A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AMENDING
RATES, RULES AND REGULATIONS FOR THE SALE AND DISTRIBUTION OF WATER
AS ADOPTED BY RESOLUTION NO. 72R-600 AND AMENDED BY RESOLUTION NOS.
73R-255, 73R-387, 73R-532, 74R-433, 75R-315, 75R-469, 75R-479,
76R-378, 78R-418, 78R-419, 78R-459, 79R-643, 80R-304, 81R-124,
81R-402, 82R-355, 83R-331, 84R-246, 86R-118, and 87R-188.
WHEREAS, the City of Anaheim maintains a water distribution system
for the furnishing of water to residents and inhabitants of the City of
Anaheim and has adopted Water Rates, Rules and Regulations for the sale and
distribution of water; and
WHEREAS, it is the policy of the City Council that Anaheim's Water
Utility shall be self-supporting from charges made by the City for water
furnished to consumers and for services rendered in connection therewith; and
WHEREAS, the Public Utilities Board held a public hearing on
July 23, 1987 and evidence was presented in connection with the proposed
revisions of water rates and fees; and
WHEREAS, the Public Utilities Board considered the California
Environmental Quality Act and made the following findings:
The largest single expenditure category during the test period of July
1, 1986 through June 30, 1988 is water supply at an estimated
$7,635,000.
2. Other operating expenses and capital expenditures estimated to cost
$9,529,000 are due to labor and material costs.
Debt service requirements and an increase in reserve amounts estimated
to cost $2,524,000 are required to meet financial reserves and
requirements.

The transfer to the general fund in an amount estimated to be $766,000
is authorized by the City Charter and constitutes an Intra-City
transfer.
5. The increase in working capital of $62,000 is required to meet the
Utility's cash requirements.
The fee increases for temporary service, service connections, meter
installations, inspection services, plan check services, and primary
distribution main extensions are due to labor cost increases and
higher material costs.
The matters covered in 1 through 6 above come within Section 21080 (b)
(8) of the Public Resources Code of the State of California thus the
establishment of these rates are exempt from the California
Environmental Quality Act.

WHEREAS, a Notice of Hearing was published as follows:
On July 9, 1987, notice of the public hearing on water rates was
published in the Anaheim Bulletin and proof thereof is on file with
the Secretary of the Public Utilities Board.

WHEREAS, the Public Utilities Board has considered the proposal of
the Public Utilities Department and has considered the evidence presented at
the public hearing; and
WHEREAS, the Public Utilities Board has made the following findings
with respect to the need for an increase in the water rates and fees:
The Water System revenue requirement of the Anaheim Public Utilities
Department will be established, as set forth below, on the basis of
projections for a Test Period consisting of the twelve months July 1,
1987 through June 30, 1988.
2. A reasonable estimate of the revenue requirement for water supply
costs for the test period is $7,635,000 as shown in Exhibit MAB-1.
3. A reasonable estimate of the revenue requirement for other operating
expenses for the test period is $6,362,000 as shown in Exhibit MAB-1.
4. A reasonable estimate of the revenue requirement for capital
expenditures funded from rates for the test period is $3,167,000.
5. A reasonable estimate of the revenue requirement for debt service and
reserve increases for the test period is $2,524,000.
6. A reasonable estimate of the revenue requirement for transfer to the
General Fund for the test period is $766,000 as shown in Exhibit MAB-1.
A reasonable estimate of the revenue requirement for an increase in
working capital for the test period is $62,000 as shown in Exhibit
MAB-1.
A reasonable estimate of the revenue requirement offsets due to other
water revenues and interest income for the test period is $468,000 as
shown in Exhibit MAB-1.

It is appropriate to perform a cost-of-service study in order to
determine the allocated revenue requirement for the test period
for the following customer classes: Single-Family Residential;
Multi-Family Residential; Residential Outside City; Commercial/
Industrial; Municipal; Irrigation; and Private Fireline.
The customer class revenue requirements as determined on the basis
of an annualized cost-of-service analysis are shown in Exhibit
BGT-1 and are appropriate. The estimated total allocated
annualized revenue requirement of $20,288,000 as set forth below
is appropriate.

14. It is appropriate to continue to fund a Water Capital Replacement Fund
with revenues from the sale of water.

It is appropriate to continue to gradually increase the portion of the
Water Capital Replacement Fund which is funded by revenues from the
sale of water.
16. A reasonable estimate for installing service laterals and meter boxes
is shown in Exhibit DXV-4.
17. A reasonable estimate for installing meters is shown in Exhibit DXV-4.
18. A reasonable estimate of acreage fees is shown in Exhibit DXV-4.
19. A reasonable estimate for charges for Assignment of Rights for
Contracts is shown in Exhibit DXV-5.
WHEREAS, based on the findings hereinabove made, the Pu lic
Utilities Board of the City of Anaheim recommends to the City Council that the
Council adopt the findings of the Public Utilities Board with respect to the
matters contained herein and adopt the water rates and fees shown in E~hibit
BGT-6 and Exhibits DXV-4 and 5.
WHEREAS, the City Council has considered the evidence and concurs
with the findings of the Public Utilities Board as set forth hereinabove.
NOW, THEREFORE BE IT RESOLVED that the findings of the Public
Utilities Board be, and they are hereby, adopted by the City Council of the
City of Anaheim.

NOW, THEREFORE BE IT FURTHER RESOLVED that based on the findings
hereinabove made and adopted, the budget for fiscal year 1987-88 should be
modified as follows:
Control Center 82, Fund 51, Utilities Debt
Service - From $2,268,078 to $2,142,011 as shown:
FA Fees Object 06605 from $24,000 to $44,000
New Bond Interest Object 06842 from $350,000 to #233,333.
New Bond Principle Object 06847 from $30,000 to $0.
BE IT FURTHER RESOLVED by the City Council of the City of Anaheim that the
Water Rates, Rules and Regulations adopted by City Council Resolution No.
72R-600 and amended by City Council Resolution Nos. 73R-255, 73R-387, 73R-532,
74R-433, 75R-315, 75R-469, 75R-479, 76R-378, 78R-418, 78R-419, 78R-459,
79R-643, 80R-304, 81R-124, 81R-402, 82R-355, 83R-331, 84R-246, 86R-118 and
87R-188 be amended as follows, to wit:
BE IT FURTHER RESOLVED by the City Council of the City of Anaheim that the
amended Water Rates, Rules and Regulations be made effective for service
rendered on and after August 5, 1987.
THE FOREGOING RESOLUTION is approved and adopted by the City Council of

displaced by use of natural gas or diesel fuel.

Spacer Connections:
For tract developments requiring two inches or smaller meters, spacer
connections may be provided for the purpose of eliminating damage to
permanent meters during the grading of parkways, and for pressure
testing of plumbing. The rate shall be ~4.05 per month for a
single-family unit and an additional charge of $0.80 will be made for
each unit in excess of one.
SPECIAL CONDITIONS
A. Rates A and B of this schedule are subject to Schedules W-CA, W-PS
and rules and regulations of the Utility.
For Rate A of this schedule, the permit holders are required to
submit meter readings of the temporary meters on a monthly basis on
forms provided by the Utility. If the forms are not returned within
10 days from the date sent and it becomes necessary that a Utility
inspector obtain meter readings at the job site, an additional $16.50
fee will be applied.
C. Temporary metered connections may be terminated at any time, and will
be at the discretion of the Utility.

When the total period of service is less than 30 days, no
prorations will be made, and the bill shall not be less than
the monthly minimum.
B. READINGS OF SEPARATE METERS NOT COMBINED
For the purpose of billing, each meter upon the customer's premises
will be considered separately, and the readings of two or more meters
will not be combined, except as follows:
1. Where combination of meter readings are specifically provided for
in the tariff schedules.
2. Where the Utility's operating convenience requires the use of
more than one meter per service connection.
C. PAYMENT OF BILLS
1. Ail bills are due and payable upon presentation. Payment shall
be made at the City of Anaheim, Division of Collections.
Bills for connection or re-connection of service and payments for
deposits or to reinstate deposits as required under the rules of
the Utility shall be paid before service will be connected or
reconnected.
D. RETURNED CHECK CHARGE
The Utility may require payment of a returned check charge equal to
that permitted under the City of Anaheim Municipal Code for any check
returned from the bank unpaid.

4. Primary Distribution Mains
Primary Distribution Mains which supply water to all areas of
the system shall be paid for by acreage fees assessed on all
properties in the system except those properties excluded in
(1) above. The fees will be based upon gross acreage served
by domestic water service and/or fire protection, and will be
due prior to signature approval of the final water
improvement plans by the Water Engineering Manager. This
does not apply to application for temporary or irrigation
service. The water main extension fees shall be $2,225.00
per acre.
The above fees will be calculated to the nearest one

Public-owned facilities such as freeways, flood control
channels, and water spreading basins may not be required to
pay the water main extension fees if water service for these
properties is not required. If a portion of these facilities
require water service, the water main extension fees shall be
paid on that portion requiring service.
When a Primary Distribution main must be extended to a new
subdivision or development, the Utility will extend the main
up to five hundred (500) feet. If an extension greater than
500 feet is required, the developer will pay for the
extension that is in excess of 500 feet, in addition to the
normal water main extension fees. The developer's portion of
the cost shall be reimbursed to him without interest as
acreage fees are collected from others connecting to the
extended main within a refund area designated by the Utility
at the time the advance is made. The reimbursement agreement

shall be in effect for a period of ten (10) years. In no case
shall the reimbursement exceed the developer's cost of the
extension.
If the Utility requires a main larger than that required to serve
a new development, the developer will only pay the cost of the
size required to service his property (minimum of 8-inch for
residential, 10-inch for commercial, and 12-inch for industrial).
c. Normal practice of the Utility is to extend all Primary
Distribution Mains. In unusual circumstances, the applicant for
water service who requires Primary Distribution Mains may be
permitted, if qualified in the judgment of the Utility, to
construct and install the mains himself, or arrange for their
installation pursuant to competitive bidding procedures initiated
by him, and limited to contractors who possess a current
California Contractor's License permitting them to do this type
of construction work.
The cost, including the cost of inspection and supervision by the
Utility, shall be paid directly by the applicant. The applicant
shall provide the Utility with a statement of actual construction
cost in reasonable detail. The installation shall be in
accordance with the plans and specifications prepared by the
Utility.
For purposes of making any reimbursement to applicant or
crediting applicant with payment of water fees the cost of the
main extension made by applicant shall be deemed to be the lesser
of (1) the actual cost or (2) the Utility's per foot cost of
water mains used in determining the water main extension fees.
d. A map dated June 1, 1987 showing the Primary Distribution Mains
is included and made a part of the Rules and Regulations.

Right-of-way, inspection and field valve program fees shall be
due prior to signature approval of the water system improvement
plans by the Water Engineering Manager.
Fees for Utility Labor are hereby established as follows:
Plan Check Fee: Four Hundred Dollars (~400.00) plus Forty
Cents (~0.40) per linear foot of pipe in excess of five
hundred (500') feet.
Construction Inspection Fee: Four Hundred Dollars ($400.00)
plus Forty Cents (~0.40) per linear foot of pipe in excess of

e. Standard Specifications for Construction of Domestic Water
Systems. A fee of Ten Dollars ($10.00) will be charged by
the Water Engineering Division, Public Utility Department for
each copy of the Water Engineering Division's Standard
Specification for Construction of Domestic Water Systems.
5. Refund of Advances
a. Each Advance in excess of the Special Facilities Charge shall
be refunded from subsequent Applicant's Share of Prior
Advances, Special Facilities Charges, any interest derived
from Special Facilities accounts by the City, or payments
collected as Special Facilities Surcharges from customers in
the Applicant's Special Facilities District, in accordance
with a written agreement between the Utility and the
Applicant. Refund of the amount of the Special Facilities
Charge shall be made only from the Special Facilities
Surcharges. Beginning November 1, 1979, and thereafter, any
interest derived from Special Facilities accounts by the City
shall be subject to refund to Applicants. Interest derived
prior to said date of November 1, 1979 shall not be subject
to refund. Assignment of Rights under written agreement
shall require prior City Council approval and shall be
subject to a fee of Three Hundred Dollars (~300.00) to cover
the cost of processing the assignment.
b. The total amount of any refund to an Applicant shall not
exceed the amount of his Advance, without interest.
c. Refunds shall be subject to any existing Revenue Bond
Covenants, and shall be junior to any present or future bond
payments.

5. Refund of Advances
The Utility shall make refunds to the Applicant who made an
Advance, or his assignee, for a period of thirty years from
the date the Advance was made, or until the amount of the
Initial Capital Investment has been paid, without interest,
whichever comes first.
When it has been necessary for the Utility to advance funds
to alter or add to the Special Facilities in a Special
Facilities District, funds available for refunds will first
be applied to the Utility's Advance before Section B.5.f. is
applicable.
Where two or more Applicants in a Special Facilities District
have paid advances in a Special Facilities District, they
shall each receive as refunds a proportional amount of the
funds received from Share of Prior Advances, interest derived
from Special Facilities accounts by the City, Special
Facilities Charges, and Special Facilities Surcharges
available for refund. The most recent Applicant shall not be
eligible for a refund from the Share of Prior Advances, or
the Special Facilities Charge Applicant advanced.

The costs of all transmission and terminal storage facilities serving
the East Santa Ana Canyon Area as defined herein shall be paid for by
the owners or developers of property benefiting from such facili-
ties. The procedure set forth herein provides that the person who
develops a parcel of property within the East Santa Ana Canyon Area
shall pay his proportional share of transmission and terminal storage
facilities in the form of Transmission and Terminal Storage Acreage
Fees. Other fees, which are covered in Rule 15-A, and 15-B of the
City's Water Rates, Rules and Regulations shall also be applicable.
1. Definition of Terms

"East Santa Ana Canyon Area" - That portion of the Water
Utility's service area located generally south of the Santa
Ana River and extending to the Orange-Riverside County line,
as shown on Drawing No. W-2389-B on file at the City of Ana-
heim, Public Utilities Department, Water Engineering Division.

"Transmission Facilities and Terminal Storage Facilities" -
Those facilities associated with those certain pipelines and
reservoirs deemed necessary by the Water Utility to provide
water in an efficient and reliable manner, and which have
been determined by the Water Utility to be of direct benefit
to the East Santa Ana Canyon Area.
"Primary Distribution Main" - The primary distribution
portion of the 36 inch water main serving the East Santa Ana
Canyon is hereby defined as 33.24% of the capacity and cost
of the 36 inch water main constructed from the existing City
system in the vicinity of Mohler Drive and Santa Aha Canyon
Road to the most southerly boundary of the Bauer Ranch
Development as shown as Phase 1 and Phase la on Drawing
W2389-B.

1. Definition of Terms
f. "Transmission and Terminal Storage Acreage Fees" - Transmis-
sion and Terminal Storage Acreage Fees shall be the rate to
be charged per acre of gross area of Applicant's property.
This rate is to be computed by dividing the gross area within
the East Santa Aha Canyon Area into the cost of Transmission
and Terminal Storage Facilities determined to be of direct
benefit to the East Santa Ana Canyon as shown on Drawing
W-2389.
g. "East Santa Ana Canyon Area Documents" - Shall consist of
Drawing Nos. W-2389-B and W-2393 delineating the boundary of
the East Santa Ana Canyon Area, location and estimated or
actual cost of transmission and terminal storage facilities
and gross area in acres. These documents shall be revised
periodically to reflect adjusted gross area, actual cost of
facilities in place, current cost estimates, and such other
costs which may be incurred annually in direct benefit of the
area described in Rule 15-C.
2. Computation of Char~es
a. Transmission Facilities Acreage Fees - Transmission Facili-
ties Acreage Fees shall be computed on the basis of estimated
or actual costs of construction of the Transmission
Facilities as defined in Rule 15-C-l-d, as adjusted by an
amount equal to any change in the Engineering News Record
(ENR) construction cost index, as provided for in Rule
15-C-3-e, since the date of completion for those Trans-
mission Facilities previously

b. Terminal Storage Facilities Fees - Terminal storage facili-
ties fees shall be computed on the basis of the estimated or
actual costs of construction of the Terminal Storage
Facilities as defined in Rule 15-C-l-e, and dividing the
total cost by the gross acres remaining to be developed
within the described area, and multiplying the quotient by
the number of acres in the Applicant's development area. The
Applicant's development area shall be measured to the nearest
one-hundredth acre of the gross acreage.
c. Acreage fees for Terminal Storage and Transmission Main
Facilities within the east Santa Aha Canyon area, subsequent
to the first initial phases of development, shall be paid
prior to recordation of the final Tract Map. Acreage fees
shall be required on tracts in their entirety. Payment of
acreage fees for portions of a tract shall not be accepted.
3. Advances
a. When, in the opinion of the General Manager, Public Utilities
Department, a facility, or a portion of a facility, is
required to provide proper service to an Applicant's
property, the Applicant shall be required to advance funds as
herein provided for the construction of said facilities.

b. Advances for Transmission Facilities and Terminal Storage
Facilities shall include only those facilities shown on
Drawing Nos. W-2389-B and W-2393. Transmission and Terminal
Storage costs shall be based on the Water Utility's estimate,
the consulting design engineer's cost estimate, and the
construction bid or the final construction cost, depending on
what state of development the facilities are in. This cost
shall include, but shall not necessarily be limited to, the
cost of engineering, land or right-of-way (including acquisi-
tion costs thereof), reservoirs, transmission water mains,
grading, paving, telemetry, retaining walls, curbs and
drainage facilities, and the cost of all other improvements
and overheads necessary in the opinion of the General
Manager, Public Utilities Department, to make these
facilities a permanent operating water installation.

4. Timin~ and Revision of Advances
Applicants in the East Santa Aha Canyon Area shall be required to pay
advances, which may consist of fees and construction cost advances by
one or more of the following methods.
If, in the opinion of the General Manager, additional funds
are required to construct terminal storage and transmission
main facilities in excess of the terminal storage and
transmission main fees, the applicant shall enter into an
agreement with the City which provides for the advance of
additional funds to construct the required facilities. The
agreement shall provide for the reimbursement of funds in
excess of the terminal storage and transmission main fees
which are in effect at the time the agreement is entered into.
In the event the advance consists only of the terminal
storage and transmission main acreage fees, the fees shall be
paid prior to recordation of the final tract map. Acreage
fees shall be required on tracts in their entirety. Payment
of acreage fees for portions of a tract shall not be accepted.
c. Primary mains in the East Santa Ana Canyon Area shall be
treated in the manner set forth in Rule No. 15-A.

Revision of Advances Due - The Water Utility shall revise the
East Santa Ana Canyon Area Documents periodically to reflect
acreage adjustment, actual cost of facilities in place,
current cost estimates and such other costs which may be
directly related to the Santa Ana Canyon Area.
A cost adjustment shall also be made for those facilities in
place based on Engineering News Record's (ENR) construction
cost indexes. The adjusted cost shall be levied upon future
Applicants in the form of acreage fees.

5. Reimbursement of Advances
a. Transmission and Terminal Storage Acreage Fees - Transmission
and Terminal Storage Acreage Fees as defined in Rule 15-C-1
are not subject to reimbursement.
b. Where Applicant is required to advance funds for construction
of Transmission and Terminal Storage Facilities within the
East Santa Ana Canyon Area in excess of the prevailing
Transmission and Terminal Storage Fees, pursuant to Rule
15-C-3, said excess advances shall be subject to
reimbursement by the following method.
(1) City will enter into a reimbursement agreement with
Applicant for the period of time not to exceed twenty
five (25) years.
(2) The Transmission and Terminal Storage Fees shall be
established at the prevailing acreage rate in effect at
the time the reimbursement agreement is entered into by
the City.
(3) In no case will the reimbursement exceed the Applicants
advance over and above the Transmission and Terminal
Storage Fee as provided for in Rule 15-C-2-a and
adjustments as provided for in Rule 15-C-4-e.
(4) The amount of reimbursement due Applicant shall be
determined within 90 days of the issuance of the Notice
of Completion on the basis of actual contract costs
directly associated with Transmission and/or Terminal
Storage Facilities.

6. METHOD OF REIMBURSEMENT
a. Transmission Facilities
(1) Transmission Facilities - Reimbursements for advances
made in excess of the Transmission Facilities Acreage
Fees shall not commence until the Transmission Facilities
as shown on East Santa Ana Canyon Area Document
No. W-2389-B are completed in their entirety.
Thereafter, reimbursements shall be made as transmission
acreage fees are collected from subsequent Applicants.
(2) Reimbursements shall be made for funds advanced as
adjusted by any change in the Engineering News Record
(ENR) construction cost indexes. The initial adjustment
shall reflect the period of time from the date in which
the notice of completion for those Transmission
Facilities constructed, until the date of the
reimbursement to the nearest month. The ENR construction
cost indexes will be adjusted annually by the Water
Utility on the unrefunded portion due Applicants. This
adjustment will be made after the annual refund and
reflected on the adjusted Transmission and Terminal
Storage acreage fees for the following year. The annual
refund will be made generally in October, and reflect
activity for the period between July 1, and June 30 of
the preceeding fiscal year.

(3) Where two or more Applicants in the East Santa Aha Canyon
Area have advanced funds toward the construction of
Transmission Facilities, they each shall receive as
reimbursement a proportional amount of the monies col-
lected by the Water Utility for Transmission Facilities
Acreage Fees from subsequent Applicants. The
proportional amount of reimbursement shall be deter-
mined by multiplying the gross amount available for
reimbursement times a weighted factor for each eligible
Applicant. The numerator of this factor is the product
of the Applicant's original Advance, multiplied by the
number of years since the date of record of the Appli-
cant's Advance. The denominator of this factor is the
sum of the numerators for all Applicants eligible for
reimbursements. The number of years shall be calculated
to the nearest month.
b. Terminal Storage Facilities
Should the General Manager, Public Utilities Department,
determine that it would be in the best interests of the
East Santa Ana Canyon Area to construct a portion of the
required terminal storage facilities, the cost of which
exceeds the Applicants fees due and monies paid by
previous applicants together with interest, Rule 15-C-4
shall prevail. Reinbursement for advances made in excess
of terminal storage fees shall be made in the same method
outlined in Rule 15-C-5.

Rendition of Water Service - The Water Utility shall not be

agreements which have been executed prior to such revision.

SERVICE CONNECTIONS, METERS, AND CUSTOMER'S FACILITIES
GENERAL
1. For all services, other than those where the developer is
installing the main, the Utility shall furnish and install the
service connection and meter box, after applications is made and
all applicable fees are paid.
2. In new subdivisions, and in other cases where the developer
installs the mains, the developer shall furnish and install the
service connection and meter box, and the Utility shall furnish
and install the meter.
3. The service connection, meter, and meter box will generally be
installed at a convenient location between the curb or edge of
pavement and the property line. If it is considered impractical
to install the facilities in this location, they may be installed
upon the customer's premises, in which case a casement will be
required.
B. SERVICE CONNECTION AND WATER METER INSTALLATION CHARGES
For service connections and water meter installations under (3)
and (4) below, all materials shall be furnished and installed by
the Water Division.
For service connections and water meter installations under (5)
and (6) below, the service connection and meter box shall be
furnished and installed by the developer in accordance with Water
Division specifications. The meter shall be furnished and
installed by the Water Division. It is intended that (5) and (6)
below apply to new subdivisions and other developments where the
developer is installing the in-tract water
facilities.
Inside City Limits (Where Utility Installs Main).
a. Charge with replacement of pavement required:
1 inch service with 5/8 x 3/4 inch meter
1 inch service with 1 inch meter
2 inch service with 1 1/2 inch meter
2 inch service with 2 inch meter
b. Charge without replacement of pavement required:
1 inch service with 5/8 x 3/4 inch meter
1 inch service with 1 inch meter
2 inch service with 1 1/2 inch meter
2 inch service with 2 inch meter

expense. All labor, equipment, and material to be furnished
by the developer.

b. Request for such services shall be made to the Public
Utilities Department, Water Engineering Division.
c. Fees:
A fee of $450.00 per application, plus $50.00 for each
additional service connection, when processed as part of a
single application shall be required to cover the cost of
plan check and inspection.
A fee of $150.00 per application, plus $50.00 for each
additional service connection, when processed as part of a
single application shall be required to cover the cost of the
field valve program.
For services installed on private property an additional fee
of ~300.00 shall be required to cover the cost of processing
a public utility easement.
