A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM DENYING VARIANCE NO, 3809.
WHEREAS, after a request for variance by CHARLES J.
BOLERJACK and DOROTHY A. BOLERJACK, 3625 Savanna Street, Anaheim,
California 92804, property owners, and MICHAEL K. FRAZIER, 18200
Yorba Linda Boulevard, No. 201, Yorba Linda, California 92686,
agent, to permit a three-story, 16-unit "affordable" apartment was
received, a public hearing before the Planning Commission of the
City of Anaheim was held upon due and proper notice, a result of
which Variance No. 3809 was denied covering the following
described property:
THE WEST ONE-HALF, MEASURED ALONG THE SOUTH LINE OF
LOT 21, OF TRACT 743, IN THE CITY OF ANAHEIM, COUNTY
OF ORANGE, STATE OF CALIFORNIA, AS SHOWN ON A MAP
RECORDED IN BOOK 22 PAGE 10 OF MISCELLANEOUS MAPS,
RECORDS OF ORANGE COUNTY, CALIFORNIA.
EXCEPTING TItEREFROM THAT PORTION LYING NORTHWESTERLY
OF THE SOUTHEASTERLY LINE OF THE LAND DESCRIBED IN A
DEED TO ORANGE COUNTY FLOOD CONTROL DISTRICT, RECORDED
MAY OS, 1960 IN BOOK 5227 PAgE 182 OF OFFICIAL
RECORDS; and
WHEREAS, thereafter, within the time prescribed by law,
an interested party or the City Council, on its own motion, caused
the review o£ said Planning Commission action at a public hearing
noticed and held as prescribed by law and, as a result thereof,
the City Council does hereby make the following findings:
1. That there no special circumstances applicable to the
property which do not apply to other property in the same vicinity
and zone.
2. That strict application of the zoning code does not
deprive the property of privileges enjoyed by other property in
the same vicinity and zone.
3. That the project would otherwise be entitled to a density
bonus or two other variances pursuant to Government Code Section
65915, however, the City Council has the discretion to den7 this
variance request due to the number and type of variances requested
for this project.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the
Anaheim that said Variance be, and the same is hereby,
BE IT FURTHER RESOLVED that the time within which
rehearings must he sought is governed by the provisions of Section
1.12.100 of the Anaheim Municipal Code and the time within which
judicial review of final decisions must be sought is governed by
Section 1094.6 of the Code of Civil Procedure and Anaheim City
Council Resolution No. 79R-524.
