A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM ESTABLISHING FEES AND PENALTIES
IN CONNECTION WITH THE HAZARDOUS MATERIALS
DISCLOSURE PROGRAM.
WHEREAS, Section 6.10.100 of the Anaheim Municipal Code
authorizes the City Council to establish a schedule of fees and
penalties in connection with the hazardous materials disclosure
program; and
WHEREAS, the City Council desires to establish said fees
and penalties as hereinafter set forth; and
WHEREAS, the fees do not exceed the reasonable costs to
the City of Anaheim of administering the hazardous materials
disclosure program and of responding to requests from the public for
access to disclosure forms.
NOW, THEREFORE, BE tT RESOLVED by the City Council that
the following fees and penalties shall be charged:
To be paid annually by persons using or handling hazardous
materials - Fee shall consist of Materials Fee plus Quantity

Quantity ranges apply for maximum amount of materials per
disclosure of liquid, gas or solid, whichever is greater.
Co
Underground storage tanks, retail swimming pool chemical
suppliers, retail paint suppliers and photography shops
are exempt from quantity.
To be paid by persons requesting access to disclosure forms:
$5.00 per disclosure form
To be paid upon the late filing of apy disclosure form and/or
business emergency plan, up to a maximum of $500.00:
1. 1-14 days late: $100.00
2. 15-21 days late: $200.00
3. 22-28 days late: $300.00
4. 29-35 days late: $400.00
5. 36-60 days late: $500.00
6. Over 61 days late: Penalties of Section 25514(b) of the
Health and Safety Code.
