4627ORDINANCE NO. 4627 AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING THE ZONING MAP REFERRED TO IN TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: WHEREAS, the Planning Commission did adopt its Resolutions No. PC82-210 and PC83-163 determining that a change or changes in the zone or zones hereinafter mentioned and described should be made as hereinafter set forth after a duly noticed hearing; and WHEREAS, certain conditions and requirements were made as conditions precedent to the making of a change or changes of said zone or zones, which conditions have been complied with. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That the Zoning Map referred to in Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended by rezoning and reclassifying that certain property situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: THE SOUTH 815.00 FEET OF THE EAST HALF OF THE WEST HALF OF THE SOUTHWEST QUARTER OF THE SOUTHWEST QUARTER OF SECTION 12, TOWNSHIP 4 SOUTH, RANGE 11 WEST, IN THE RANCHO LOS COYOTES, AS SHOWN ON A MAP RECORDED IN BOOK 51, PAGE 11 OF MISCELLANEOUS MAPS, RECORDS OF ORANGE COUNTY, CALIFORNIA. EXCEPTING THEREFROM THE EAST 15.00 FEET THEREOF. ALSO EXCEPTING THEREFROM THE SOUTH 40.00 FEET, AS DESCRIBED IN DEED TO THE STATE OF CALIFORNIA RECORDED MARCH 5, 1966 IN BOOK 3424, PAGE 186 OF OFFICIAL RECORDS OF SAID ORANGE COUNTY. THAT PORTION OF THE SOUTHWEST ONE-QUARTER OF SECTION 12, TOWNSHIP 4 SOUTH, RANGE 11 WEST, AS SHOWN ON A MAP RECORDED IN BOOK 51, PAGE 11 OF MISCELLANEOUS MAPS IN THE OFFICE OF THE COUNTY RECORDER OF SAID COUNTY, DESCRIBED AS FOLLOWS: BEGINNING AT A POINT IN THE SOUTH LINE OF SAID SECTION 12, SAID POINT BEING LOCATED 648.71 FEET NORTH 89 DEGREES 41' 10" EAST FROM THE SOUTHWEST CORNER OF SAID SECTION 12, SAID POINT BEING ON THE WEST LINE OF THE EAST 15.00 FEET OF THE EAST ONE-HALF OF THE SOUTHWEST -1- 82-83-4 ONE-QUARTER OF SECTION 12; THENCE NORTH 0 DEGREES 10' 49" WEST 815.00 FEET ALONG THE SAID WEST LINE OF THE EAST 15.00 FEET TO A POINT IN A LINE PARALLEL WITH AND 815.00 FEET NORTHERLY FROM THE SOUTH LINE OF SAID SECTION 12; THENCE SOUTH 89 DEGREES 41' 10" WEST 316.93 FEET ALONG SAID PARALLEL LINE TO A POINT IN THE WEST LINE OF THE EAST ONE-HALF OF THE WEST ONE-HALF OF THE SOUTHWEST ONE-QUARTER OF THE SOUTHWEST ONE-QUARTER OF SAID SECTION 12; THENCE 0 DEGREES 11' 10" WEST 513.23 FEET ALONG THE WEST LINE OF SAID EAST ONE-HALF OF THE WEST ONE-HALF TO A POINT IN THE NORTH LINE OF THE SAID SOUTHWEST ONE-QUARTER OF THE SOUTHWEST ONE-QUARTER OF SECTION 12; THENCE NORTH 89 DEGREES 41' 20" EAST 661.98 FEET ALONG SAID NORTH LINE TO A POINT IN THE EAST LINE OF THE WEST 330.00 FEET OF THE EAST ONE-HALF OF THE SOUTHWEST ONE-QUARTER OF THE SOUTHWEST ONE-QUARTER OF SAID SECTION 12; THENCE SOUTH 0 DEGREES 10' 49" EAST 1328.23 FEET ALONG THE EAST LINE OF THE SAID WEST 330.00 FEET TO A POINT IN THE SOUTH LINE OF SAID SECTION 12; THENCE SOUTH 89 DEGREES 41' 10" WEST 345.00 FEET ALONG SAID SOUTH LINE TO THE POINT OF BEGINNING. EXCEPT THE SOUTH 40.00 FEET OF THE EAST 345.00 FEET THEREOF, into the "RM -1000" RESIDENTIAL, MULTIPLE -FAMILY ZONE, subject to the following conditions: 1. That a tentative tract map shall be submitted for review and approval by Planning Commission. 2. (a) That the owner(s) of the subject property shall pay to each mobilehome owner as identified in the conversion impact report relocation benefits in the respective amounts as set forth on Exhibit "A" attached hereto and incorporated herein by this reference, or such other benefits as mutually agreed upon between the park owner and the mobilehome owner. Said relocation benefits shall be paid to each mobilehome owner, and proof thereof submitted to City in a form satisfactory to the City Attorney, prior to the issuance of any building permit for any phase or portion of the proposed development other than these portions identified as Phase 1 and Phase 2 as shown on the Phasing Plan, Sheet 4, Revision No. 1 of plans on file in the Planning Department of the City of Anaheim, or prior to July 1, 1985, whichever occurs first. (b) That not withstanding subparagraph (a) above, any mobilehome owner who relocates from the park at any time after the date of issuance of grading permits for any phase of the development shall be paid said relocation benefits contemporaneous with the termination of each tenancy provided, however, that such advance payments pursuant to this subparagraph (b) need not be made at any time in advance of the date otherwise set forth in subparagraph (a) to more than ten percent (10%) of such mobilehome owners. -2- (c) That the amount of said relocation benefits payable to each mobilehome owner pursuant to subparagraph (a) or (b) above, shall be increased by an amount equal to any increase in the Consumer Price Index for Urban Wage Earners and Clerical Workers, All Items, Los Angeles -Long Beach Metropolitan Area (1967=100), published by the United States Department of Labor, Bureau of Labor Statistics ("Index"), which is published nearest to the date of this resolution as compared to the Index most recently published prior to the date of payment of said relocation benefits. (d) That the owner of the subject property shall post a performance bond in an amount and form satisfactory to the City Attorney to guarantee the payment of said relocation benefits. 3. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Revision No. 3 of Exhibit Nos. 1 through 12; provided, however, that the three-story structure shall be relocated a minimum of fifty (50) feet from the northerly property line and that revised plans indicating such revision shall be submitted to and approved by the Planning Department staff prior to the issuance of building permits. 4. That Condition No. 3, above-mentioned, shall be complied with prior to final building and zoning inspections. SECTION 2. The City Zoning Map shall be, and the same is hereby, amended and the property above-described shall be excluded from the zone in which it is now situated and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map, as amended, is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted. SECTION 3. CERTIFICATION The City Clerk shall certify to the passage of this ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, published and circulated in said City, and thirty (30) days from and after its final passage, it shall take effect and be in full force.
