RESOLUTION NO. 98R-I08
A RESOLUTION OF THE ANAHEIM CITY COUNCIL APPROVING THE
FINAL ENVIRONMENTAL IMPACT REPORT FOR THE WEST
ANAHEIM COMMERCIAL CORRIDORS REDEVELOPMENT PROJECT
AND MAKING CERTAIN FINDINGS THEREWITH
WHEREAS, as the Lead Agency the Anaheim Redevelopment Agency (the "Agency") has
prepared and certified an Environmental Impact Report (the "ErR") on the Redevelopment Plan
for the West Anaheim Commercial Corridors Redevelopment Project (the "Project") pursuant
to the California Environmental Quality Act (public Resources Code Sections 21000, et seq.:
"CEQA"), the Guidelines for Implementation ofthe California Environmental Quality Act (14
California Code of Regulations, Sections 15000, et seq.: the "State CEQA Guidelines"), and
procedures adopted by the Agency relating to environmental evaluation of public and private
projects; and
WHEREAS, the Agency transmitted for filing a Notice of Completion of the Draft ErR
and thereafter in accordance with the State CEQA Guidelines forwarded the Draft ErR to the
State Clearinghouse for distribution to those agencies which have jurisdiction by law with
respect to the Project and to other interested persons and agencies, and sought the comments
of such persons and agencies; and
WHEREAS, notice to all interested persons and agencies inviting comments on the
Draft EIR was published in accordance with the provisions of CEQA and the State CEQA
Guidelines; and
WHEREAS, the Draft EIR was thereafter revised and supplemented to adopt changes
suggested, to incorporate comments received during the public review period pursuant to CEQA
and the State CEQA Guidelines, and to provide the Agency's and City of Anaheim's ("City") and
the Anaheim Redevelopment and Housing Commission's ("Commission") responses to said
comments, and as so revised, a Final EIR has been submitted to the Agency; and
WHEREAS, a joint public hearing between the Commission, the Agency and the City
Council was held on the Project and the Final EIR on June 16, 1998, following notice duly and
regularly given as required by law, and all interested persons expressing a desire to comment
thereon or object thereto have been heard; and
WHEREAS, the Final EIR consists of the Draft EIR, as revised and supplemented to
incorporate all comments received during the public review period and the responses of the
Agency, the Commission and the City thereto; and
WHEREAS, the Agency made and adopted the Findings of Fact Relating to the
Environmental Impact of the West Anaheim Commercial Corridors Redevelopment Project and
Mitigation Monitoring Plan (the "Agency Resolution"); and
WHEREAS, the Agency has found and determined that the Project will not have a
significant effect upon the environment; and

WHEREAS, based on such Findings of Fact, the Agency has found that significant
environmental effects have been reduced to an acceptable level in that all significant
environmental effects have been eliminated or reduced to insignificant levels; and
WHEREAS, the City is a Responsible Agency, as defined in Section 21069 ofthe Public
Resources Code, with respect to the Project.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim as
follows:
Section 1. The City Council has evaluated all comments, written and oral, received
from persons who have reviewed the Draft EIR. Having duly reviewed and considered the
Final EIR prepared and certified by the Agency for the Project, the City Council finds that the
Final EIR represents the independent judgment of the City Council.
Section 2. The City Council hereby makes and adopts the Findings of Fact Relating
to the Environmental Impact of the West Anaheim Commercial Corridors Redevelopment
Project as set forth in Exhibit "A" attached hereto and incorporated by this reference (including,
without limitation, the mitigation measures therein set forth). Based on such Findings of Fact,
the City Council hereby finds that significant environmental effects have been reduced to an
acceptable level in that all significant environmental effects have been eliminated or reduced
to insignificant levels. Based on the foregoing, the City Council finds and determines that the
Project will not have a significant effect upon the environment.
Section 3. The City Council hereby adopts the Mitigation Monitoring Plan In
Exhibit "B" attached hereto and incorporated herein by this reference.
Section 4. The City Clerk is hereby directed to file a Notice of Determination with
the County Clerk of the County of Orange pursuant to the provisions of Section 21152 of CEQA
and Section 15096(i) of the State CEQA Guidelines.

I. ENVIRONMENTAL EFFECTS FOUND NOT TO BE SIGNIFICANT
The Final EIR for the West Anaheim Commercial Corridors Redevelopment Project
identified the following effects of the Project to be adverse but less than significant:
A. Population and Housing
B. Public Utilities - Electrical Power
C. Public Utilities - Solid Waste
Finding
Changes or alterations have been required for, or incorporated into, the
Project that avoid or substantially lessen the potential adverse, but less than
significant, environmental effects identified in the Final EIR.
Facts in Support of Finding
The Final EIR found that existing federal, state, and local requirements and
the City standard project review procedures will reduce effects in most of the above areas of
environmental concern to a level of insignificance. In addition, the Final EIR and Mitigation
Monitoring Plan also include mitigation measures under the headings of "Land Use," "Traffic and
Circulation," "Air Quality," "Hazards," "Water" and "Wastewater" developed to further reduce
potential effects in these areas of environmental concern.
The Final EIR also identified Project effects on portions of "Land Use,"
"Population and Housing," "Geology and Seismicity," and "Public Services" to be neither adverse nor
significant. These impacts were identified to be potentially beneficial.
II. POTENTIALLY SIGNIFICANT ENVIRONMENTAL EFFECTS FOUND TO BE
MITIGATED TO A LESS THAN SIGNIFICANT LEVEL
A. LAND USE
Significant Effects
A number of residences and businesses could be displaced by other
development in the Amendment Area. Additionally, the Alternative Land Use Scenario may be
inconsistent with the existing General Plan.
Findings
1. Changes or alterations have been required in, or incorporated into, the
Project which avoid or substantially lessen the potential significant
environmental effects identified in the Final EIR.

1. Displaced residents will be located in conformance with a feasible
relocation plan in conformance with the Community Redevelopment
Law. Additionally, the Agency is mandated to set aside 20 percent of
tax increment revenues for low- and moderate-income housing.
2. Displaced businesses will be given an opportunity to relocate within
the Amendment Area if feasible and provided with relocation
assistance as required by State law and the opportunity to participate
in redevelopment activities.
3. A General Plan Amendment will be required to mitigate any
inconsistencies with the existing General Plan if the Alternative Land
Use Scenario is adopted.
B. GEOLOGY/SEISMICITY
Significant Effects
The Norwalk Fault is located just North of the Amendment Area.
Implementation of the Redevelopment Plan will result in additional development in the Amendment
Area. Consequently, in the event of a major earthquake, this development could expose additional
people and structures to ground shaking and liquefaction hazards.
Findings
1. Changes or alterations have been required in, or incorporated into, the
Project which avoid or substantially lessen the potential significant
environmental effects identified in the Final EIR.
Facts in Support of Findings
1. The Amendment Area has not been delineated by the State Geologist
as a Special Study Zone subject to potentially active surface rupture-
type faults. Additionally, new development will have the benefit of
demolishing or rehabilitating some older structures that were not
constructed to current seismic safety standards. Finally, such new
development will be constructed to current seismic standards.

C. HYDROLOGY
Significant Effects
Greater development in the Amendment Area will result in greater
proportions of impervious surfaces, adversely impacting total runoff. Water quality could also be
affected by run off containing pesticides and fertilizers applied to new landscaping and from potential
spills or improper management of chemicals. Additionally, increased development could result in
additional consumption of groundwater resources
Findings
I. Changes or alterations have been required in, or incorporated into, the
Project which avoid or substantialIy lessen the potential significant
environmental effects identified in the Final EIR.
Facts in Support of Findings
The impacts wilI be mitigated as a result of the public improvements to
OCWD facilities as listed in the Final EIR. The improvements will be incorporated in the
implementation program for the Redevelopment Plan. The Project will generate new sources of
funding to pay for such improvements. The improvements include the folIowing:
1. Widening at Carbon Canyon Channel from Knott A venue to Dale
Avenue along with three bridge modifications.
2. Modification of existing retarding basin structure sill heights at Gilbert
Retarding Basin
3. Stabilization of the channel side slopes at channel section experiencing
rip rap settlement between the Gilbert Retarding Basin and the
Crescent Retarding Basin.
4. Provision of an inlet structure into Carbon Canyon Creek, a pump
station, or raising pad elevations at Lincoln and Magnolia,
5. Inclusion of general flood control and drainage improvements as listed
in Section 4.4.3 of the Final EIR.
AdditionalIy, al\ new and rehabilitated development wilI be required to
comply with County DAMP and NPDES thereby mitigating impacts on water quality to a level of

D. TRAFFIC AND CIRCULATION
Significant Effects
The Final EIR identified two intersections that may be significantly affected
by future development in the Amendment Area under the General Plan Scenario.
Findings
1. Changes or alterations have been required in, or incorporated into, the
Project which avoid or substantially lessen the potential significant
envirorunental effects identified in the Final EIR.
Facts in Support of Findings
1. Prior to approval of new development in the Amendment Area, a
traffic study will be prepared if required by the Director of Public
Works identifying any project generated increases that exceed the
threshold for significance and appropriate mitigation measures. The
mitigation measures shall be in place before proceeding with the
development.
2. The Mitigation measures in the Final EIR and Mitigation Monitoring
Plan include adding an second eastbound and westbound left-turn lane
at the intersection of Knott A venue and Ball Road, and construction of
a westbound right-turn lane at Beach Boulevard and Orange Avenue.
These measures will fully mitigate potential impacts and result in
intersections operating at an acceptable level of performance (Level of
Service D or better).
E. Am QUALITY
Significant Effects
The Final EIR has identified construction activity impacts and operational
activity impacts to air quality.
Findings
1. Changes or alterations have been required in, or incorporated into, the
Project which avoid or substantially lessen the potential significant
envirorunental effects identified in the Final EIR.

Facts in Support of Findings
1. Ridesharing programs, traffic flow improvements, parking
management, land use strategies, transit programs, non-motorizes
strategies and other programs have been incorporated into the
redevelopment activities in the Amendment Area and are set forth in
the Mitigation Monitoring Program.
F. HAZARDS
Significant Effects
Due to the average age of the structures in the Amendment Area, the potential
for hazardous materials being present, particularly lead based paint and asbestos, are high.
Additionally, the Final EIR identifies 114 hazardous material users and/or generators in the
Amendment Area and 42 registered underground storage tanks. Additionally, the age of the tanks
coupled with the higher groundwater levels in this area means that contamination may quickly spread
to local water supplies resulting in more costly cleanups. A 20-acre site in the Amendment Area was
used as a landfill up until approximately 1961. Methane gas emanating from the landfill is collected
from wells on the site.
Findings
1. Changes or alterations have been required in, or incorporated into, the
Project which avoid or substantially lessen the potential significant
enviromnental effects identified in the Final EIR.
Facts in Support of Findings
1. All future development in the Amendment Area will be required to
comply with applicable City, State and federal laws governing
hazardous materials
2. The Project will provide a potential new source of funding to mitigate
existing hazardous conditions.
3. Complete soil test and analysis shall be performed before development
on sites with known hazardous conditions. If contamination exist, no
development shall be allowed on the site until the site is remediated.
4. Applicants for development on or adjacent to the Sparkes-Rains
Landfill, Anderson Pit and Davis Dump sites must evaluate the affects
of landfill gas and differential settling and comply with LEA control
measures. Additionally, these applicants must evaluate whether
increased infiltration of liquid into the refuse will occur and provide
appropriate mitigation as required by the Santa Ana Regional Water
Quality Control Board, the LEA, and the City.

G. NOISE
Significant Effects
The Final EIR identified potential noise impacts as a result of construction
activity and increased traffic volume.
Findings
I. Changes or alterations have been required in, or incorporated into, the
Project which avoid or substantially lessen the potential significant
environmental effects identified in the Final EIR
Facts in Support of Findings
Project related construction noise should be limited by conditions on
construction permits limiting work to the least noise sensitive hours, erection of solid barriers if
feasible if heavy equipment use is planned to occur for more than two weeks, and specify access
routing to minimize noise.
H. PUBLIC SERVICES - FIRE PROTECTION
Significant Effects
The Final EIR identified potential impacts on fire protection services as a
result of increased urban uses.
Findings
I. Changes or alterations have been required in, or incorporated into, the
Project which avoid or substantially lessen the potential significant
environmental effects identified in the Final EIR.

I. Implementation of the Redevelopment Plan will stimulate new
development and rehabilitation of older structures which would be
required to follow more stringent current fire codes which include use
of, among other things, fire resistive construction material and
sprinkler systems.
I. PUBLIC SERVICES - POLICE PROTECTION

The Final EIR identified potential impacts on police protection services as a
result of increased urban uses.
Findings
1. Changes or alterations have been required in, or incorporated into, the
Project which avoid or substantially lessen the potential significant
environmental effects identified in the Final EIR.
Facts in Support of Findings
1. The Project proposes to abate present blighting conditions which may
contribute to crime. The Amendment is expected to improve traffic
and circulation. Additionally, new and rehabilitated development will
incorporate better building design, lighting, security hardware and
visibility than currently exist in the Amendment Area.
2. The Project is expected to result in new sources of funding that could
be used to finance additional personnel and facilities.
J. PUBLIC SERVICES - SCHOOLS
Significant Effects.
The Final EIR identified potential impacts on school districts serving the
Amendment Area and whose schools are over capacity or approaching capacity due to the anticipated
generation of additional students.
Findings
1. Changes or alterations have been required in, or incorporated into, the
Project which avoid or substantially lessen the potential significant
environmental effects identified in the Final EIR.
2. Such changes or alterations are within the responsibility and
jurisdiction of another public agency and not the agency making the
finding. Such changes have been adopted by such other agency or can
and should be adopted by such other agency.
Facts in Support of Findings
1. The Community Redevelopment Law requires that the school districts
and community college districts within the Amendment Area receive
mandatory tax increment sharing payments as a result of the
Redevelopment Plan. These payments will be used to provide
facilities and ongoing educational programs. Additionally, the school

districts currently collect development impact fees to the maximum
extent allowable by law.
2. Other changes are within the responsibility and jurisdiction of the
school districts and the State of California. These changes include the
districts continuing to collect development impact fees as authorized
by State law, making regular and timely applications for State
construction funds, pursuing alternate means of financing schools as
those are made available through changes in State law, and using
year-round schedules and double sessions as necessary and
appropriate. Also, these changes include the State continuing to
finance construction of new schools and classrooms in response to
enrollment increases.
K. PUBLIC SERVICES - PARKS AND RECREATION
Significant Effects
The Final EIR identified potential impacts on park and recreation facilities as
a result of increased population levels in the Amendment Area.
Findings
1. Changes or alterations have been required in, or incorporated into, the
Project which avoid or substantially lessen the potential significant
environmental effects identified in the Final EIR.

The Project is expected to result in new sources of funding that could be used
to finance park and recreation facilities.

L. PUBLIC UTILITIES - WATER SUPPLY
Significant Effects
The Final EIR identified potential impacts to the City's water distribution
system as a result of build out of the Amendment Area.
Findings
1. Changes or alterations have been required in, or incorporated into, the
Project which avoid or substantially lessen the potential significant
environmental effects identified in the Final EIR.
Facts in Support of Findings
1. The Redevelopment Plan contains an implementation plan that details
facility improvements in the Amendment Area
2. Water design requirements shall be subject to the provisions of site
plan review by the City
3. Required water system improvements shall be in place prior to the
issuance of any building permits in the Amendment Area.
4. City ordinances and other actions regulating the use of water shall
apply to all new and substantially rehabilitated development in the
Amendment Area.
5. Water conservation measures recommended by the California
Department of Water Resources shall be incorporated in all new or
substantially rehabilitated projects.
M. PUBLIC UTILITIES - WASTE WATER
Significant Effects
The Final EIR identified increased generation of waste water from residential,
commercial and industrial land uses.
Findings
1. Changes or alterations have been required in, or incorporated into, the
Project which avoid or substantially lessen the potential significant
environmental effects identified in the Final EIR.

I. The Redevelopment Plan contains an implementation plan that details
wastewater facility improvements in the Amendment Area
2. Sewer design requirements will be subject to provisions of site plan
review by the City.
3. Industrial users must demonstrate that on-site measures will reduce the
load strength of the sewage.
4. Implementation of water conservation mitigation measures will reduce
per unit sewage flows.
N. CULTURAL RESOURCES
Significant Effects
The majority of the Amendment Area has not been previously surveyed
relative to paleontolgical and archaeological resources.
Findings
I. Changes or alterations have been required in, or incorporated into, the
Project which avoid or substantially lessen the potential significant
environmental effects identified in the Final EIR.
Facts in Support of Findings
I. All areas in the Amendment Area where the ground surface is
exposed shall be surveyed by a qualified archaeologist prior to any
earth removal or disturbance.
2. Where ground surface is not visible, a qualified archeologist shall be
present to conduct monitoring activities during any earth removal or
disturbances.

III. FINDINGS CONCERNING THE PROJECT ALTERNATIVES
Six alternatives to the proposed Project are evaluated in the Final EIR. The City of Anaheim
has reviewed and considered such alternatives in light of the adverse environmental effects which
may result from the Project and the reduction or elimination of such effects which may be
accomplished by selection of the alternatives.
The alternatives are summarized below, and specific economic, social, or other
considerations that render such alternatives infeasible are set forth.
No Project
The no additional development alternative, required by law to be considered the "no project"
alternative, considers the impacts associated with no additional development beyond what currently
exists in the Amendment Area. This alternative is used to establish a baseline to which all other
alternatives, including the proposed Project, can be compared.
The "no additional development" alternative is considered environmentally inferior to the
proposed Project, because it would not generate any additional or new environmental impact.
However, this alternative would not achieve the stated goals and objectives of the Redevelopment
Plan which include eliminating blight conditions, promoting new continuing private sector
investment, facilitating commercial sales activity, expanding existing businesses, and creating local
job opportunities, all of which rely on additional new development. Failure to achieve these goals
and objectives makes this alternative infeasible.
Accordingly, the City of Anaheim finds that the "no additional development" alternative is
infeasible.
Increased Residential Development
This alternative considers developing up to 1,095 more dwelling units in the Amendment
Area than proposed by the General Plan. These units would be developed on 86 acres of land that
the Project proposes to develop with commercial uses. Under this alternative, the Amendment Area
would have a total of up to 1,141 units. As a result of developing additional land with these housing
units, non-residential development would be reduced by approximately 951,242 square feet.
This alternative could increase demand for utilities and public facilities. However, impacts to
population and housing, traffic, electrical service and solid waste would be less that the proposed
project. Although the alternative has the potential to eliminate blighted commercial areas with new
housing, the alternative may be difficult for the City to implement and wiIl require an amendment to
the General Plan. Consequently, this alternative is considered neither superior nor inferior to the
Project.
Accordingly, the City of Anaheim finds that the "more residential development" alternative is
considered an environmentaIly equivalent alternative but may be difficult to implement because it
would require a General Plan amendment.

Reduced Amendment Area Boundaries
This alternative considers reducing the Amendment Area. Because the Amendment Area is
already concentrated around Beach Boulevard, Lincoln Avenue, Orange Avenue and Ball Road, few
scenarios for reduction exist that would not interfere with the integrity of the Project. To the extent
that a sub-area is removed, the financial ability to assist with public improvements would be reduced.
Thus, eliminating this area from redevelopment would preclude an achievement of the goals and
objectives of the proposed Project to eradicate blighting conditions and prevent their reoccurrence in
the entire Amendment Area. The inability to achieve these goals and objectives makes this alternative
infeasible.
Accordingly, the City of Anaheim finds that the "smaller amendment area" alternative is
infeasible.
Extend Amendment Area Boundaries
This alternative assumes that the Amendment Area would be expanded to include residential
properties between Lincoln Avenue and Ball Road. However, a preliminary review of these areas is
inconclusive regarding the presence of significant blighting conditions. Moreover, inclusion of the
area is not considered environmentally superior because it would not reduce, and might increase,
environmental impacts.
Accordingly, the City of Anaheim finds that extending the Amendment Area Boundaries is
infeasible.
Alternative Financing
Under this alternative, the Agency would not use tax increment financing but rely solely on
other sources of funding to implement the Project's anticipated improvements and programs. This
alternative would have the same environmental impacts; however, this alternative is not
environmentally superior to the Project because the scope of public improvements would be limited
due to reduce financial resources.
Accordingly, the City of Anaheim finds that this alternative is infeasible.

Alternate Sites
An alternative site must first meet the blight requirements set forth in the Community
Redevelopment Law. Selection of an alternative amendment area would mean that no benefits
associated with redevelopment would be attained in the Amendment Area. Thus redevelopment in
the proposed Amendment Area would occur at a slower rated and not meet the basic objectives of the
Project.
Accordingly, the City of Anaheim finds that the "alternate location" alternative is infeasible.

FINDINGS RELATING TO THE ENVIRONMENTAL IMPACT OF
THE WEST ANAHEIM COMMERCIAL CORRIDORS
REDEVELOPMENT PROJECT
INTRODUCTION
This document presents findings that must be made prior to approval of the Project
pursuant to Section 21081 of the Public Resources Code and Section 15091 of the State CEQA
Guidelines. Under CEQA, the decision maker is required to make written findings explaining
how it has dealt with each alternative and each significant environmental impact identified in
the draft environmental impact report and final environmental impact report. The possible
findings are:

avoid or substantially lessen the significant environmental effect as identified in
the Final ElR.
. Such changes or alterations are within the responsibility and jurisdiction of
another public agency and not the agency making the finding. Such changes

provision of employment opportunities for highly trained individuals make
infeasible the mitigation measures or project alternatives identified in the Final
EIR.

record.

MITIGATION MONITORING
PROGRAM
The following environmental mitigation measures shall be incorporated
into individual development projects within the Amendment Area as
conditions of approval, as appropriate. Individual project applicants
shall secure a signed verification for each of the mitigation measures
included as conditions of approval, which indicates that mitigation
measures have been complied with and implemented, and fulfills the
City's environmental and other requirements. (Public Resources Code
Section 21081.6.) Final clearance shall require all applicable
verification as included in the following table. The City of Anaheim
Planning Department will have primary responsibility for monitoring
and reporting the implementation of most of the mitigation measures.

numbered for ease of reference.
