A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ANAHEIM ESTABLISHING AN
APPLICATION FEE FOR OPERATOR'S PERMITS
AND OPERATOR'S REGISTRATION FOR
UNLICENSED COMMUNITY CARE FACILITIES
AND SOBER LIVING HOMES.
WHEREAS, under Section 18.16.058 (Community Care Facilities — Unlicensed (Small)
and Sober Living Homes (Small)) of Chapter 18.16 (Regulatory Permits) of Title 18 (Zoning) of
the Anaheim Municipal Code, an applicant for an Operator's Permit or Operator's Registration
must pay a fee at the time in an amount established by resolution of the City Council for the
purpose of defraying the costs and expenses to the City of Anaheim (the "City") for the
processing of applications; and
WHEREAS, the City Council desires to establish a fee to process the applications for
Operator's Permits and Operator's Registration; and
WHEREAS, the fee hereinafter established are less than or equal to, but in any event
do not exceed, the actual direct and indirect costs and expenses incurred by the City in receiving,
processing, analyzing, acting upon and administering applications for the Operator's Permit and
Operator's Registration authorized by Section 18.16.058.
WHEREAS, pursuant to and in accordance with the provisions of the California
Environmental Quality Act (Public Resources Code Section 21000 et seq.; herein referred to as
"CEQA"), the State of California Guidelines for Implementation of the California Environmental
Quality Act (herein referred to as the "CEQA Guidelines"), and the City's Local CEQA
Procedure Manual, the City is the "lead agency" for the preparation and consideration of
environmental documents for "projects", as that term is defined in Section 15378 of the CEQA
Guidelines; and
WHEREAS, the City Council finds and determines that this Resolution is exempt
from the California Environmental Quality Act (CEQA) pursuant to Section 21080(b)(8) of the
California Public Resources Code in that said fee is established to meet operating expenses,
including employee wage rates and fringe benefits and purchasing or leasing of supplies,
equipment, materials and services.; and
NOW, THEREFORE, the City Council of the City of Anaheim resolves, finds and
determines on the basis of the facts set forth in the agenda report presented to it and any
testimony received at the meeting at which this matter was considered, as follows:
Section 1. The foregoing recitals are true and correct.
Section 2. The application fee of Three Hundred Twenty Three Dollars ($323.00) as
set forth in Exhibit A attached hereto is hereby adopted and shall become effective on the
effective date of Ordinance No. 6493 and shall accompany, any application submitted pursuant

to Section 18.16.058 (Community Care Facilities —Unlicensed (Small) and Sober Living Homes
(Small)) of Chapter 18.16 (Regulatory Permits) of Title 18 (Zoning) of the Anaheim Municipal
Code.
THE FOREGOING RESOLUTION is approved and adopted by the City Council of the
City of Anaheim this 27th day of October, 2020, by the following roll call vote:
