RES-2020-111 RESOLUTION NO. 2020 - 111 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING APPLICATION FOR FUNDING PURSUANT TO THE CALIFORNIA PET ASSISTANCE AND SUPPORT PROGRAM TO ENHANCE AND IMPROVE THE PET PROGRAM AT THE LA MESA SHELTER WHEREAS,homelessness is one of the most pervasive challenges facing cities throughout California; and WHEREAS, the City of Anaheim has developed a homelessness plan and undertaken multiple efforts at the local level to combat homelessness including, but not limited to, creating or augmenting a continuum of shelter and service options for those living without shelter; and WHEREAS, the City of Anaheim entered into that certain agreement dated June 20, 2019 and entitled "Agreement between the City of Anaheim and Illumination Foundation for the Operation of an Emergency Shelter at 3035 E. La Mesa Street" (the "Agreement"). The Illumination Foundation, a nonprofit corporation with a primary mission to shelter individuals experiencing homelessness and pursuant to the terms of the Agreement, Illumination Foundation administers and operates a temporary, low barrier emergency shelter on City-owned property located at 3035 E. La Mesa Street in Anaheim, California(the "La Mesa Shelter"); and WHEREAS, Senate Bill 109 Section 16 (SB 109), authorizes approximately $5 million in Pet Assistance and Support Program ("PAS Program") funds for qualified homeless shelters to provide shelter, food, and basic veterinary services for pets owned by individuals experiencing homelessness, along with staffing and liability insurance related to providing those services; and WHEREAS the State of California, California Department of Housing and Community Development (the "Department") implements and administers the PAS Program and the Illumination Foundation is a "qualified homeless shelter" under the PAS Program guidelines; and WHEREAS, Illumination Foundation has applied for PAS Program funds to allow Illumination Foundation to improve its existing Pet Program at the La Mesa Shelter by providing food, crates, and other supplies for the pets; and WHEREAS, on April 7, 2020, the City Council of the City of Anaheim that the City of Anaheim agreed to be a co-applicant to Illumination Foundation's application to the Department for PAS Program funds; and WHEREAS, the Department may approve funding allocations for the PAS program, subject to the terms and conditions of the NOFA, PAS Program requirements, and the Standard Agreement and other contracts between the Department and PAS Program grant recipients; and 1 WHEREAS, the Department issued a Notice of Funding Availability ("NOFA") dated December 31, 2019 under the PAS Program; and WHEREAS, the City will receive a PAS program grant to fund shelter, food, and veterinarian services, staffing and liability insurance related to providing those services. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim as follows: 1. If the City receives a grant of PAS program funds from the Department pursuant to the above referenced PAS program NOFA, it represents and certifies that it will use all such funds in a manner consistent and in compliance with all applicable state and federal statutes, rules, regulations, and laws, including without limitation all rules and laws regarding the PAS program, as well as any and all contracts Applicant may have with the Department. 2. The City Manager is hereby authorized and directed to receive a PAS program grant, in an amount not to exceed $ 200,000.00 in accordance with all applicable rules and laws. 3. The City hereby agrees to use the PAS program funds for eligible activities as approved by the Department and in accordance with all program requirements, and other rules and laws, as well as in a manner consistent and in compliance with the Standard Agreement and other contracts between the Applicant and the Department. 4.
