RES-1989-234RESOLUTION NO. 89R-234 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ESTABLISHING A POLICE PROTECTION FACILITIES PLAN FOR THE EAST SANTA ANA CANYON AREA. WHEREAS, Section 17.08.434 of Chapter 17.08 of Title 17 of the Anaheim Municipal Code permits the City Council to establish police protection facilities plans; and WHEREAS, the City Council does hdreby find and determine as follows: 1) That area (hereinafter Area) located generally south of the Santa Ana River extending easterly from a point located approximately midway between Fairmont Boulevard and Weir Canyon Road to the Riverside County Line is presently undeveloped or substantially undeveloped. z) That the Area is about to be developed with large residential and commercial land uses. 3) That the existing police protection facilities are inadequate to serve or protect the Area when developed; and WHEREAS, a Police Protection Facilities Plan For The East Santa Ana Canyon Area (hereinafter the Plan) has been formulated; and WHEREAS, the Plan identifies the police protection facilities (including land, structures, and equipment) which the City Council does hereby determine are reasonably necessary to provide adequate police protection to the area of benefit; and WHEREAS, the Plan does establish the boundaries of the area of benefit, the actual or estimated cost of the Police Protection Facilities and the method of apportionment of the cost of said facilities; and plan; and WHEREAS, a public hearing was held to consider the WHEREAS, the boundaries of the area of benefit are outlined on that map (marked Exhibit A) entitled "East Santa Aha Canyon Area of Benefit - Police Protection Facilities Plan" on file in the Office of the City Clerk which boundaries are incorporated herein by reference; and WHEREAS, the estimated cost of the Police Protection Facilities is Three Million Four Hundred Forty-six Thousand Seven Hundred Twenty Dollars ($5,446,720.00) for Phase I, and Eight Hundred Fifty-four Thousand Five Hundred Dollars ($854,500.00) for Phase II; and WHEREAS, the method of apportionment is based upon frequency of service responses for police protection calculated on a dwelling unit basis for residential use and an acreage basis for other uses. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Anaheim does hereby adopt and establish that plan entitled "Police Protection Facilities Plan for the East Santa Ana Canyon Area of Benefit" BE IT FURTHER RESOLVED that the fees established by the PLAN shall not apply to any plan for any structure which has been filed with, and the plan check fee paid to, the Building Division prior to the date of adoption of this resolution.
