CITY OF ANAHEIM ORDINANCE NO. 5895 ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ANAHEIM EXTENDING THE TIME LIMIT OF THE EFFECTIVENESS OF THE REDEVELOPMENT PLANS FOR REDEVELOPMENT PROJECT AREAS ALPHA, RIVER VALLEY, PLAZA, WEST ANAHEIM COMMERCIAL CORRIDORS, AND COMMERCIAL/INDUSTRIAL; EXTENDING THE TIME LIMIT FOR PAYMENT OF INDEBTEDNESS AND RECEIPT OF PROPERTY TAXES UNDER THE REDEVELOPMENT PLANS FOR REDEVELOPMENT PROJECT AREAS ALPHA, RIVER VALLEY, PLAZA, WEST ANAHEIM COMMERCIAL CORRIDORS, COMMERCIAL/INDUSTRIAL; AND MAKING OTHER FINDINGS IN CONNECTION THEREWITH WHEREAS, the Anaheim Redevelopment Agency, a public body, corporate and politic ("Agency") is formed, organized, existing and exercising its powers pursuant to the California Community Redevelopment Law, Health and Safety Code, Section 33000, et seq. ("CRL"), and was originally formed by Resolution No. 6966 of the City Council of the City of Anaheim on June 6, 1961; and WHEREAS, the Agency is engaged in activities necessary and appropriate to carry out the Redevelopment Plan for the Project Alpha Redevelopment Project Area ("Alpha Plan") which was adopted by the Agency's legislative body, the City Council of the City ("City Council"), by Ordinance No. 3190 on July 19, 1973 and thereafter amended by Ordinance No. 3567 on July 20, 1976, Ordinance No. 3631 on November 30, 1976, Ordinance No. 4300 on January 12, 1982, Ordinance No. 4786 on December 16, 1986, and Ordinance No. 5486 on December 13, 1994; and WHEREAS, pursuant to CRL Section 33333.6, Ordinance No. 5486 referenced above, among other actions, established a time limit on the effectiveness of the Alpha Plan and a time limit on the period for payment of indebtedness and receipt of property taxes under the Alpha Plan; and WHEREAS, the Agency is engaged in activities necessary and appropriate to carry out the Redevelopment Plan for the River Valley Redevelopment Project Area ("River Valley Plan") which was adopted by the Agency's legislative body, the City Council, by Ordinance No. 4463 on November 29, 1983 and thereafter amended by Ordinance No. 5091 on January 23, 1990, Ordinance No. 5467 on December 13, 1994, and Ordinance No. 5751 on December 19, 2000; and WHEREAS, pursuant to CRL Section 33333.6, Ordinance No. 5467 referenced above, among other actions, established a time limit on the effectiveness of the River Valley Plan and a time limit on the period for payment of indebtedness and receipt of property taxes under the River Valley Plan; and WHEREAS, the Agency is engaged in activities necessary and appropriate to carry out the Redevelopment Plan for the Plaza Redevelopment Project Area ("Plaza Plan") which was adopted by FIDOCS.DEV S V CS\OTHERREP\V T03CO2A. DOC the Agency's legislative body, the City Council, by Ordinance No. 5136 on June 13, 1990, and thereafter amended by Ordinance No. 5465 on December 13, 1994; and WHEREAS, pursuant to CRL Section 33333.6, Ordinance No. 5465 referenced above, among other actions, established a time limit on the effectiveness of the Plaza Plan and a time limit on the period for payment of indebtedness and receipt of property taxes under the Plaza Plan; and WHEREAS, the Agency is engaged in activities necessary and appropriate to carry out the Redevelopment Plan for the West Anaheim Commercial Corridors Redevelopment Project Area ("Commercial Corridors Plan") which was adopted by the Agency's legislative body, the City Council, by Ordinance No. 5412 on December 7, 1993 and thereafter amended by Ordinance No. 5466 on December 13, 1994, and Ordinance No. 5637 on June 23, 1998; and WHEREAS, as to the amendment of the Commercial Corridors Plan in 1998 since the addition of acreage to that Project Area occurred post -1994, then this Ordinance and the extensions provided herein relating to the Commercial Corridors Plan shall only apply to the pre -1994 original area included within the Commercial Corridors Project Area and Commercial Corridors Plan, and WHEREAS, pursuant to CRL Section 33333.6, Ordinance No. 5466 referenced above, among other actions, established a time limit on the effectiveness of the Commercial Corridors Plan and a time limit on the period for payment of indebtedness and receipt of property taxes under the Commercial Corridors Plan; and WHEREAS, the Agency is engaged in activities necessary and appropriate to carry out the Redevelopment Plan for the Commercial/Industrial Redevelopment Project Area ("Commercial/Industrial Plan") which was adopted by the Agency's legislative body, the City Council, by Ordinance No. 5415 on December 21, 1993 and thereafter amended by Ordinance No. 5464 on December 13, 1994; and WHEREAS, pursuant to CRL Section 33333.6, Ordinance No. 5464 referenced above, among other actions, established a time limit on the effectiveness of the Commercial/Industrial Plan and a time limit on the period for payment of indebtedness and receipt of property taxes under the Commercial/Industrial Plan; and WHEREAS, the Alpha Plan, River Valley Plan, Plaza Plan, Commercial Corridors Plan, and the Commercial/Industrial Plan collectively comprise the "Redevelopment Plans"; and WHEREAS, by and through Senate Bill 1045, enrolled on August 19, 2003 and chaptered on September 2, 2003 ("SB 1045",) CRL Section 33333.6 was amended to provide that as to redevelopment plans originally adopted before January 1, 1994, and when such redevelopment agency is required to make a payment to the Educational Revenue Augmentation Fund in fiscal year 2003-2004 pursuant to CRL 33681.9, the City Council, as the legislative body of the Agency, may enact an ordinance to extend by one year the time limit on the effectiveness of the Redevelopment Plans and the time limit for payment of indebtedness and receipt of property taxes under the Redevelopment Plans, each and respectively; and WHEREAS, SB 1045 further provides that such ordinance may be adopted without compliance with the normal procedures for redevelopment plan amendments; and 2 DOC SOC\ l 008767v4122621.0000 WHEREAS, the City Council desires to adopt this ordinance to amend and extend certain time limitations of the Redevelopment Plans, as more particularly set forth below, in accordance with Section 33333.6, as amended by SB 1045; and WHEREAS, the enactment of this Ordinance is exempt from the California Environmental Quality Act (Public Resources Code Section 21000 et seq.) ("CEQA") pursuant to CEQA Guidelines Section 15378(b)(4) because it is a fiscal activity which does not involve any commitment to any specific project which may result in a potentially significant physical impact on the environment; and NOW THEREFORE, the City Council of the City of Anaheim hereby ordains as follows: 1. The current time limit on the effectiveness of the Alpha Plan is hereby extended by one year (from the existing time limit of July 19, 2008) to July 19, 2009, and the Anaheim Redevelopment Agency is hereby authorized to act with respect to the Alpha Plan at any time during which the Alpha Plan is effective. 2. The current time limit on paying indebtedness or receiving property taxes pursuant to the Alpha Plan and CRL is hereby extended by one year (from the existing time limit of July 19, 2018) to July 19, 2019, and the Anaheim Redevelopment Agency is hereby authorized to act with respect thereto during such extended period. 3. The current time limit on the effectiveness of the River Valley Plan is hereby extended by one year (from the existing time limit of November 29, 2018) to November 29, 2019, and the Anaheim Redevelopment Agency is hereby authorized to act with respect to the River Valley Plan at any time during which the River Valley Plan is effective. 4. The current time limit on paying indebtedness or receiving property taxes pursuant to the River Valley Plan and CRL is hereby extended by one year (from the existing time limit of November 29, 2028) to November 29, 2029, and the Anaheim Redevelopment Agency is hereby authorized to act with respect thereto during such extended period. 5. The current time limit on the effectiveness of the Plaza Plan is hereby extended by one year (from the existing time limit of June 13, 2025) to June 13, 2026, and the Anaheim Redevelopment Agency is hereby authorized to act with respect to the Plaza Plan at any time during which the Plaza Plan is effective. 6. The current time limit on paying indebtedness or receiving property taxes pursuant to the Plaza Plan and CRL is hereby extended by one year (from the existing time limit of June 13, 2035) to June 13, 2036, and the Anaheim Redevelopment Agency is hereby authorized to act with respect thereto during such extended period. 7. As to the original area included within the Commercial Corridors Project Area and Commercial Corridors Plan (pre -1994) the current time limit on the effectiveness of the Commercial Corridors Plan (pre -1994 area) is hereby extended by one year (from the existing time limit of December 7, 2028) to December 7, 2029, and the Anaheim Redevelopment Agency is hereby authorized to act with respect to the Commercial Corridors Plan at any time during which the Commercial Corridors Plan is effective. 3 DOCSOCU 008767v4\22621.0000 8. As to the original area included within the Commercial Corridors Project Area and Commercial Corridors Plan (pre -1994) the current time limit on paying indebtedness or receiving property taxes pursuant to the Commercial Corridors Plan (pre -1994 area) and CRL is hereby extended by one year (from the existing time limit of December 7, 2038) to December 7, 2039, and the Anaheim Redevelopment Agency is hereby authorized to act with respect thereto during such extended period. 9. The current time limit on the effectiveness of the Commercial/Industrial Plan is hereby extended by one year (from the existing time limit of December 21, 2028) to December 21, 2029, and the Anaheim Redevelopment Agency is hereby authorized to act with respect to the Commercial/Industrial Plan at any time during which the Commercial/Industrial Plan is effective. 10. The current time limit on paying indebtedness or receiving property taxes pursuant to the Commercial/Industrial Plan and CRL is hereby extended by one year (from the existing time limit of December 21, 2038) to December 21, 2039, and the Anaheim Redevelopment Agency is hereby authorized to act with respect thereto during such extended period. 11. Except with respect to the amendments set forth herein, the Redevelopment Plans, as amended, are and shall remain unchanged and in full force and effect in accordance with their terms. 12.
