88-280RESOLUTION NO. 88R-280 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING AN AMENDMENT TO CERTAIN CONDITIONS OF APPROVAL IN CONDITIONAL USE PERMIT NO. 2844 AND AMENDING RESOLUTION NO. 86R-525. WHEREAS, the City Council of the City of Anaheim heretofore adopted Resolution No. 86R-524 approving Conditional Use Permit No. 2844, subject to certain conditions specified therein; and WHEREAS, the permittee has now requested an amendment to certain of said conditions of approval; and WHEREAS, the City Council held a duly noticed public hearing on July 12, 1988, at which hearing the City Council did receive and consider evidence, both oral and documentary, relating to said request; and WHEREAS, the City Council hereby finds and determines that the amendment of said conditions of approval in the manner hereinafter set forth is reasonably necessary to protect the public peace, health, safety or general welfare, or necessary to permit reasonable operation under said Conditional Use Permit No. 2844; and WHEREAS, the application for amendment to Conditional Use Permit No. 2844 requests the approval of the sale of beer and wine for off-premises consumption as an additional proposed use in conjunction with the proposed expansion of the convenience market to 1200 square feet, the City Council hereby finds that: 1. The proposed use is properly one for which a conditional use permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare. 4. The traffic generated by the proposed use will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. imposed general The granting of the proposed use under the conditions will not be detrimental to the peace, health, safety and welfare of the citizens of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the conditions of approval heretofore imposed in Conditional Use Permit No. 2844 be, and the same are hereby, amended by the amendment of Condition Nos. 7 and 11 as set forth in Resolution No. 86R-525 to read as follows: "7. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Revision No. 2 of Exhibit Nos. 1 and 2." "11. That the proposal shall comply with all signing requirements of the CL(SC) Zone, unless a variance allowing sign waivers is approved by the Planning Commission or City Council." BE IT FURTHER RESOLVED that new Condition No. 12 be, and the same is hereby, added to Conditional Use Permit No. 2488 as set forth in Resolution No. 86R-525, to read as follows: "12. That the sale of beer and wine for off-premise consumption only shall be permitted in conjunction with the convenience market on the premises, subject to compliance with all provisions of Section 18.87.023.020 of the Anaheim Municipal Code as the same now exist or may hereinafter be amended." herein, effect.
