A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM ESTABLISHING DRAINAGE
FEES. (ORANGEWOOD AVENUE DRAINAGE
REIMBURSEMENT AREA)
WHEREAS, on January 15, 1974, by Resolution No. 74R-11,
the City Council duly adopted the Master Plan for Drainage for the
City of Anaheim, which Plan established particular drainage areas
specified therein; and
WHEREAS, Section 17.08.400 of the Anaheim Municipal Code,
adopted pursuant to the authority of Section 66483 of the
Government Code, requires subdividers or developers of property
within said drainage areas to pay certain drainage fees in such
amounts as established by resolution of the City Council; and
WHEREAS, the costs of constructing the drainage
facilities for said local drainage areas, whether actual or
estimated, are set forth in the Master Plan for Drainage; and
WHEREAS, said costs are based upon findings by the City
Council that subdivision and development of property within such
drainage areas will require construction of the facilities
described in the Master Plan for Drainage, and that the fees
hereinafter set forth are fairly apportioned within such areas
either on the basis of benefits conferred on property proposed for
subdivision or on the need for such facilities created by the
proposed subdivision and development of other property within such
areas.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim that the following fees be, and the same are
hereby, established pursuant to Section 17.08.400 of the Anaheim
Municipal Code for purposes of defraying the actual or estimated
costs of constructing facilities for the drainage areas
hereinafter specified.
