2004-031 RESOLUTION NO. 2004- 31 A RESOLUTION OF CITY COUNCIL OF THE CITY OF ANAHEIM, CALIFORNIA, MAKING APPLICATION TO AND REQUESTING THE LOCAL AGENCY FORMATION COMMISSION OF ORANGE COUNTY TO TAKE PROCEEDINGS PURSUANT TO THE LOCAL GOVERNMENT REORGANIZATION ACT OF 2000 FOR THE CITY OF ANAHEIM TO ANNEX APPROXIMATELY 70.45 ACRES OF PROPERTY WITHIN ITS SPHERE OF INFLUENCE, AND FILE ANNEXATION NO. 285 WHEREAS, the City of Anaheim (the "City") will file an application with the Orange County Local Agency Formation Commission to annex unincorporated territories referred to as 4-AN-1, 4-AN-2, 4-AN-3, and 4-AN-5 as set forth in Exhibit A, attached hereto and by this reference incorporated herein; and WHEREAS, the proposed annexation areas are included in the Land Use Element of the City's General Plan and designated therein, respectively, as follows: 4-AN-1 - Low Density Residential (Portion A) Low-Medium Density Residential (Portion B) 4-AN-2 - General Industrial (Portion A) Water Uses (Portion B) 4-AN-3 - Low-Medium Density Residential 4-AN-5 - Low-Medium Density Residential; and WHEREAS, the proposed annexation areas have been pre- zoned by the City into the following zoning designations of the City which designations shall become effective as to each area upon completion of annexation proceedings as to said respective area: 4-AN-1 - RS-7200 (Residential, Single-Family) Zone (Portion A) RS-3000 (Residential, Multiple-Family) Zone (Portion B) 4-AN-2 - ML (General Industrial) Zone (Portion A) RS-A-43,OOO (Residential/Agricultural) Zone (Portion B) 4-AN-3 - RS-5000 (Residential, Single-Family Zone 4-AN-5 - RM-3000 (BCC) (Residential, Multiple-Family, Brookhurst Commercial Corridor Overlay) Zone WHEREAS, this proposed annexation will be subject to the following terms and conditions: the annexation shall be consistent with Government Code Section 56375 and other applicable law existing as of the date of the filing of this Resolution; and "'IT , T' .", T' WHEREAS, the reasons for this proposed annexation are as follows: to increase the economy and efficiency of government services as well as coordination of urban planning efforts and enhancement of community identity; and WHEREAS, on December 9, 2002 and April 9, 2003 City and LAFCO staff held a community meeting for the residents and property owners of the territories to address any concerns about the proposed annexation; and WHEREAS, the City and the Municipal Water District of Orange County ("MWDOC") are member agencies of the Metropolitan Water District of Southern California ("MWD") and any annexation of territory to one MWD agency shall be accompanied by a concurrent detachment from the other. WHERAS, California Revenue and Taxation Code 99 allow cities and counties to adopt and approve property tax exchange agreements to set forth the exchange of such revenues following the addition to a city of previously unincorporated territory; and WHEREAS, the City and the County of Orange have reached agreement and will exchange property tax per the Master Property Tax Transfer Agreement (County Resolution 80-1903), whereby the City shall receive approximately 42.47% of the property tax and the County shall receive approximately 57.52% of the property tax generated. NOW THEREFORE, BE IT RESOLVED, that the City Council of the City of Anaheim, California, does hereby approve the Resolution of Application for Annexation No. 285, and requests the Local Agency Formation Commission of Orange County take proceedings for the annexation of territories to the City, which territories are described herein as areas 4-AN-1, 4-AN-2, 4-AN-3 and 4-AN-5 (as shown in Exhibit 1, attached hereto and incorporated herein by this reference), according to the terms and conditions stated above and in the manner provided by the Cortese-Knox-Hertzberg Local Government Reorganization Act of 2000. BE IT FURTHER RESOLVED, that the City does hereby approve the property tax exchange agreement reached between the City and the County of Orange, whereby upon completion of the annexation, the City shall receive approximately 42.47% of the property tax and the County shall receive approximately 57.52% of the property tax generated from the annexed area. ...,. , .,..
