RESOLUTION NO. 88R-401 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE NO. 5842. WHEREAS, after a request for variance by L AND J ANAHEIM ASSOCIATES, 1050 N. WHEREAS, thereafter, within the time prescribed by law, an interested party or the City Council, on its own motion, caused the review of said Planning Commission action at a public hearing noticed and held as prescribed by law and, as a result thereof, the City Council does hereby make the following findings: 1. The variance will not cause an increase in traffic congestion in the immediate vicinity nor adversely affect the adjoining land uses; and 2. The granting of the variance under the conditions imposed will not be detrimental to the peace, health, safety or general welfare of the citizens of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hereby, granted to permit the addition of 76 guest rooms and 5,000 square feet of meeting/conference room area to an existing 260-room hotel on the property hereinbefore described with waivers of the following sections of the Anaheim Municipal Code: SECTIONS 18.06.050.0241 AND 18.06.080 18.48.066.050 Minimum number (489 required; __ of parking spaces. 285 proposed) That said variance be granted subject to the following conditions: That prior to issuance of a building permit, the appropriate traffic signal assessment fee shall be paid to the City of Anaheim in an amount as determined by City Council resolution. o That sidewalks shall be removed and/or reconstructed along Harbor Boulevard as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer. That prior to issuance of a building permit, the appropriate fees due for primary mains and fire protection service shall be paid to the Water Utility Division in accordance with Rules 1SA and 20 of the Water Utility Rates, Rules and Regulations. -2- o 9. 10. 11. 14. 15. 16. 17. That trash storage areas shall be provided and maintained in a location acceptable to the Street Maintenance and Sanitation Division and in accordance with approved plans on file with said Division. That the minimum dimensions of all small car spaces shall be eight (8 feet by fifteen (15) feet. That as required by the City Traffic Engineer, all tour buses shall load and unload passengers on-site and shall be prohibited from any loading and unloading in the public right-of-way. That a fee shall be paid to the City of Anaheim for tree planting along Ball Road and Harbor Boulevard in an amount as determined by City Council resolution. That the new construction authorized by this resolution shall be served by underground utilities. That fire sprinklers shall be installed as required by the City Fire Department. That all air conditioning facilities and other roof and ground mounted equipment shall be properly shielded from view. That the proposal shall comply with all signing requirements of the CR "Commercial, Recreational" Zone, unless a variance allowing sign waivers is approved by the City Council, Planning Commission or Zoning Administrator. That the on-site landscaping shall be maintained in compliance with City standards. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1 through 4. That all tandem parking spaces shall primarily be used by either employees or valet-parked cars. That the property owner/property occupant shall be responsible for relocating or otherwise replacing any parking spaces removed by CALTRANS due to the widening of Interstate 5 (Santa Ana) freeway. Said plan for replacement parking shall be subject to the approval of the City Traffic Engineer. That prior to issuance of a building permit, or within a period of one year from the date of this resolution, whichever occurs first, Condition Nos. 1, 3, 5 and 7, above-mentioned, shall be complied with. Extensions for further time to complete said conditions may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. That prior to final Nos. 2, 4, 8, 9, 10 with. building and zoning inspections, Condition and 13, above-mentioned, shall be complied -3- 18. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement. BE IT FURTHER RESOLVED that the City Council of the City of Anaheim does hereby find and determine that adoption of this Resolution is expressly predicated upon applicant's compliance with each and all of the conditions hereinabove set forth. Should any such condition, or any part thereof, be declared invalid or unenforceable by the final judgment of any court of competent jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed null and void.
