A RESOLU]ION OF THE Ci'IY COUNCIL OF THE CITY
OF ANAHEIM APPROVING AN AMENDMENT TO
CONDItiONS OF APPROVAL IN VARIANCE NO. 3712.
WHEREAS, the Zoning Administrator of the
heretofore approved Variance No. 5712, subject to
conditions; and
City of Anaheim
certain
WHEREAS, the permittee has now requested an amendment to
certain of said conditions of approval; and
WHEREAS, tile Zoning Administrator heretofore approved.
said request, in part, and
WHEREAS, tile permittee heretofore appealed the decision
of the Zoning Administrator to the City Council; and
WHEREAS, tile City Council held a duly noticed public
hearing on June 14, 1988, at which hearing the City Council did
receive and consider evidence, both oral and documentary, relating
to said request; and
WHEREAS, the City Council hereby finds and determines
that the amendment of said conditions of approval in the manner
hereinafter set forth is reasonably necessary to protect the
public peace, health, safety or general welfare, or necessary to
permit reasonable operation under said Variance No. 3712.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim that the conditions of approval heretofore imposed
in Variance 3712 be, and the same are hereby, amended in their
entirety to read as follows:
"1 .
That sidewalks and driveways shall be removed
and/or reconstructed along Loara Street as
required by the City Engineer and in accordance
with standard plans and specification on file in
the office of the City Engineer.
That prior to issuance of a building permit the
appropriate fees due for primary, secondary and
fire protection shall be paid to the Water
Utility Division by the owner/developer in
accordance with Rules 1SA and 20 of the Water
Utility Rates, Rules and Regulations.
That plans shall be submitted to the Building
Division showing compliance with the minimum
standards of the City of Anaheim, including the
Uniform Building, Plumbing, Electrical,
Mechanical and Fire Codes as adopted by the City
of Anaheim. The appropriate permits shall be
obtained for any necessary work.
1'hat subject property shall be developed
substantially in accordance with plans and
specifications on file with the City of Anaheim
marked Exhibit Nos. 1 and 2.
The trash enclosure shall be constructed in
accordance with City standards unless otherwise
approved by the Sanitation and Street Sweeping
Section of the Maintenance Department. The
design, color and materials shall be similar to
the existing enclosure and apartment building.
That appropriate signage reviewed and approved by
the City Traffic Engineer shall be installed on
subject property indicating a one-way driveway
system to ensure vehicular and pedestrian
visability around the trash enclosure.
That Condition Nos. 1 through 6 above-mentioned,
shall be completed within a period of sixty (60)
days from the date of this decision.
That approval of this application constitutes
approval of the proposed request only to the
extent that it complies with the Anaheim
Municipal Zoning Code and any other applicable
City regulations. Approval does not include any
action or findings as to compliance or approval
of the request regarding any other applicable
ordinance, regulation or requirement."
BE 11' FURTHER RESOLVED that, except as expressly amended
herein, Variance No. 5712 shall remain in full force and effect.
TIlE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 14th day of June, 1988.
