A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM GRANTING VARIANCE NO. 3659, IN
PART.
WHEREAS, after a request for variance by Keith John
Hultquist and Marlene Marie Hultquist, 1225 Andrea Lane, Anaheim,
California 92807, owners; Blue Ribbon Builders, Inc., 2235 W.
Katella Avenue, Orange, California 92667, agent, Attention: Lynn
Neale, was received, a public hearing before the Zoning
Administor of the City of Anaheim was held upon due and proper
notice, a result of which Variance No. 3659 was granted, in part,
covering the following described property:
LOT 15 OF TRACT NO. 8831, IN THE CITY OF ANAHEIM, AS
SHOWN ON A MAP RECORDED IN BOOK 369, PAGES 1, 2 AND 3
OF MISCELLANEOUS MAPS, RECORDS OF ORANGE COUNTY,
CALIFORNIA; and
WHEREAS, thereafter, within the time prescribed by law,
an interested party or the City Council, on its own motion, caused
the review of said Planning Commission action at a public hearing
noticed and held as prescribed by law upholding the decision of the
Zoning Administrator and, as a result thereof, the City Council
does hereby make the following findings:
1. That there are special circumstances applicable to the
property, including size, shape, topography, location or
surroundings, which do not apply to other property under identical
zoning classification in the vicinity; and
2. That, because of special circumstances shown in (1)
above, strict application of the zoning code deprives the property
of privileges enjoyed by other property under identical zoning
classification in the vicinity; and
WHEREAS, the City Council does further find and determine
with regard to the proposed waiver of certain off-street parking
requirements that:
1. The variance will not cause an increase in traffic
congestion in the immediate vicinity nor adversely affect the
adjoining land uses; and
2. The granting of the variance under the conditions imposed
will not be detrimental to the peace, health, safety or general
welfare of the citizens of the City of Anaheim.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim that a conditional zoning variance be, and the same
is hereby, granted, in part, to construct a two-story addition and
to allow an increase of one bedroom to four instead of five, as
requested, on the property hereinbefore described subject to the
following conditions:
1 That subject property shall be developed substantially in
accordance with plans and specifications on file with the City of
Anaheim marked Exhibit Nos. 1 and 2; provided, however, that a
minimum fifteen (15) foot building setback shall be maintained from
the rear (west) property line, that lot coverage shall not exceed
thirty-five percent (55%) and that only four (4) bedrooms are
permitted. Revised plans showing said increased setback, maximum
55% lot coverage and 4 bedrooms shall be submitted in connection
with the building permit.
2. That prior to final building and zoning inspections,
Condition No. 1, above-mentioned, shall be complied with.
5. That approval of this application constitutes approval of
the proposed project only to the extent it complies with the
Anaheim Municipal Zoning Code and any other applicable City
regulations. Approval does not include any action or findings as
to compliance or approval of the project regarding any other
applicable ordinance, regulation or requirement.
BE IT FURTHER RESOLVED that waiver of maximum lot
coverage is denied.
BE IT FURTHER RESOLVED that the City Council of the City
of Anaheim does hereby find and determine that adoption of this
Resolution is expressly predicated upon applicant's compliance with
each and all of the conditions hereinabove set forth. Should any
such condition, or any part thereof, be declared invalid or
unenforceable by the final judgment of any court of competent
jurisdiction, then this Resolution, and any approvals herein
contained, shall be deemed null and void.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim ~.,his 28th day of July, 1987.
