RES-2020-028 RESOLUTION NO. 2 0 2 0-0 2 8 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM SUPPORTING A REGIONAL HOUSING NEEDS ASSESSMENT (RHNA)PROCESS THAT IS FAIR AND REASONABLE WHEREAS, California State housing law requires that each city and county plan for existing and future housing needs in accordance with the outcome of the Regional Housing Needs Assessment(RHNA)process; and WHEREAS, the Southern California Association of Governments (SCAG) is responsible for developing a uniform methodology for the distribution of the RHNA allocation among member cities and counties; and WHEREAS, a transparent and collaborative approach to regional planning, involving opportunity for informed stakeholder input and thoughtful deliberation, is critical to achieving desirable and equitable outcomes; and WHEREAS, the SCAG Regional Council approved a proposed regional determination of approximately 430,000 housing units for the 6th RHNA cycle based upon local input received by SCAG as part of the Regional Transportation Plan/Sustainable Communities Strategy (RTP/SCS); and WHEREAS, upon receipt of SCAG's proposed regional determination, the California Department of Housing and Community Development (HCD) responded with a counter- proposal for a regional determination of 1,344,740 units. HCD's based its counter-proposal on its assumptions for existing need at the time of review. SCAG objected to this determination based on State law requirements and subsequently received a reduced determination of 1,341,827 units from HCD; and WHEREAS, the Department of Finance (DOF) recently updated the population projections used by HCD in support of the regional determination of 1,341,827 units for the SCAG region;and this update shows a significant decrease in population than the previous DOF forecast; and WHEREAS, Governor Newsom has stated that his commitment to building 3.5 million homes by 2025, a goal that was made at about the same time SCAG was receiving its regional determination,was a"stretch goal"and that the State would soon be releasing a more pragmatic estimate of the housing needs by region; and 1 WHEREAS, despite several requests from SCAG jurisdictions to object to the regional determination based on this new information, SCAG staff does not believe that State law provides a process to further object to the regional determination beyond the first objection that lead to the regional determination of 1,341,827 units; and WHEREAS, SCAG is responsible for preparing a methodology to allocate the regional determination to local jurisdictions, which SCAG must submit to HCD for review concerning the methodology's conformance with State law; and WHEREAS,the SCAG process to develop the allocation methodology for the 6th RHNA cycle, covering the planning period from October 2021 through October 2029, included opportunity for stakeholder engagement throughout, including detailed discussion of three draft allocation methodology options during a series ofpublic meetings and hearings intended to ensure robust participation by the public and affected agencies; and WHEREAS, based in part on stakeholder input, SCAG staff developed a single recommended RHNA allocation methodology which was introduced in September 2019 at a public workshop, subsequently reviewed by the SCAG RHNA Subcommittee and SCAG Community, Economic and Human Development (CEHD) Committee and ultimately recommended for SCAG Regional Council consideration and submittal to the California Department of Housing and Community Development(HCD); and WHEREAS, at the November 7, 2019 meeting of the SCAG Regional Council to consider the recommended RHNA allocation methodology, a substitute motion was made by a City of Riverside representative introducing a modified RHNA methodology, which effectively would shift a significant portion of the 6th RHNA cycle regional allocation away from Riverside and San Bernardino Counties and toward coastal areas including predominately Orange County jurisdictions; and WHEREAS,the modified RHNA allocation methodology was approved for submittal to HCD by the SCAG Regional Council on a contested vote of 43-19 (opposed by all Orange County SCAG representatives), despite a lack of detail regarding the associated impacts of the proposed methodology changes, supporting documentation as to the merit of the proposed changes and any opportunity for informed stakeholder input; and WHEREAS, SCAG jurisdictions, including the City of Anaheim, did not receive sufficient or adequate advance notice that SCAG would entertain a substantially modified, unsupported methodology; and WHEREAS, the modified methodology fails to account adequately for local input and growth forecast data and, due to the late introduction by substitute motion,and was unable to be fully analyzed for potential impacts before a vote of the Regional Council; and 2 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES HEREBY RESOLVE AS FOLLOWS: 1. To urge HCD to reduce the SCAG region's regional determination of 1.3 million units to a number that is reasonable and supported by factual and reliable data in compliance with State law. 2. To support a RHNA allocation methodology that is fair and reasonable for all jurisdictions in the SCAG region. 3. To support a RHNA allocation methodology that utilizes local household growth input as a factor in the allocation of units to meet the region's existing housing need.
