AP, A 200/, - 5 A RESOLUTION OF THE ANAHEIM REDEVELOPMENT AGENCY CONSENTING TO HOLDING A JOINT PUBLIC HEARING WITH THE CITY COUNCIL OF THE CITY OF ANAHEIM ON THE PROPOSED REDEVELOPMENT PLAN AMENDMENTS TO MERGE THE ALPHA, RIVER VALLEY, PLAZA, COMMERCIAL/INDUSTRIAL, WEST ANAHEIM COMMERCIAL CORRIDORS AND STADIUM REDEVELOPMENT PROJECTS WHEREAS, the Anaheim Redevelopment Agency ("Agency") is a community redevelopment agency organized and existing under the California Community Redevelopment Law, Health and Safety Code Section 33000, et. seq., ("CRL") and has been authorized to transact business and exercise the powers of a redevelopment agency pursuant to action of the City Council of the City of Anaheim ("City Council"); and WHEREAS, on July 19, 1973, by Ordinance No. 3190, the City Council approved and adopted a redevelopment plan for the Alpha Redevelopment Project and subsequently amended the redevelopment plan seven times to delete territory from the project area, modify land uses, and establish fiscal and time limits in compliance with Assembly Bill 1290 ("AB 1290"), Senate Bill 1045 ("SB 1045"), Senate Bill 211 ("SB 211") and other provisions ofthe CRL ("Alpha Project"); and WHEREAS, on November 29, 1983, by Ordinance No. 4463, the City Council adopted a redevelopment plan for the River Valley Redevelopment Project and subsequently amended the redevelopment plan five times to modify land uses and establish time limits in compliance with AB 1290, SB 1045, SB 211 and other provisions of the CRL ("River Valley Project"); and WHEREAS, on June 12, 1990, by Ordinance No. 5136, the City Council adopted a redevelopment plan for the Plaza Redevelopment Project and subsequently amended the redevelopment plan twice to establish time limits in compliance with AB 1290, SB 1045 and other provisions of the CRL ("Plaza Project"); and WHEREAS, on December 7, 1993, by Ordinance No. 5412, the City Council adopted a redevelopment plan for the Brookhurst Commercial Corridor Redevelopment Project and subsequently amended the redevelopment plan three times to add territory to the project area, including renaming the project area the West Anaheim Commercial Corridors Redevelopment Project, and establish time limits in compliance with AB 1290, SB 1045 and other provisions of the CRL ("West Anaheim Project"); and WHEREAS, on December 21, 1993, by Ordinance No. 5415, the City Council adopted a redevelopment plan for the Commercial/Industrial Redevelopment Project and subsequently amended the redevelopment plan twice to establish time limits in compliance with AB 1290, SB 1045 and other provisions of the CRL ("Commercial/Industrial Project"); and F:\Docs\DEVSVCS\RESOLUTNLahr4315B.doc WHEREAS, on August 9, 1994, by Ordinance No. 5442, the City Council adopted a redevelopment plan for the Stadium Redevelopment Project ("Stadium Project"); and WHEREAS, the "Existing Plans" consist of the Redevelopment Plans, as amended, prepared for the Alpha Project, River Valley Project, Plaza Project, Commercial/Industrial Project, West Anaheim Project, and the Stadium Project and the territory included within the Existing Plans is referred to as the "Existing Project Areas"; and and WHEREAS, the Agency is vested with the responsibility to carry out the Existing Plans; WHEREAS, the Agency desires to amend each of the Existing Plans ("Amendments") to merge the Existing Project Areas in order to combine the tax increment revenues from the Existing Project Areas and rcallocate thc revenues to and among the entire merged project area ("Merged Project Area") that will best facilitate the revitalization of blighted areas through economic vitality and increase and improve housing opportunities; and WHEREAS, the Agency also desires to amend the land use provisions of the Redevelopment Plan for the Alpha Project in order to be consistent with the City of Anaheim's General Plan, as the General Plan may be amended from time to time; and WHEREAS, the Agency has submitted the proposed Amendments to the Planning Commission of the City of Anaheim for its report and recommendations, and the Planning Commission on March 22, 2004, reviewed the proposed Amendments, determined the proposed amendments are consistent with the City's General Plan and recommended approval of the proposed Amendments; and WHEREAS, pursuant to the provisions of the CRL Sections 33486, 33457.1, 33452, 33454 and 33458 there is a need for a joint public hearing of the City Council and the Agency in order to receive testimony from any and all interested persons, including: property owners, business owners, tenants, community organizations, and any other interested groups and/or citizens, with respect to the proposed Amendments and related items; and WHEREAS, the Agency will prepare the required Notice of Joint Public Hearing pursuant to CRL Sections 33486 and 33452. NOW, THEREFORE, THE ANAHEIM REDEVELOPMENT AGENCY DOES HEREBY, FIND AND RESOLVE AS FOLLOWS: 1. The Agency hereby approves the convening of a joint public hearing with the City Council on May 11, 2004, at 5:00 p.m., or as soon thereafter as possible, in the City of Anaheim City Council Chambers, City Hall East, 200 S. Anaheim Boulevard, Anaheim, California 92805, for the purpose of receiving testimony and considering the proposed Amendments and other related matters. 2. Agency staff is hereby directed to work with the City Clerk and Agency advisors in the mailing of a copy of the aforesaid notice and related materials attached herewith, pursuant to Sections 33486 and 33452 of the CRL, to the last known assessee of each parcel of land within the Existing Project Areas as shown on the last equalized assessment rolls of Orange County and the State of California. The notice shall be sent to all property and business owners, tenants and residents within the Existing Project Areas, and to all affected taxing entities, which receive a portion of the ad valorem taxes levied on properties within the Project Areas. 3. Agency staff is hereby directed to work with the City Clerk and Agency advisors in the publishing of the aforesaid notice, including a map and a reference to the availability of the legal description for the Existing Project Areas (as recorded with the Orange County Recorder), prior to the date of the joint public hearing in a newspaper of general circulation for period not less than once a week for four (4) consecutive weeks. The notice shall be published in the Orange County Register and/or Anaheim Bulletin on April 13, 20 and 27 and May 4, 2004 to satisfy this requirement.
