A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM VACATING A PUBLIC UTILITY EASEMENT
LOCATED SOUTHEAST OF SANTA ANA CANYON ROAD AND
WEST OF MARTIN ROAD. (87-7A)
WHEREAS, the City Council of the City of Anaheim did,
by resolution duly adopted, declare its intention to vacate
certain public streets, highways or public service easements
pursuant to the Public Streets, Highways and Service Easements
Vacation Law; and
WHEREAS, notice of a public hearing to consider said
vacation was posted and published in the manner prescribed by law;
and
WHEREAS, on the 28th day of July, 1987, a public
hearing was held to allow interested persons to submit evidence
concerning said proposed vacation; and
WHEREAS, the City Council does find, from the evidence
submitted, that the street, highway or public service easement
hereinafter specifically described is unnecessary for present or
prospective public purposes including nonmotorized transportation
facilities.
WHEREAS, if and to the extent that there are in place
public utility facilities in use for which easements are not
reserved and excepted by this resolution, the City Council hereby
determines that the public convenience and necessity requires that
no easements be reserved for such facilities.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Anaheim does hereby order the vacation of that public
utility easement, more specifically described as follows:
That certain easement granted to Southern California
Edison Company by deed recorded April 5, 1951 as
Document 18371 in Book 2170, page 232 of Official
Records, more particularly described as follows:
The right to construct, use, maintain, alter, add to,
repair, replace and/or remove, in, on, and over the
real property hereinafter described...: An electric
line, consisting of poles, necessary guys and
anchors, cross-arms, wires and other fixtures and
appliances, for conveying electric energy to be used
for light, heat, power, telephone and/or other
purposes.
Said real property is described as follows:
That certain parcel of land in the Southwest
one-quarter of Section Thirty-One, Township Three
South, Range Eight West, S.B.B. & M., as conveyed to
the Grantors herein by deed recorded November 14,
1950 in Book 2101, page 327 of Official Records of
said Orange County.
All poles shall be erected and maintained within two
feet of the following described line:
The Northeasterly line of said property of the
Grantors.
Note: Southern California Edison Company easements
have heretofore been acquired by the City of Anaheim.
BE IT FURTHER RESOLVED that the vacation authorized by
this resolution shall not be effective until a certified copy of
this resolution is recorded in the Office of the Recorder of
Orange County.
BE IT FURTHER RESOLVED that the City Clerk be, and she
is hereby, authorized and directed to cause a certified copy of
this resolution to be recorded in the Office of the Recorder of
the County of Orange.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 28thday of July, 1987,
