� RESOLUTIUN OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING ZONING AND DEVELOPMENT
"� STANDARDS RELATING TO SPECIFIC PLAN 88-2 FOR
THE SUMMIT OF ANAHEIM HILLS.
WHEREAS, the Anaheim City Planning Commission did
receive a request from The Baldwin Building Company, a General
Partnership, Attention: lliana Hoard, 16811 Hale Avenue, Irvine,
CA 92714, for approval of Specific Plan No. 88-2, (including a
Public Facilities Plan and Zoning and Development Standards), a
Fiscal Impact Analysis, and amended and restated Development
Agreement No. 88-03, to provide for up to 2,117 residential units,
a 5-acre commercial site, a 10-acre school site, a 12-acre park
site, and 169.1 acres of open space. The property is located
approximately 1.1 miles southeast of Weir Canyon Road and the
Riverside Freeway intersection, and is bounded on the north by
Sycamore Canyon Specific Plan development, on the west by The
Highlands at Anaheim Hills Specific Plan development, and on the
south and east by Irvine company property, and further described
as The Summit of Anaheim Hills Planned Community (PC)(SC). The
legal description of subject property is contained in Planning
Commission Resolution No. PC88-282, recommending City Council
approval of Specific Plan No. 88-02, including conditions; and
WHEREAS, the City Planning Commission did hold a
public hearing upon said application, notices of which public
hearing were duly given as required by law; and
WHEREAS, said Commission, after due inspection,
investigation and studies made by itself and in its behalf and
after due consideration of all evidence and reports offered at
said hearing, did adopt its Resolution No. PC88-282 recommending
the adoption of Specific Plan No. 88-2, Exhibit A and Resolution
No. PC88-283 recommending approval of the zoning and development
standards contained in Specific Plan 88-2 at Chapter IV thereof;
and
WHEREAS, thereafter, within the time prescribed by
law, the City Council caused the review of said Planning
Commission action at a duly noticed public hearing; and
WHEREAS, at the time and place fixed for said public
- hearing, the City Council did duly hold and conduct such hearing
and did give all persons interested therein an opportunity to be
heard and did receive evidence and reports, and did consider the
same; and
WHEREAS, THE City Council does find, after careful
consideration of the recommendations of the City Planning
Commission and all evidence and reports offered at said hearing
concerning the zoning and development standards, that:
l. The property covered by the specific plan has unique
site characteristics including topography, location and
surroundings which will be enhanced by the special land use and
development standards of the specific plan;
2. The plan is consistent with the goals and policies
of the General Plan and with the purposes, standards and land use
guidelines therein;
3. Implementation of the specific plan zoning and
development standards will result in development of a desirable
character which will be compatible with existing and proposed
development in the surrounding area and land uses;
4. The specific plan contributes to a balance of land
uses; and
5. The specific plan respects environmental and
aesthetic resources consistent with economic realities.
AND WHEREAS, the City Council does further find,
after careful consideration of the action of the City Planning
Commission and all evidence and reports offered at said public
hearing before the City Council regarding said specific plan, that
all of the conditions set forth in Section 18.93.040 of the
Anaheim Municipal Code as they apply to zoning and development
standards are present; and
WHEREAS, pursuant to the provisions of the
California Environmental Quality Act, Supplement to Environmental
Impact Report No. 281 was prepared and submitted in connection
with Specific Plan No. 88-2 for the proposed development of the
property referred to as The Summit of Anaheim Hills, and the City
Council certified said Supplement to Environmental Impact Report
No. 281 and adopted the Statement of Overriding Considerations in
their approval of Specific Plan No. 88-2 (Resolution No. 88R-395).
NOW, THEREFURE, BE IT RESOLVED the the Zoning and
Development Standards set forth in Chapter IV of Specific Plan
88-2 as adopted by City Council Resolution No. 88R-395 be, and the
same are here by adopted.
BE IT FURTHER RESOLVED that the approval of, and
exercise of any rights under, the Specific Plan Zoning and
Development Standards as herein adopted or under the Zoning and
Development Standards ordinance as hereinafter adopted shall be
- subject to those certain conditions as specified Resolution No.
88R-395 as the same now exist or may hereinafter be amended.

BE IT FURTHER RESOLVED that the City Council of the
City of Anaheim does hereby find and determine that the adoption
of this Resolution is expressly predicated upon applicant's
compliance with each and all of the conditions hereinabove set
forth. Should any condition or any part thereof, be declared
`� invalid or unenforceable by the final judgment of any court of
competent jurisdiction, then this Resolution, and any approvals
herein contained, shall be deemed null and void.
THE FOREGOING RESOLUTION is approved and adopted by
the City Council of the City of Anaheim this lst day of November,
1988.
