RESOLUTION NO. 98RU2
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM AMENDING RESOLUTION NO. 92R-17 ADOPTING
PERSONNEL RULES APPLICABLE TO EMPLOYEES IN MANAGEMENT,
CONFIDENTIAL AND NON-REPRESENTED PART-TIME CLASSIFICATIONS
WHEREAS, the Human Resources Director has recommended in a staff report dated
June 9, 1998, that Resolution No. 92R-17 be amended in the manner hereinafter set forth,
effective June 26, 1998; and
WHEREAS, the City Council of the City of Anaheim does find that amending
Resolution No. 92R-17 is in the best interest of the City of Anaheim; and
WHEREAS, as a result thereof, the need exists to amend Resolution No. 92R-17,
which adopted Personnel Rules for Management, Confidential and Part-Time Non-
Represented classifications.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Anaheim as
follows:
1. That, Section 6.06 of Personnel Rule 6, Premium Pay, be amended to read as
follows:
"6.06 Non-represented part-time employees in the classifications listed below shall be
guaranteed a minimum of four (4) hours, paid at their current hourly rate. For time worked in
excess of four (4) hours, employees shall be paid straight time overtime based on the
applicable hourly rates to be computed in quarter-hour units.

2. That, Section 6.061 of Personnel Rule 6, Premium Pay, be deleted in its entirety.
"6.061 Non represented part time employees in the classifications listed below
who work separate events at both locations (/\naheim Stadium and Convention Center) on the
same day, the four (1) hour guarantee stated in Section 6.07 shall apply to each said event.

3. That, Section 7.7 of Personnel Rule 6, Appointments and Promotions, be amended
to read as follows:
"7.7 In the absence of appropriate employment lists, aD. provisional ActinQ appointment
may be made by the appropriate Executive Manager with the approval of the Human
Resources Director and the City Manager for Executive and Administrative ManaQement
positions, and the Human Resources Director for Middle ManaQement, Supervisory and
Professional positions of a person meeting the minimum qualifications for the position. For
Confidential classifications, Provisional Appointments may be made by the appropriate
Executive ManaQer with the approval of the Human Resources Director.
7.71 For confidential classifications, an eligibility list shall be established within six (6)
months of any regular, full-time position filled by provisional appointment. In the event
that any provisional appointee fails to qualify on the eligibility list as established within
the appropriate time frames of the provisional appointment, said provisional appointee
shall have his/her employment terminated no later than the close of the first complete
biweekly pay period following the establishment of the eligibility list.
7.72 For Executive, Administrative and Middle Management classifications, an
eligibility list shall normally be established within twelve (12) months of any regular, full-
time position filled by provisional actinQ appointment. For Supervisory and Professional
Management classifications an eligibility list shall normally be established within six (6)
months of any regular, full-time position filled by provisional actinQ appointment. In the
event that any provisional actinQ appointee fails to qualify on the eligibility list as
established within the appropriate time frames of the provisional actinQ appointment,
said provisional actinQ appointee shall have his/her employment terminated no later
than the close of the first complete biweekly pay period following the establishment of
the eligibility list"
4. That, Section 9.1 of Personnel Rule 9, Probation, be amended to read as follows:
"9.1 The work and conduct of probationary employees in Confidential, ManaQement
and part-time Unrepresented job classifications shall be subject to close scrutiny and
evaluation, and, if found to be below standards satisfactory to the appointing authority, the
appropriate Executive Manager may reject the probationer at any time during the probationary
period. Such rejections shall not be subject to review or appeal unless such a rejection is

alleged to be contrary to the provisions of any state or federal law or the Personnel Ordinance
and/or Personnel Resolution.
9.11 An Confidential or ManaQement employee rejected or laid off during the
probationary period from a position to which he has been promoted or transferred shall
be returned to the classification in which he/she has regular status unless the reasons
for his/her failure to complete the probationary period would be cause for dismissal
from City service. Part-Time Unrepresented employees shall not be returned to their
former position if they are rejected or laid off durinQ the probationary period."
5. That, Personnel Rule 10, Suspension, Demotion and Dismissal be amended to read
as follows:
"Section 10.0 The tenure of every full-time confidential, management and non-
represented part-time employee shall be conditioned on good behavior and satisfactory work
performance. Any employee may be suspended, demoted or dismissed for good and
sufficient cause as noted in the Sections below.
10.01 When, in the judgment of the appropriate Executive Manager, a Non-Exempt
Confidential, management or non-represented part-time employee's work performance
or conduct justifies disciplinary action short of demotion or dismissal, the employee may
be suspended without payor reduced in salary. Upon taking such action, the
Executive Manager shall file with the employee and the Human Resources Director a
written notification containing a statement of the substantial reasons for the action. No
employee shall be suspended for more than thirty (30) calendar days at anyone time,
except 3S provided for in Section 10.021.
10.02 When, in the judQment of the appropriate Executive ManaQer an employee in a
confidential or manaQement classification desiQnated as "Exempt" whose work
performance or conduct iustifies disciplinary action short of demotion or dismissal, the
employee may be suspended without pay for a full work week or more (in full work
week increments). In cases of violation of safety rules of major siQnificance, an Exempt
employee may be suspended without pay as determined appropriate by the Executive
manaQer. Upon takinQ such action. the Executive ManaQer shall file with the employee
and the Human Resources Director a written notification containinQ a statement of the
substantial reasons for the action. No employee shall be suspended for more than four
(4) consecutive work weeks at anyone time.
10.03 A confidential, management or non-represented part-time employee may be
demoted or dismissed upon recommendation of an Administrative Manager or other
appropriate supervisor whenever in the judgment of the appropriate Executive
Manager, the employee's work or misconduct so warrants. Upon taking such action,
the Executive Manager shall file with the employee and the Human Resources Director,
a written notification containing a statement of the substantial reasons for the action
and the effective date of the action.

10.04 The demotion or dismissal of any Executive Manager shall require the approval
of the City Council before such action is taken by the City Manager."
6. That, Section 16.1 of Personnel Rule 16, Vacation, be amended to read as follows:
"Section 16.1 Employees working in part-time classifications listed below who work
eight-hundred (800) or more hours in any calendar year shall be paid three percent (3%) of
hislher gross earnings as vacation benefits. The calendar year shall be defined as the period
for which wages earned are reported for tax purposes.

BE IT FURTHER RESOLVED that the effective date of this Resolution shall be
June 26, 1998.
AND, BE IT FURTHER RESOLVED that, except as amended herein, Resolution No.
92R-17 shall remain in full force and effect.
