A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM OPPOSING CALIFORNIA SENATE BILL 12
"LOCAL GOVERNMENT: PLANNING AND ZONING:
WILDFIRES"
WHEREAS, California State Senate Bill 12 was introduced by Senator Mike McGuire on
December 7, 2020 relating to planning and zoning: wildfires; and
WHEREAS, Senate Bill 12 is an act to amend Sections 65007, 65302, 65584, 65584.04,
and 65584.06 of, and to add Sections 65011, 65012, 65013, 65040.18, 65302.11, 65860.2,
65865.6, 65962.3, and 66474.03 to, the Government Code, to amend Section 13132.7 ofthe Health
and Safety Code, and to amend Section 4290 of, and to add Section 4123.6 to, the Public Resources
Code, relating to local government; and
WHEREAS, while elements of the legislation which encourage retrofitting of existing
structures to harden against wildfires may have merit, state lawmakers should include funding for
implementation to offset administrative burdens which may be faced by city departments; and
WHEREAS, as drafted, Senate Bill 12 may be infeasible and unachievable for many new
housing projects in Anaheim and in California; and
WHEREAS, Senate Bill 12 may be improved by consideration of evidence gathered from
experience in building fire resistant communities. Recently developed master -planned
communities have received national recognition as the nation's leader in implementing fire
protection strategies; and
WHEREAS, California's homebuilders are on the leading edge of design and technology
that makes homes more energy efficient, water conserving, emissions reducing, and fire safe; and
WHEREAS, Senate Bill 12 may open the door to new regulation, which, in turn, will likely
place new burdens on housing development at the same time the state is suffering a housing crisis;
and
WHEREAS, Senate Bill 12 vests broad authority in the Governor's Office of Planning and
Research (OPR), thereby removing local land -use discretion and reducing local control.
NOW, THEREFORE, BE IT RESOLVED the City Council of the City of Anaheim stands
in opposition to Senate Bill 12, which requires the State Fire Marshal (SFM) to incorporate OPR's
Fire Hazard Planning -General Plan Technical Advice Series into SFM's statewide, standards for
developments of 100 or more residential units, and in doing so would give the OPR control over
the state's decision-making process with regards to planning for future housing needs and further
erode local control.

BE IT FURTHER RESOLVED, that the City Council of the City of Anaheim will transmit
copies of this resolution to the Chair of the California Senate Appropriations Committee and to
the author for appropriate distribution.
THE FOREGOING RESOLUTION is approved and adopted by the City Council of the
City of Anaheim this 2 2 day of June , 2021 by the following roll call vote:
