The size and shape of the site for the Stealth Facility is adequate to allow the full development of the proposed use, in a manner not detrimental to either the particular area or health and safety because the project has been designed to comply with all Code requirements, including structural height, landscaping, and the installation of new eucalyptus trees to screen the facility. 4. The traffic generated by the Stealth Facility will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area because the number of vehicles entering and exiting the site is consistent with typical land uses that would be permitted as a matter of right within the C-G zone. 5. The granting of Conditional Use Permit No. 2019-06016 under the conditions imposed will not be detrimental to the health and safety of the citizens of the City of Anaheim and will provide a land use that is compatible with the surrounding area. NOW, THEREFORE, BE IT RESOLVED that this Planning Commission does hereby approve Conditional Use Permit No. 2019-06016 at the Property, subject to the conditions of approval described in Exhibit B attached hereto and incorporated herein by this reference, which are hereby found to be a necessary prerequisite to the proposed use of the Property in order to preserve the health, safety and general welfare of the citizens of the City of Anaheim. Extensions for further time to complete conditions of approval may be granted in accordance with Section 18.60.170 of the Code. Timing for compliance with conditions of approval may be amended by the Planning Director upon a showing of good cause provided (i) equivalent timing is established that satisfies the original intent and purpose of the condition, (ii) the modification complies with the Code, and (iii) the applicant has demonstrated significant progress toward establishment of the use or approved development. - 3 - PC2020-*** BE IT FURTHER RESOLVED that Conditional Use Permit No. 2019-06016 is approved without limitations on the duration of the use. Amendments, modifications and revocations of this permit may be processed in accordance with Chapters 18.60.190 (Amendment of Permit Approval) and 18.60.200 (City-Initiated Revocation or Modification of Permits) of the Code. BE IT FURTHER RESOLVED that approval of Conditional Use Permit No. 2019-06016 constitutes approval of the proposed request only to the extent that it complies with the Zoning Code of the City of Anaheim and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement. BE IT FURTHER RESOLVED that the Planning Commission does hereby find and determine that adoption of this Resolution is expressly predicated upon applicant's compliance with each and all of the conditions hereinabove set forth. Should any such condition, or any part thereof, be declared invalid or unenforceable by the final judgment of any court of competent jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed null and void. BE IT FURTHER RESOLVED that the Planning Commission does hereby find and determine that adoption of this Resolution is expressly predicated upon applicant's compliance with each and all of the findings hereinabove set forth. THE FOREGOING RESOLUTION was adopted at the Planning Commission meeting of February 3, 2020. Said resolution is subject to the appeal provisions set forth in Chapter 18.60 (Procedures) of the Code pertaining to appeal procedures and may be replaced by a resolution of the City Council in the event of an appeal. Said information shall be specifically shown on plans submitted for building permits. CONDITIONS OF APPROVAL REVIEW BY 8 The telecommunications equipment operator shall ensure that its installation and choice of frequencies will not interfere with the 800 MHz radio frequencies required by the City of Anaheim to provide adequate spectrum capacity for Public Safety and related purposes. Planning and Building Department, Planning Services Division 9 Before activating its facility, the telecommunications equipment operator shall submit to a post-installation test to confirm that the facility does not interfere with the City of Anaheim’s Public Safety radio equipment. This test shall be conducted by the Communications Division of the Orange County Sheriff’s Department or a Division- approved contractor at the expense of the telecommunications equipment operator. Planning and Building Department, Planning Services Division 10 All equipment, including supply cabinets and power meter shall be screened from public view as required by the Planning and Building Department. Furthermore, clinging vines shall be planted adjacent to the equipment enclosure in order to screen any wall associated with the facility and prevent graffiti. Radio Frequency Capacity Information and Justification The proposed wireless telecommunication facility will close a significant gap in coverage at the present facility. As shown on the LTE justification plot submitted elsewhere in this application, Sprint will close a significant coverage gap along the 91 Freeway upon completion of the proposed site. In addition, the proposed facility will increase capacity and improve existing coverage in the area, maintain service to prevent this gap from reopening, and preserve the ability of first responders to receive and act on calls along this stretch of the 91 and surrounding neighborhoods. As such, a drive test was not necessary for this project, nor are any new commercial areas or residences likely to receive significantly improved se rvice upon completion of this project. The proposed facility is the most centrally and sensibly located facility from a land-use perspective. Safety – RF is Radio The FCC regulates RF emissions to ensure public safety. Standards have been set based on peer- reviewed scientific studies and recommendations from a variety of oversight organizations, including the National Council on Radiation Protection and Measurement s (NCRP), American National Standards Institute (ANSI), Institute of Electrical and Electronics Engineers (IEEE), Environmental Protection Agency (EPA), Federal Drug Administration (FDA), Occupational Safety and Health Administration (OSHA), and National Institute for Occupational Safety and Health (NIOSH). Although the purview of the public safety of RF emissions by the FCC was established by the Telecommunications Act of 1996, these standards remain under constant scrutiny. All Sprint cell sites operate well below these standards, and the typical urban cell site operates hundreds or even thousands of times below the FCC’s limits for safe exposure. REQUEST: The applicant requests approval of a variance to construct a six foot high fence within the front setback of the Single-Family Residential (RS-2) Zone where the Zoning Code permits a three foot high fence. RECOMMENDATION: Staff recommends that the Planning Commission approve the attached resolution, determining that this request is categorically exempt under the California Environmental Quality Act, Section 15303, Class 3 (New Construction or Conversion of Small Structures), and approving Variance No. 2018-05115. BACKGROUND: This 4.46-acre property is developed as a church campus and is occupied by Saint John the Baptist Greek Orthodox Church. The Planning Commission approved a Conditional Use Permit for a church on this property in 1965. The church has been at this location since 1975 and serves about 400 families in the community. Their overall membership is approximately 1,200 people with an average attendance of 250 people at each service. The surrounding land uses include single-family residences on all sides. The property is accessible by three driveways on Dale Avenue. The General Plan designates this property for Low Density Residential land uses and it is zoned Single-Family Residential (RS-2). VARIANCE NO. 2018-05115 February 3, 2020 Page 2 of 4 PROPOSAL: The applicant proposes to construct a six foot high wrought iron fence with pedestrian and vehicle access gates within the front setback. The fence is proposed eight feet from the front property line and would include a variety of ground cover and landscaping between the fence and the sidewalk. The Anaheim Municipal Code allows a maximum fence height of three feet within the front setback. The front setback the RS-2 zone is 25 feet. Proposed Landscaping in Front of the Fence FINDINGS AND ANALYSIS: The Planning Commission may grant the requested variance upon a finding that the evidence presented shows that all of the following conditions exist: 1) That there are special circumstances applicable to the property, including size, shape, topography, location or surroundings, which do not apply to other property under identical zoning classification in the vicinity; 2) That, because of special circumstances shown above, strict application of the Zoning Code deprives the property of privileges enjoyed by other property under identical zoning classification in the vicinity. The applicant indicates that the fencing and landscaping would provide needed security for the church property. The applicant provided a letter (Attachment 4) demonstrating that the church has experienced a significant amount of trespassing on their property since April 2019 with approximately seven to nine incidents per month. Church personnel do not always notify the Anaheim Police Department of the trespassing because they are sometimes successful in asking the trespassers to leave the property. However, the church has had difficulty with individuals who repeatedly trespass on the property. These include individuals who regularly sleep on the property and must be escorted off the premises. The applicant’s letter also stated that trespassers fill up their trash containers and that they find human feces on the property. The applicant asserts that the proposed fence would secure the property, prevent the continuous trespassing, trash usage, and VARIANCE NO. 2018-05115 February 3, 2020 Page 3 of 4 eliminate debris left from those trespassing. The location of the fence eight feet from the sidewalk would preserve the yard area used for a children’s play area and other ministries, and allow their parishioners to walk around the church while observing certain religious customs. The landscaping in front of the fence would provide a soft edge to the fence and would be similar and compatible with the landscaping approved in front of the fence at the Braille Institute, north of this property. The church property is nearly 4.5 acres in size with a single-family zoning designation designed for residential lots of 7,200 square feet. The church is a Community and Religious Assembly use in a residential zone where the standards do not always align with the church use. In the past, it was much more common to have churches in residential zones. There are now fewer than 10 churches in the city located in the RS-2 Zone. Staff believes that strict application of the residential zoning standards to the church use is not appropriate. Recognizing the conflict between Community and Religious Assembly uses and residential zoning standards, staff is exploring an amendment to the Zoning Code to allow these uses to have greater fence heights within the front setback. Staff anticipates presenting a code amendment to the Planning Commission later this year. Staff and the applicant identified other religious uses in the city that have fences in the front setback that are six feet in height. While not located in residential zones, St. Boniface Church and the Islamic Institute of Orange County both have six-foot high fences within the front setback. St. Boniface Church VARIANCE NO. 2018-05115 February 3, 2020 Page 4 of 4 Islamic Institute of Orange County Staff believes that there are special circumstances pertaining to the property that justify the variance. The residential development standards are not consistent with the operation of a Community and Religious Assembly use. Staff also believes that strict application of the Zoning Code would deprive this property of privileges enjoyed by similar Community and Religious Assembly properties in the City. Environmental Impact Analysis: Staff recommends the Planning Commission find that the effects of the proposed project are typical of those generated within the Class 3 (New Construction) Categorical Exemption. Class 3 consists of the construction and location of limited numbers of new, small facilities or structures, including fences. The proposed project is a request for approval of a variance to permit the construction of a wrought iron fence within the front setback. As such, the proposed project meets the criteria for a Class 3 categorical exemption. Pursuant to Section 15300.02 (c) and 15303 of Title 14 of the California Code of Regulations, there are no unusual circumstances in respect to the proposed project for which staff would anticipate a significant effect on the environment and, therefore, the proposed project is categorically exempt from the provisions of CEQA. CONCLUSION: The proposed 6-foot high wrought iron fence within the front setback of the church would not be detrimental to the surrounding properties and is designed to be compatible with the surrounding neighborhood. The Land Use Element of the Anaheim General Plan designates the Property for Low Density Residential land uses; and WHEREAS, the Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on February 3, 2020 at 5:00 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of Chapter 18.60 (Procedures) of the Code, to hear and consider evidence for and against proposed Variance No. 2018-05115 (the "Proposed Project"), and to investigate and make findings and recommendations in connection therewith; and WHEREAS, pursuant to and in accordance with the provisions of the California Environmental Quality Act (Public Resources Code Section 21000 et seq.; herein referred to as “CEQA”), the State of California Guidelines for Implementation of the California Environmental Quality Act (Title 14 of the California Code of Regulations; herein referred to as the "CEQA Guidelines"), and the City's Local CEQA Procedure Manual, the City is the "lead agency" for the preparation and consideration of environmental documents for the Proposed Project; and WHEREAS, the Planning Commission finds and determines that the Proposed Project is within that class of projects (i.e., Class 3 – New Construction) which consists of construction and location of limited numbers of new, small facilities or structures, and that, therefore, pursuant to Section 15303 of the CEQA Guidelines, the Proposed Project will not cause a significant effect on the environment and is, therefore, categorically exempt from the provisions of CEQA; and - 2 - PC2020-*** WHEREAS, the Planning Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing with respect to the request for Variance No. 2018-05115, does find and determine that the required findings for approval of a variance to allow the six-foot high wrought iron fence can be made because: 1) There are special circumstances applicable to the Property, including size, shape, topography, location or surroundings, which do not apply to other property under identical zoning classification in the vicinity. Such circumstances include the fact that the Property is located within the “RS-2” Single-Family Residential Zone but is not developed with a single- family residence. Instead, the Property is developed as a Community and Religious Assembly property with multiple buildings on the Property. The development standards associated with the "RS-2" Single-Family Residential Zone contemplated the development of single-family residential uses, and Community and Religious Assembly uses by nature do not contain the same form or function as residential uses. Additionally, the open campus has a history of loiterers with and high incidents of trespassing, making it unsafe for families and children of the congregation. 2) That, because of the special circumstances identified above, strict application of the Zoning Code would deprive the property of privileges enjoyed by other property under identical zoning classification in the vicinity. In particular, there are other religious institutions in the City with six-foot high fences within the front setback that provide security. In addition to providing needed security, the character and design of the front yard fence would be complimentary with the design of the church and similar with surrounding neighborhood. WHEREAS, this Planning Commission determines that the evidence in the record constitutes substantial evidence to support the actions taken and the findings made in this Resolution, that the facts stated in this Resolution are supported by substantial evidence in the record, including testimony received at the public hearing, the staff presentations, the staff report and all materials in the project files. There is no substantial evidence, nor are there other facts, that detract from the findings made in this Resolution. This Planning Commission expressly declares that it considered all evidence presented and reached these findings after due consideration of all evidence presented to it. NOW, THEREFORE, BE IT RESOLVED that, pursuant to the above findings, this Planning Commission does hereby approve Variance No. 2018-05115 contingent upon and subject to the conditions of approval set forth in Exhibit B attached hereto and incorporated herein by this reference, which are hereby found to be a necessary prerequisite to the proposed use of that portion of the Property for which Variance No. 2018-05115 is applicable in order to preserve the health, safety and general welfare of the citizens of the City of Anaheim. Extensions for further time to complete conditions of approval may be granted in accordance with Section 18.60.170 of the Code. Timing for compliance with conditions of approval may be amended by the Planning Director upon a showing of good cause provided (i) equivalent timing is established that satisfies the original intent and purpose of the condition, (ii) the modification complies with the Code, and (iii) the applicant has demonstrated significant progress toward establishment of the use or approved development. - 3 - PC2020-*** BE IT FURTHER RESOLVED, that any amendment, modification or revocation of this permit may be processed in accordance with Chapters 18.60.190 (Amendment to Permit Approval) and 18.60.200 (City-Initiated Revocation or Modification of Permits) of the Code. The present code call for a 25’ setback from the property line, but we are requesting an 8’ setback for the following reasons: 1. It provides the maximum possible protection for our children and members, without minimizing available space for children’s play activities and other ministries. 2.There are several properties in the area that have 6’ fences on the property line on the east side of dale Ave. 3.If the perimeter fence is 25’ from the property line, it would be too close to the sanctuary, and would not permit us to observe certain religious holidays, like Holly Friday precessions around the Church in observance of our religious ceremonies. 4. The construction of this fence would protect us from a serious homeless problem that we are facing. We currently have several homeless folks who use hidden locations around the facility to sleep, try to use our restrooms and of course create their own when our faciliies are locked. The weekly activities involve both young children as well as senior citizens, which are: 1. Sunday school, every Sunday. 2. Greek language studies every Wednesday 3:00 pm – 7:00 pm. 3. Folk dance practices on Fridays and/or Saturdays. 4. Bible classes every Tuesday. 5. Byzantine chanting practices once per week in the evenings. 6. Parish Council meetings, once or more per month. 7. Executive Board meeting 2-3 times per month in the evenings. 8. Youth Orthodox meetings once a week. 9. AHEPA meetings once a month in the evenings. 10. Choir practices once a week on Wednesdays. As stated in the previous letter, below is a list of incidents since April 2019. During these incidents, either Office personnel of parishioners asked the “homeless” to leave the premises. In addition to these, we have two individuals that arrive late at night, and one sleeps outside the Men’s bathroom, which is somewhat sheltered and the other on the west side of the garages in the parking lot. These individuals are there over 50% of the time. We are planning to fence the garage area, but there is not much we can do for the bathroom on the north side of the Church, other than ask them to leave or we will call the Police.
