2004-013RESOLUTION NO. 2004- 13 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING A LETTER OF UNDERSTANDING BETWEEN THE INTERNATIONAL BROTHERHOOD OF ELECTRICAL WORKERS, LOCAL 47, AND THE CITY OF ANAHEIM WHEREAS,the City of Anaheim and the International Brotherhood of Electrical Workers, Local 47, have met and conferred and reached an understanding to amend Appendix "A" Wages and Article 48 (Shift Differential) of the Memorandum of Understanding between the Parties in effect from July 21, 2000 through July 27, 2005; and WHEREAS,the International Brotherhood of Electrical Workers, Local 47, is in agreement with the recommendations contained in said Letter of Understanding; and WHEREAS, as a result thereof, the Letter of Understanding dated January 8, 2004 between the parties has been prepared and signed; and WHEREAS, the City Council of the City of Anaheim does find that it is in the best interest of the City of Anaheim to approve said Letter of Understanding. NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Anaheim that the Letter of Understanding dated January 8, 2004, between the International Brotherhood of Electrical Workers, Local 47, and the City of Anaheim, a copy of which is attached hereto and incorporated by reference herein, is hereby approved. THE FOREGOING RESOLUTION is approved and adopted by the City Council of the City of Anaheim this 27th day of January 2004, by the following roll call vote: AYES: Pringle, Tai~-, T ..... ~ Chavoz NOES: None ABSENT: M£Cracken ABSTAIN: None MAYOR OF THE ANAHEIM ATTEST: ~ITY'C~[ERt~ OF THE CITY OF ANAHEIM APPROVED AS TO EORM: JACK L..~'I-IITE, C~T---Y ATTOR~'Ey OT3312CS.doc LETTER OF UNDERSTANDING Between the INTERNATIONAL BROTHERHOOD OF ELECTRICAL WORKERS, LOCAL 47 and the CITY OF ANAHEIM The International Brotherhood of Electrical Workers, Local 47, (IBEW) and the City of Anaheim (ANAHEIM) have met and conferred in good faith and reached an understanding regarding employee wages and other terms and conditions of employment. The PARTIES have reached an understanding to amend the Memorandum of Understanding between the Parties as follows: IBEW and ANAHEIM agree that Appendix "A" Wages will be modified, per the attached, to reflect a 31/2% base wage increase to be effective 3anuary 2, 2004, and to reflect a special equity adjustment to be effective January 2, 2004, to the Line Mechanic benchmark of an additional 2%. Commencing July 1, 2004, ]:BEW and ANAHEIM agree to meet and confer concerning Wages and possible modifications to Article 63 Post- Retirement Medical Benefits. Any changes resulting from these negotiations will be effective no sooner than January 14, 2005. 3. IBEW and ANAHEIM agree that Article 48, Shift Differential, will be amended as follows: 48.1 48.2 48.3 48. 4 ARTICLE 48 SHIFT DIFFERENTIAL Ail work periods, regularly scheduled to begin at noon or later, but before 3:00 p.m.; wi//receive a shift differentia/of $1.00 per hour. Effective January 3, 2003, such shift different/a/w/ii increase to $1.10 per hour. Effective January 2, 2004, such shift differential will increase to $1.25 per hour. Ail work periods regularly scheduled to begin at 3:00 p.m. or later, but before 3.'00 a.m., w/H receive a shift differentia/of $1.45 per hour. Effective January 3, 2003, such shift different/a/wi//increase to $1.55 per hour. Effective Januanl 2, 2004, such shift differential will increase to $1,?$ per hour. When a shift premium is applicable to time worked at the overt/me rate of pay, the overt/me rate shall be applied to the applicable shift premium. When an employee is required to work continuously without a break beyond the end of his/her night shift, the overt/me rate shall be applied to the applicable shift premium. Shift premium shah be payable only for hours actually worked and shah not be paid for non-work time, such as vacat/bns, holidays, sick leave, etc. This Agreement constitutes the entire Agreement between the PARTIES. No modification of this Agreement shall be valid unless in writing and signed by the PARTIES.
