AN ORDINANCE OF THE CITY OF ANAHEIM
AMENDING TITLE 4 OF THE ANAHEIM MUNICIPAL
CODE BY ADDING THERETO CHAPTER 4.06 --
PLACEMENT OF PUBLIC TELEPHONES ON PUBLIC
SIDEWALKS.
THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN
AS FOLLOWS:
SECTION 1.
That Title 4 of the Anaheim Municipal Code be, and
the same is hereby amended by adding thereto Chapter 4.06,
Sections 4.06.010 and 4.06.0202 reading as follows:
"CHAPTER 4.06 -- PLACEMENT OF PUBLIC TELEPHONES
ON PUBLIC SIDEWALKS.
"SECTION 4.06.010 ISSUANCE OF PERMITS - APPROVAL OF
LOCATION.
"The Director of Public Works and Superintendent of Streets
is authorized to issue permits from time to time to the serv-
ing telephone company for the installation and maintenance of
public telephones on the public sidewalks of the City of Ana-
heim. The Director of Public Works and Superintendent of
Streets shall approve the number and location of such public
telephones so as to best serve the public interest.
"SECTION 4.06.020 CONTENTS OF PERMIT.
"Permits issued pursuant to this Chapter shall include the
following provisions:
(a) The permittee shall maintain the public telephones
and any associated booths in good repair and safe and
sightly condition at permittee's expense and to the
satisfaction of the Director of Public Works and
Superintendent of Streets.
(b) The permittee shall save the City of Anaheim harmless
from any and all losses, claims or judgments for damages
to any person or property arising from the installation,
maintenance or presence of the public telephones.
(c) The permittee shall pay to the City of Anaheim 15% of
the gross revenue of each public telephone installed
on public rights of way. In connection with the pay-
ment of 15% of said gross revenues, the permittee shall
submit an accounting and shall pay the proper amount
required for each such installation to the City on
the 1st day of January and the 1st day of July of each
and every year that such permit is in force, and shall
make such accounting and payment within 30 days after
an installation is abandoned or a permit for any
installation is revoked.

(d) The permit shall be revocable on thirty (30) days'
prior written notice to the permittee from the
Director of Public Works and Superintendent of
Streets, in which event the permittee shall at its
own expense, within 10 days after the effective date
of such revocation, remove the public telephone or
telephones installed pursuant to the permit and shall
restore the sidewalk as nearly as practicable to its
condition prior to such installation.
(e) In the event the permittee abandons any installation
where a permit has been granted, permittee shall,
within 10 days after removal of the public telephone
or telephones installed pursuant to the permit,
restore the sidewalk as nearly as practicable to its
condition prior to such installation."
SECTION 2.
The City Clerk shall certify to the passage of this
ordinance and shall cause the same to be printed once within
fifteen (15) days after its adoption, in the Anaheim Bulletin,
a newspaper of general circulation, printed, published and
circulated in said City, and thirty (30) days from and after
its final passage it shall take effect and be in full force.
THE FOREGOING ORDINANCE is approved and signed by me
this 3rd day of August, 1965.

Council of the City of Anaheim held on the 27th day of
July, 1965, and t'nat the same was duly passed and adopted
at a regular meeting of said City Council held on the 3rd
day of August, 1965, by the following vote of the members
thereof:

ABSENT: COUNCILMEN: None
AND I FURTHER CERTIFY tha' the Mayor of the City of
Anaheim approved and signed said Ordinance No. 2173 on the
3rd day of August, 1965.
