A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM DENYING A SPECIAL PERMIT TO MOVE
A RESIDENTIAL STRUCTURE TO 514 EAST BROADWAY
IN THE CITY OF ANAHEIM.
WHEREAS, a written application has heretofore been
filed with the City of Anaheim for a special permit pursuant to
Section 15.32.020 of the Anaheim Municipal Code to move a fourplex
residential structure ("structure") from 1009 E. Lincoln Avenue to
514 E. Broadway in the City of Anaheim, California; and
WHEREAS, said application having been set for hearing
on the 7th day of April, 1987, at the hour of 3:00 p.m. and notice
of the time and place fixed for said hearing having been given by
mail to ali persons residing within a radius of three hundred
(300) feet from the property upon which it is proposed to move
such structure at least ten (10) days before the date fixed for
said hearing, as the names of such owners appeared upon the last
available tax assessment role (hereinafter "property owners"); and
WHEREAS, said hearing was

WHEREAS, said matter tiaving come on regularly for
hearing before the City Council upon the aforesaid dates and said
hearing having been duly held and conducted and ali persons
interested therein given an opportunity to be heard, and the City
Council, having duly considered said application for such special
permit, together with all evidence and reports submitted in
connection therewith, does find that said special permit should be
denied for the reason that a majority of said property owners in
the area have objected to the moving of said structure onto the
property where it is proposed to be moved and that subsection .030
of section 15.32.020 of the Anaheim Municipal Code therefore
requires that said special permit be denied.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the application for a special permit to
move the aforesaid structure to 514 East Broadway in the City of
Anaheim, California, be, and the same is hereby denied for the
reason and based upon the finding hereinabove set forth.
BE IT FURTHER RESOLVED by the City Council that, based
upon the aforesaid finding of a protest b7 a majority of said
property owners, it is unnecessary to find and determine, and the
City Council has not found and determined, whether said structure
meets any or all of the other criteria set forth in Section
15.32.020 of the Anaheim Municipal Code which are necessary to be
met before such special permit may be granted.
