ORDINANCE 4634
AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING
SECTION 1.01.220 OF THE ANAHEIM MUNICIPAL CODE
DEFINING CERTAIN WORDS.
THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS
SECTION 1.
That Section 1.01.220 of Chapter 1.01 of Title 1 of the
Anaheim Municipal Code be, and it is hereby, amended in its
entirety to read as follows:
"1.01.220 CONSTRUCTION - 'SHALL' - 'MAY'
'Shall' is mandatory and 'may' is
permissive.
'Shall' and 'may' when referring to or
imposing a duty upon any officer, agent, or employee of
the City of Anaheim in that person's capacity as such
officer, agent or employee shall be 'directory' and
shall create no rights, including any right to money or
damages, in favor of any party or person other than the
City of Anaheim. 'Shall' in any regulation or order
adopted or promulgated by any officer of the City of
Anaheim when referring to or imposing a duty on an
officer or employee of the City of Anaheim shall be
directory and shall create no rights, including any
right to money or damages, in favor of any party or
person other than the City of Anaheim.
No officer or employee shall adopt or
promulgate or be authorized to adopt or promulgate any
regulation or order which creates any mandatory duty
that creates any rights in favor of any party or person
other than the City of Anaheim.
The City Council declares that this
definition is declaratory of the intention of the
present ordinance and not a new enactment."
SECTION 2. SEVERABILITY
The City Council of the City of Anaheim hereby declares
that should any section, paragraph, sentence or word of this
ordinance, hereby adopted, be declared for any reason to be
invalid, it is the intent of the Council that it would have passed
all other portions of this ordinance independent of the
elimination herefrom of any such portion as may be declared
invalid.
SECTION 3. CERTIFICATION
The City Clerk shall certify to the passage of this
ordinance and shall cause the same to be printed once within
fifteen (15) days after its adoption in the Anaheim Bulletin, a
newspaper of general circulation, published and circulated in said
City, and thirty (30) days from and after its final passage, it
shall take effect and be in full force.
THE FOREGOING ORDINANCE is approved and adopted by the
City Council of the City of Anaheim this 30th day of July, 1985.
