2212ORDINANCE NO. 2212 AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT-. WHEREAS, the City Planning Commission of the City of Anaheim did heretofore duly pass and adopt Resolution No. 957 -- Series 1963-64 , in Reclassification No. 63-64-46 , recommending denial of a change in the boundaries of the zone or zones hereinafter mentioned and described, after having held a public hearing thereon in the manner and as prescribed in Title 18 of the Anaheim Municipal Code to consider such proposed change of zone or zones, and after having received evidence and reports from persons interested therein; and WHEREAS; said City Planning Commission did make findings, and a summary of its hearing, and did recommend denial of a change of zone or zones as set forth in said resolution; and WHEREAS, upon receipt of said resolution, report of findings, summary of evidence and recommendation of the City Planning Commission, the City Clerk did fix the 3rd day of December , 19 63 , as the time, and the Council Chamber in the City Hall of the ty of Anaheim as the place, for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code and change or changes of zone or zones, and did give notice thereof in the manner and as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports, and did thereupon consider the recommendation of the City Planning Commission, and did adopt Resolution(s) No.(s) 63R-968 & 65R-814 , finding and determining that Title 18 of theAnaheim!unicip— a1Z`ode should be amended and that a change or changes in the boundaries of said zone or zones should be made as set forth in said resolution(s); and WHEREAS, in accordance with said resolution(s), certain conditions and requirements were made as conditions precedent to the making of a change or changes of said zone or zones; and WHEREAS, all conditions precedent to said change or changes of zone or zones have been complied with; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS-. SECTION 1. That Title 18 of the Anaheim Municipal Code relating to zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional Zoning Map or Maps showing such change or changes as follows: -1- 63-64-46 That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: The south 252.00 feet of the north 318.00 feet of the east half of the east half of the north- west quarter of the northwest quarter of Section 14, Township 4 South, Range 11 West, in the Rancho Los Coyotes, City of Anaheim, County of Orange, State of California, as per map recorded in Book 51, page 11 of Miscellaneous Maps, in the Office of the County Recorder of said County. EXCEPT the east 1.00 feet thereof. now is R -A, RESIDENTIAL -AGRICULTURAL ZONE, and that it be changed to and incorporated in C-1, NEIGHBORHOOD -COMMERCIAL ZONE, upon the following conditions: 1. That adequate trash storage facilities shall be provided at the southwest corner of subject property, in addition to the area near the south- east corner as shown on Exhibit No. 1, Revision No. 1; that said trash storage areas shall conform to approved plans for such areas on file in the Office of the Director of Public Works and Super- intendent of Streets, and shall be constructed prior to final building inspection. 2. That subject property shall be developed substan- tially, in accordance with plans and specifications on file with the City of Anaheim, marked "Exhibit No. 1, Revision No. 1," and stamped and signed on December 2, 1963, by Mayor Coons. 3. That tree wells shall be provided at approximately 40 -foot intervals in the Lincoln Avenue parkway abutting subject property; that plans for said tree wells and the plantings therein shall be approved by the Superintendent of Parkway Maintenance; and that said tree wells shall be planted with trees prior to final building inspection. 4. That a 6 -foot strip of land shall be landscaped on the Lincoln Avenue frontage, and said landscaping maintained, as indicated on Exhibit No. 1, Revision No. 1; that plans for said landscaping shall be submitted to and approved by the Superintendent; of Parkway Maintenance; and that said landscaping shall be installed prior to final building inspec- tion. 5. That ail air conditioning facilities shall be con- tained within the building or properly shielded from view. 6. That the parking area and the entranceway to the building shall be landscaped as indicated on Exhibit No. 1, Revision No. 1; that plans for said -2- landscaping shall be submitted to and approved by the Superintendent of Parkway Maintenance; and that said landscaping shall be installed prior to final building inspection. 7. That a 6 -foot masonry wall, or wall of equivalent material, shall be constructed around the periphery of the Bella Vista cul-de-sac, except for openings for pedestrian access, which wall shall be con- structed prior to final building inspection. SECTION 2. The City Zoning Map shall be, and the same is hereby, amended, and the property above described shall be excluded from the zone in which it is now situated, and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map as amended is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted. SECTION 3. The City Clerk shall certify to the passage of this ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption, in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in said City, and thirty (30) days from and after its final passage it shall take effect and be in full force.
