88-194 RESOLUTION NO. 88R-194 A RLSOLU~ION OF THE LIlY COUNCIL OF THE CITY OF ANAHEIM DENYING VARIANCE NO. 3773. WHEREAS, after a request for variance by 1RIDER CORPORATION, 12 Corporate Plaza, Newport Beach, CA 92660, owner and GARY McCANN, 12 Corporate Plaza, Newport Beach, CA 92660, agent, to permit 11 single-family residential units with a waiver of the maximum structural height limitation set forth in Section 18.84.042.011 of the Anaheim Municipal Code, was received, a public hearing before the Planning Commission of the City of Anaheim was held upon due and proper notice, a result of which Variance No. 5773 was denied covering the following described property: ALL THAT CERTAIN LAND CALIFORNIA, COUNTY OF DESCRIBED AS FOLLOWS: SITUATED N THE SLATE OF ORANGE, CITY OF ANAHEIM, BEGINNING AT A POINT 1N THE NORth LINE OF SAID SECIlON 6, DISIANT THEREON 868.82 FEEl' EAST OF THE NORTHWEST CORNER OF SAID SECTION 6, SAID PO1NI BEING ALSO NORTHEASTERLY CORNER OF THE LAND CONVEYED TO RALPH LEROY DANKER AND WIFE BY DEED RECORDED SEPTEMBER 19, 1946 IN BOOk 1455, PAGE 243 OF OFFICIAL RECORDS IN THE OFFICE OF THE COUNIY RECORDER OF SAID ORANGE COUNTY; THENCE EAST ALONG SAID NORTH LINE, 254.94 FEET TO THE NORTHWESTERLY CORNER OF TtiE LAND CONVEYED TO W.E. SCttMITT AND WIFE BY DEED RECORDED JULY 19, 1950 IN BOOK 2044, PAGE 46 OF OFFICIAL RECORDS tN THE OFFICE OF THE COUNTY RECORDER OF SAID ORANGE COUNTY; THENCE ALONG THE WESTERLY LINE OF SAID LAND CONVEYED TO SCHMITT, THE FOLLOWING COURSES: SOUTH 59 DEGREES 42' EAST 277.00 FEE~; SOUTH 29 DEGREES 33' EAST 598.14 FEET; SOUTH 5 DEGREES 51' WEST 91.88 FEET TO A POINT IN THE NORTHERLY LINE OF THE LAND CONVEYED TO JACOB G. TINKEN AND WIFE BY DEED RECORDED FEBRUARY 28, 1948 IN BOOk 1730, PAGE 326 OF OFFICIAL RECORDS IN THE OFFICE OF THE COUNTY RECORDER OF SAID ORANGE COUNTY; THENCE ~ES]ERLY ALONG SAiD NORTttERLY LINE OF SAID LAND CONVEYED I'O TINKEN, TO THE SOUTHWESTERLY CORNER OF SAID LAND CONVEYED TO DANKER; 1HENCE NORTH 88 DEGREES 24' EAST 192.36 FEET TO THE SOUTHEASTERLY CORNER OF SAID LAND CONVEYED TO DANKER; THENCE NORTH 0 DEGREES 33' EASI 400.00 FEET TO THE POINT OF BEGINNING; and WHEREAS, thereafter, within the time prescribed by law, an interested party or the City Council, on its own motion, caused the review of said Planning Commission action at a public hearing noticed and held as prescribed by law and, as a result thereof, the City Council does hereby make the following findings: 1. That there are no special circumstances applicable to the property which do not apply to other property in the same vicinity and zone. 2. That strict application of the zoning code does not deprive the property of privileges enjoyed by other property in the same vicinity and zone. NOW, TItEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that said Variance be, and the same is hereby, denied. BE IT FURTItER RESOLVED that the time within which rehearings must be sought is governed by the provisions of Section 1.12.100 of the Anaheim Municipal Code and the time within which judicial review of final decisions must be sought is governed by Section 1094.6 of the Code of Civil Procedure and Anaheim City Council Resolution No. 79R-524. THE FOREGOING RESOLUTION is approved and adopted by the City Council of the City of Anaheim this 10th day of May, 1988.
