A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM DENYING VARIANCE NO. 3771.
WHEREAS, after a request for variance by TESTA ALMA
EMMA BOSWELL, c/o THOMAS RONALD BOSWELL, 2033 Park Ridge, Norco,
California 91760 and MARY PLICET, 19811 Burleigh, Yorba Linda,
California 92686, owners and MAGDY HANNA, 4000 MacArthur
Boulevard, Suite 680, Newport Beach, California 92660, agent, was
received, a public hearing before the Planning Commission of the
City of Anaheim was held upon due and proper notice, a result of
which Variance No. 3771 was denied covering the following
described property:
BEGINNING AT THE SOUTHWEST CORNER OF THE WEST HALF OF
THE SOUTHEAST QUARTER OF THE SOUTHWEST QUARTER OF SAID
SECTION 17; THENCE WESTERLY ALONG THE SOUTHERLY LINE
OF SAID SECTION 17, A DISTANCE OF 105.00 FEET TO THE
SOUTHWEST CORNER OF THE LAND DESCRIBED IN DEED TO MARY
CLARK, RECORDED AUGUST 4, 1955, IN BOOK 3161, PAGE 522
OF OFFICIAL RECORDS; THENCE ALONG THE WESTERLY LINE OF
THE LAND DESCRIBED IN SAID DEED, NORTH 0 DEGREES 25'
14" EAST 210.00 FEET TO THE NORTHWEST CORNER THEREOF;
THENCE SOUTH 89 DEGREES 57' 08" EAST 105.00 FEET TO
THE EASTERLY LINE OF SAID WEST HALF; THENCE SOUTHERLY
ALONG SAID EASTERLY LINE 210.00 FEET TO THE POINT OF
BEGINNING.
PARCEL 2: BEGINNING AT A POINT IN THE SOUTH LINE OF
THE SOUTHWEST QUARTER OF SAID SECTION 17, SAID POINT
BEING 100 FEET WEST OF THE SOUTHEAST CORNER OF THE
WEST HALF OF TttE SOUTHEAST QUARTER OF THE SOUTHWEST
QUARTER OF SECTION 17; THENCE WEST ALONG THE SOUTH
LINE OF SAID SOUTHWEST QUARTER 117 FEET; THENCE NORTH
0 DEGREES 25' 14" EAST 210 FEET; THENCE SOUTH 89
DEGREES 57' 09" EAST 117 FEET; THENCE SOUTH 0 DEGREES
25' 14" WEST 210 FEET TO THE POINT OF BEGINNING.
EXCEPTING THEREFROM THAT PORTION INCLUDED WITH PARCEL
1; and
WHEREAS, thereafter, within the time prescribed by law,
an interested party or the City Council, on its own motion, caused
the review of said Planning Commission action at a public hearing
noticed and held as prescribed by law and, as a result thereof,
the City Council does hereby make the following findings:
1. That the applicant failed to present any evidence to
demonstrate that there are special circumstances applicable to the
property which do not apply to other property in the same vicinity
and zone.
2. That the applicant failed to present any evidence to
demonstrate how strict application of the zoning code would
deprive the property of privileges enjoyed by other property in
the same vicinity and zone.

BE IT RESOLVED by the City Council of
said Variance be, and the same is hereby,
BE IT FURTHER RESOLVED that the time within which
rehearings must be sought is governed by the provisions of Section
1.12.100 of the Anaheim Municipal Code and the time within which
judicial review of final decisions must be sought is governed by
Section 1094.6 of the Code of Civil Procedure and Anaheim City
Council Resolution No. 79R-524.
