AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING
THE ZONING MAP REFERRED TO IN TITLE 18 OF THE
ANAHEIM MUNICIPAL CODE RELATING TO ZONING.
THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT:
WHEREAS, the Planning Commission did adopt its Resolution
No. PC84-201 determining that a change or changes in the zone or
zones hereinafter mentioned and described should be made as
hereinafter set forth after a duly noticed hearing; and
WHEREAS, certain conditions and requirements were made as
conditions precedent to the making of a change or changes of said
zone or zones, which conditions have been complied with.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM
DOES ORDAIN AS FOLLOWS:
SECTION 1.

SUBJECT TO EASEMENTS, RESERVATIONS AND COVENANTS OF

into the "RM -1200" RESIDENTIAL, MULTIPLE -FAMILY ZONE, subject to the
following conditions:
1. That sidewalks, curbs, gutters and paving shall be
relocated along Lincoln Avenue as required by the City Engineer and
in accordance with standard plans and specifications on file in the
Office of the City Engineer.
2. That the owner of subject property shall pay to the City
of Anaheim a fee for street lighting along Lincoln Avenue in an
amount as determined by the City Council.
3. That prior to issuance of a building permit, primary water
main fees shall be paid to the City of Anaheim, in an amount as
determined by the Office of the Utilities General Manager.
4. That prior to issuance of a building permit, appropriate
park and recreation in -lieu fees shall be paid to the City of Anaheim
in an amount as determined by the City Council.

5. That prior to issuance of a building permit, the
appropriate traffic signal assessment fee shall be paid to the City
of Anaheim in an amount as determined by the City Council for each
new dwelling unit.
6. That all driveways shall be designed to accommodate ten
(10) foot radius curb returns as required by the City Traffic
Engineer.
7. That drainage of subject property shall be disposed of in
a manner satisfactory to the City Engineer.
8. That subject property shall be served by underground
utilities.
9. That prior to commencement of structural framing, fire
hydrants shall be installed and charged as required and determined to
be necessary by the Chief of the Fire Department.
10. That trash storage areas shall be provided and maintained
in accordance with approved plans on file with the Street Maintenance
and Sanitation Division.
11. That gates shall not be installed across any driveway or
private street in a manner which may adversely affect vehicular
traffic in the adjacent public streets. Installation of any gates
within a distance of forty (40) feet from said public street
rights-of-way shall be subject to the review and approval of the City
Traffic Engineer.
12. That all air conditioning facilities shall be properly
shielded from view, and the sound buffered from adjacent properties.
13. That prior to issuance of building permits, the applicant
shall present evidence satisfactory to the Chief Building Inspector
that the residential units will be in conformance with Noise
Insulation Standards specified in the California Administrative Code,
Title 25.
14. That prior to issuance of building permits, the applicant
shall present evidence satisfactory to the Chief Building Inspector
that the proposed project is in conformance with Council Policy
Number 542 "Sound Attenuation in Residential Projects".
15. That a 6 -foot high masonry block wall shall be constructed
and maintained along the north, east and west property lines and
adjacent to those property lines abutting the CL zoned restaurant
property to the southwest.
16. That the existing driveway serving the restaurant property
located southwest of subject property shall be relocated
approximately 50 feet easterly, to the satisfaction of the City
Traffic Engineer. Said existing driveway shall be removed and
replaced with a standard curb, gutter, sidewalk and landscaping.

17. That prior to issuance of a building permit, or within a
period of one year from the date of this resolution, whichever occurs
first, Condition Nos. 2, 3, 4, 5, 13 and 14, above-mentioned, shall
be complied with. Extensions for further time to complete said
conditions may be granted in accordance with Section 18.03.090 of the
Anaheim Municipal Code.
18. That prior to final building and zoning inspections,
Condition Nos. 1, 6, 7, 8, 10, 11, 17, 15 and 16, above-mentioned,
shall be complied with.
SECTION 2.
The City Zoning Map shall be, and the same is hereby,
amended and the property above-described shall be excluded from the
zone in which it is now situated and incorporated in and made a part
of the zone or zones as above set forth, and said City Zoning Map, as
amended, is hereby adopted and the City Engineer is hereby directed
to prepare a sectional zoning map to be added to the City Zoning Map
showing the changes hereby approved and adopted.
SECTION 3. CERTIFICATION
The City Clerk shall certify to the passage of this
ordinance and shall cause the same to be printed once within fifteen
(15) days after its adoption in the Anaheim Bulletin, a newspaper of
general circulation, published and circulated in said City, and
thirty (30) days from and after its final passage, it shall take -
effect and be in full force.
THE FOREGOING ORDINANCE is approved and adopted by the
City Council of the City of Anaheim this 9th day of July, 1985.
