RES-1989-333RESOLUTION NO. 89R-333
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM SETTING FORTH LOCAL CONDITIONS
JUSTIFYING AMENDMENTS TO THE UNIFORM
BUILDING CODE, 1988 EDITION.
WHEREAS, Health and Safety Code Section 17958.5
provides for a city to make changes or modifications in the
Uniform Building Code, 1988 Edition, as are reasonably necessary
because of local climatic, geographical or topographical
conditions; and
WHEREAS, Health and Safety Code Section 17958.7
requires the City Council to make express findings of the
necessity for modifications in the Uniform Building Code before
before adopting such changes; and
WHEREAS, the Chief Building Official of the City of
Anaheim has recommended that the Uniform Building Code, 1988
Edition, be adopted by the City with certain modifications and
amendments which are required by local conditions.
NOW, THEREFORE, BE IT RESOLVED that the modifications
to the Uniform Building Code recommended by the Chief Building
Official are hereby expressly found to be necessary on account
of local climatic, geographical or topographical conditions as
follows:
Sections 15.04.001 through 15.04.304 of the Anaheim
Municipal Code. These sections are administrative in
nature, adopt the 1988 Uniform Building Code by reference,
authorize the City to establish permit fees, and amend the
Uniform Building Code to conform with other Codes enforced
by the City of Anaheim.
Section 15.04.407 of the Anaheim Municipal Code. This
amendment changes the definition of the Front of Lot, and
is necessary to make the Building and Zoning Codes
compatible.
Section 15.04.426 of the Anaheim Municipal Code. This
amendment is necessary to allow planned unit development
with small lots in which an open space under common
ownership provides the necessary distance between
buildings to prevent conflagration. This is consistent
with current building practice throughout the State.
Section 15.04.1101 of the Anaheim Municipal Code. This
amendment includes masonry fences over three (3) feet high
in the definition of an M Occupancy and is necessary in
order to regulate this type of fence which is in common
use as property line fences in residential tracts and is
regulated by Zoning ordinances. Many masonry fences are
placed adjacent to public right-of-way.
Section 15.04.1213 of the Anaheim Municipal Code. This
amendment is necessary to comply with State Department of
Housing and Community Development requirements.
Section 15.04.1704 of the Anaheim Municipal Code. The
City of Anaheim is geographically located in an area which
is subject to periodic extremely high velocity wind
conditions. Said condition is further accentuated by the
topographical features of the hill and canyon areas in the
easterly portion of the City. The City of Anaheim is
subject to seasonably high temperatures and dry
atmospheric conditions which often occur during times of
the high velocity winds as hereinabove described. Due to
the climatic, geographical and topographical conditions
hereinabove described, the City of Anaheim is susceptible
to fires which are of particular danger during periods of
high winds when fires tend to spread across building roofs
where such roofs are not of noncombustible or
fire-retardant construction.
Section 15.04.1807 of the Anaheim Municipal Code. This
amendment reduces the maximum height above which high rise
residential and office buildings must be fire sprinklered
from 75 to 55 feet above the lowest level of fire
department vehicle access. This amendment is necessary
due to the inability of the City fire suppression forces
to attack and suppress fires in buildings over 55 feet in
height without these features.
Section 15.04.2623 o£ the Anaheim Municipal Code. This
amendment requires a vapor barrier beneath a concrete
floor slab in Group I and R, Division 3, occupancies and
is necessary because of local soil and climatic conditions.
Section 15.04.5503 of the Anaheim Municipal Code. This
amendment requires sound insulation in exterior walls of
residential buildings in noise-critical areas and is
necessary to comply with State laws.
Section 15.04.3504 of the Anaheim Municipal Code. This
amendment specifies the methods of obtaining compliance
with State mandated noise regulations and is necessary to
comply with State law.
Section 15.04.3807 of the Anaheim Municipal Code. This
amendment is necessary to provide additional fire
protection for Class 1 construction due to local climatic
conditions of high velocity winds and high temperatures
which create a high degree of fire danger not experienced
generally throughout the State.
BE IT FURTHER RESOLVED that a copy of this
Resolution, together with the Ordinance adopting the Uniform
Building Code, as amended, be filed with the State Department
Housing and Community Development.
